Argentina sends top level political mission to Ghana after the ARA Libertad

Argentina is sending a top level ministerial delegation to Ghana to discuss the release of the Navy’s tall vessel ARA Libertad, retained in the African country following a Thursday court ruling which confirmed the seizure on the complaint from a hedge fund. Read full article

    Since their court case failed I wonder if the Argentine government will attempt to bribe the Ghanaian authorities.

    Of course, Ghana is ranked 69 on the world corruption index, whilst Argentina is ranked 100. This means that, should they try to bribe the authorities, they may find themselves in for a shock, as they are booted out of the country, whilst Ghana announces what they have tried to do to the whole world. Of course the Ghanaians would have to seize the bribe money as 'evidence'. ;-)

    No, I think the Argentine government will pay up quietly, then announce loudly to the world that Argentine diplomacy has worked, that they have defeated the evil corrupt vulture fund, and that Ghana supports them in their spurious claims to the Falkland Islands.

    It will be quite interesting to see how this pans out.

    Typical Argentina thinking politians are above the rule of law and therefore they can persuade Ghanas politicians to order the release of the ship in contradiction to a court ruling.

    Sorry argentina, but Ghanas politinians (and yours for that matter) do not have the pwer to over rule an order made in a court of law, as no one, not even politicians are above the law - Clearly argentina likes to think they are.

    11- hit the nail on the head! She assumes that as she has sacked all the straighter judges in Arg. and replaced them with her paid cronies - same system works elsewhere! Ghana probably has its legal system based on the British one that was there before so she may well be in for a shock when she funds that judges there perhaps do NOT like politicians trying to tell them what to do!

    The Ghanian port authorities are getting rather fed up with a 100m long ship blocking one of their loading areas. It's starting to cost them money. They need to find somewhere else to hold her.

    Would be rather cool if it became the new palatial plaything of the hedge fund. They could entertain clients and also advertise what happens to those debtors who don't pay up.

    We have Old Ironsides...the USS Constitution in Boston Harbor. An awesome ship and 200 years old and still a commissioned vessel. I would want to sail her around the Falklands before taking her to NYC though, just for haha's
    Idlehands, I read that always. She berthed in there largest pier and taking valuable space. I suspect that Ghana is going to want her moved rather soon. I am sure no one is paying her harbor fees either.

    Being now an inactive officer in the Chilean Navy, I'm sincerely saddened to see the pride of our Argentinian brothers being caught up in this scandal caused by a corrupt thieving government that was clearly democratically elected. The English have a saying, “You reap what you sow...” and most certainly the humiliation CFK is experiencing is pure schadenfreude for me. (I only wish it had been Tango One instead.).
    As for the crew, there having an experience of their lives to tell thir grandchildren. (Although the Captian must be furious...)
    One last note: the nasty and racist comments regarding Africans and Jews is repulsive and should be removed by the editor.
    Let's hope they pay the 20m and let the issue fade.

    BTW: I had my ski vacation with my family in Argentina and was able to pre-pay at a heavy discount here in Chile resulting in about a 32% savings on about 70% of the normal cost. We paid cash gratuities and purchased clothing “sin boleta” at almost all the shops. As good Chileans, we decided to pretend to think like Argentinians and avoid paying taxes, it was fun! However, upon returning to Santiago, it was back to being “normal” and paying our 19% VAT.

    If i were her Captain, I never would have dock the ship!! Anchored at a distance. Never allow to be held like that....and certainly scuttle the ship as a last resort!! The sensible thing to do is to pay $20 million and get out of Dodge! I think CFK pride is too high for that, better to admonish and save face.     Well, I found the reason for the Ghanian court's reason for setting aside the ship's immunity. Argentina had herself wavered the immunity in an agreement with her creditors.

    If Allende were the capitán, the ship would have lost its way on the high seas and the cadets from educated families would have had their food rations stolen to be redistributed amongst the officers. But let say you make it across the ocean and find yourself in Capitán Carlos María Allievi shoes...you would order your men to fight to the death and never surrender to the capitalist devils, then you would hide in your cabin until your men lost control of the ship...then blow your brains out with your service revolver in the hope that you would become a martyr.

    Mind you if Capitán Carlos María Allievi followed in the noble traditions of the institute that employs him, he would have sedated Allende and thrown him overboard.

    But putting hypothetical Capitan Allende scenarios to one side...failing a legal victory, the only honourable thing to do is scuttle the ship.

    I don’t think it will come to that. I don’t have as much faith in the incorruptibility of the Ghanan legal system as many posters on here. If Ghana is ranked 69th in the global corruption index, that makes it highly likely that a suitcase of cash will fix the problem. One of Chavez’s peons is probably on his way right now.

