    Alright Billy, show us the particular “special” law which limits any UN Charter rights. The specific resolution which spells out that the Falkland Islanders' right to self determination is limited.

    Isolde, I don´t have to prove the law, you can find all Falklands/Malvinas resolutions in the web.

    There is a basic principle in common law and in the continental system, specific law derogates general law, and this is the case. As UN says, Falk/Malv is an special and unique case, because of that it has special resolutions that must be follow by the parts; Argentina and UK as UN stats.

    Marcos- please come up with FACT and EVIDENCE that shows the non military civilian sttlers here were evicted by the British as you claim in 1833.
    Come up with clear evisence and proof - or SHUT UP!

    WE kown that the FACTS - as verifiable by documents in Arg Archives as well as British Archives show that:
    The miltia from Buenos Aires were told to leave - and did so

    The civilian settlers some of whom had beent here for a year or so- no more - were invited to stay or leave voluntarily of their own free will.
    4 people - 2 couples left - one Uruguyan and 1 Breazillian. ALL others stayed on.

    Their presence still on the Islands was referred to and written down by Charles Darwin when he visited soem 10-12 years later.

    At least one of them - alday- married an English settler - and that family still has descendants here today.

    The lasy of the original folk from 1833 dies arounf 1870 and is buried here in Stanley Cemetery,

    Now the above are FACTS - easily verifiable.

    Now you come up with FACTS and VERIFICATION that support your story - or Shut Up.

    @13 Tell us, Billy boy. Is that “special case” not a determination of the Fourth Committee. A Committee that has NO power. A Committee whose draft resolutions usually don't make it to the General Assembly. And as pointed out @6 GA resolutions are only advisory. Historically, of course, Argentina is notable for ignoring Security Council resolutions. Much like Saddam Hussein and Muammar Gaddafi. And we all know what happened to them, don't we?

    The “self determination of people”, nevertheless their race, creed, origen or who their ancestor are is an essential right of the modern international law of the human rigths which is growing up since the signature of the UN CHARTER in 1948. Even so the 2065 UN RESOLUTION that Argentina invokes to claim negotiations about the Malvinas / Falkland issue, state very clear that the “invitation” to the Governments of Argentina and the United Kingdom to find a peaceful solution to the problem is ”bearing in mind the provisions and objectives of the Charter of the United Nations and of General Assembly resolution 1514 (XV) and the interests of the population of the Falkland Islands (Malvinas)” . I know perfectly that my Country ( Argentina) makes a diference between “interest” and “wishes” but this difference is not consistent because under the modern rules of the international humanitarian rights is imposible care the rights of the individuals without ask which they think about which their interest are.

    Like i said in many others comments, it's true that resolution 1514, and the charter of the u. n. have fundaments about self determination, but what your politicians omit, is that both dont let any colonial situation to break the territorial integrity of any country, read resolution 2353 which reffers the gibraltar question, in one of it's paragraphes it describes what's the thought of the u. n respecting the relevancy of territorial integrity.
    On the other hand, if the right to self determination is the paramount, and there is not any other alternative than self determination, then ¿why the international comunity voted twice in 1985 against the british proposals about including references of self determintion for this cause, why in 1947 the u. k. didn't include the dispute of the islands, when it proposed argentina to take the question of the dependencies to the court, why the decolonization committe still considers the malvinas-falkland cause like a special colonial situation, why none of the two parts proposes to take the dispute to the court, if the both are so sure of their rights, like they parrot all the time?.
    I dont deny that maybe self determination is really applicable for this case, but what is really extrange is that none of them proposes to take the dispute to the court, beyond our wishes the best that we can do, is to investigate, we dont have to buy the partial truthes of the politicians, everybody is intelligent, the only one problem is that some of them dont like to make ample analysis, and prefer to buy partial truthes.

    8 Malvinero. It was the US who attacked the Argentine stationed in Malvinas.

    The 28th December, 1832, the USN frigate “Lexington” under cover of a French flag to mislead the Argentine population, the pirate USN captain Silas Duncan, under false pretences (what else could be expected coming from an American?) invited aboard to discuss but instead took prisoners Vernet and his second in command. Then, after destroying all installations and small ships by cannonshots, they invited those in the island to surrended and come aboard.

    Resolution 1514 refers to Non Self Governing territories only, not to all countries. Argentina is not a Non Self Governing territory so is not covered by Resolution 1514. The 6th declaration in 1514 is specifically to stop the territorial disruption of countries Non Self Governing territories undergoing decolonisation. That declaration is for a very specific situation.

    Resolution 2353 does not change that. The paragraph in Res 2353 which mentions territorial integrity does not change anything, in effect it repeats what I've said above. Countries undergoing decolonisation should have their territorial integrity protected during that process.

    Once a country is decolonised, it can do whatever it likes, including splitting up, as long as self determination is respected. There are many cases where this has happened, where due to self determination countries have broken up into smaller portions. Yugoslavia and Czechoslovakia are two recent examples. The jurisprudence supports this as well, in the cases of East Timor, Kosovo and more recently in Southern Sudan the ICJ has found that self determination comes ahead of territorial integrity.

    Argentina cannot claim that its territorial integrity has been disrupted in the Falkland Islands, because a) the UN does not recognise the Falklands as Argentine territory, and never has and b) it is the Falklands which are undergoing decolonisation, not Argentina. Argentina is not on the list of Non Self Governing territories.

    I respect your opinion but i dont agree on it, that paragraph of resolution 2353 shows perfectly what's the thought of the u. n respecting the relevancy of territorial integrity, ¿did you read that resolution really?, beside article 7 of resolution 1514 affirms that the territorial integrity of all the countries must be respected, it doesn't reffer only the non-self governing territories. On the other hand, dont include the kosovo case in dispute, because even the court clarified about the exceptionality of the case, beside you didn't answer the 4 questions of my comment 18, it's interesting to know your answer.
    On the other hand, i have always wondered why you never accepted to read my investigation, i already explained you why i decided not to publish it on line.

    Not being ungrateful or anything but the Argentine contribution to the Allied war effort in both World Wars was next to zero. Hate to say this but you were actually more trouble than you were worth.

    Perhaps you figured more for the for the Facist Axis powers of Italy and Germany even Spain?

    Was interested to learn recently about the soldiers who left the Irish Army so they could join up and fight for Britain against the facists. On their return they suffered terrible prejudice from the Irish State. These are the people that truly deserve our thanks and gratitude.

    Actually you failed at that even more. Argentina's military history has been one long record of failure ever since you intentionally used your black population as cannon fodder through sickeningly disproportionate conscription, and used them to fight your war of independence against Spain, and just about every war for the next few decades.

    Hell the only success you enjoyed was in mass extermination campaigns against unarmed civilians and natives who resisted you stealing their land, but the moment you fought someone who knew how to fight, you were humiliated, and have spent thirty years crying like a spineless wretch about how you were victimized.

    this is also why you spend near equal amounts of time gloating over Spain winning two minor battles in south america against Britain during the Napoleonic wars.

    amazing how extreme nationalism can cause such delusions of grandeur/importance