    Ghana has various defense treaties with some rather powerful countries. Your “force” would be wiped out by “friendly powers” before it could get half way across. In addition, you would piss off the whole of Africa. Certainly worthy of a master strategist like you.
    It may have escaped your notice, but Ghana is a sovereign country with an indigenous BLACK population - unlike Argentina which is a former colony of Spain.
    Use 20 MILLION argentine pesos ? Who is going to accept this abroad for the material you would have to import to start your pet project.
    As to molesting children, you seem to have a fixation on this subject. Is this your hobby when you are not foaming at the mouth in impotent rage. I am sorry you cannot be British but we have rather high standards to keep.

    A suggestion, post a copy of this to the Ghana news agency and a copy to your foreign office delegation now in Ghana.
    DEMAND that your wishes be carried out. I am sure they will acquiesce.

    First, a big thank you and abrazo to all the wonderful people of Argentina who made my family stay at Valle de Las Leñas so wonderful. Although we saved money on taxes, we made sure to support the local economy and gladly paid generous gratuities in Dollars to the staff we came into contact with. The service was of the highest level and we were all treated extremely well. Not one person we met had a kind word for the current CFK government.
    My children insisted I take a few runs on the mild days (alas no black diamonds anymore) and I can eat again beef. What incredible steaks and fantastic Malbecs I sampled! Better than any resort in Chile, by far.

    And yes... We understand that when we're not paying taxes, we're actually committing a crime, but we prefered not to voluntary give it to a corrupt government either.

    I must admit that I'm enjoying the humiliation that CFK is experiencing, and feel she deserves it, but obviously I have mixed feelings on the detention of such an important national image. Chile has a similar beautiful ship as well. I'd be outraged.

    As far as the captain in command of the 'noble Libertad, unless a time of active belligerence, his first responsibility is to the saftey and welfare of his crew. National honor must be maintained, and the captain should not relinquish command without careful admiralty protocol, which every cadet has to study. The government of Ghana I trust will act in a correct manner, and I assume the captain will do everything to comply with his admiralty command. If the admiralty in BA orders the captain to relinquish custody of the ship, but is allowed to disembark “with sword” honor is retained. If the captain is ordered by his commander to surrender, he would be humiliated.

    Unfortunately, the simple act of quietly paying a settlement does not seem to be what CFK will pursue, so I assume this will drag out for some time. Bad press for CFK, and 20m is minor compared to letting this escalate.

    The debt won't just disappear and the Argentine government's refusal to pay, despite losing in the courts has led to this rather dramatic step. CFKC crowed about being above international law but this demonstrates that she is wrong.

    Her feckless attitude to debt is not a good example to set. What if all Argentines decide that they are just not going to pay their debts anymore? Because they just don't want to. Imagine.

    Thanks for the kind comments about my trip. Argentinians are great people, they just seem to have bad luck in choosing political leaders.

    Early in my Naval service, I served briefly as a second officer on a fast attack craft. As young officers, we all agreed we’d rather die than ever “strike ones colors” and surrender to an imaginary overwhelming Argentinian attack. (In those days, Argentina had a vastly superior fleet and we were foolish.)

    In the Naval Academy we studied naval history and I wrote a long paper on the events leading up to the scuttling of the Graf Spree by the very honorable Captain Hans Langsdorff. (His loyalty was not to Hitler, as mine would not be to CFK either.)

    Sinking ones ship in port is almost as humiliating as surrender. A commander of a war vessel has great responsibilities and is honor bound to fight to the death, especially if ordered to do so. If the admiralty of the fleet gave a specific order to scuttle the ship, I would have to comply. (I would note it would be very stupid, complicated and would require at least the assistance of my second officer.) If scuttled at dockside, the ship could be refloated in a week.

    The vessels involved just carried out what was expected of a RN ship.
    An Argentinian would not know what courage is - it must have been bred out of them over the generations with a few exceptions.

    Argentine navy ran for cover. They could have continued with their surface vessel attack
    Army, ran for cover and surrendered.
    The air force was the only arm with any cojones.

    Did you realise that Dad's army is a comedy show where the British laugh at themselves..

    The Japanese had a different mind set from the rest of the world.
    They would commit suicide without any military advantage.

    The Afghani Talibans kill more of their own people for their own misbegotten faiths. Strapping bombs to young children and sending them into market squares to kill as many as possible is murder by proxy - then, I suppose you approve of these things, being morally bankrupt.

    Regarding scuttling the Liberdad. “Think” it would be entirely insane.

    Patriotic men that still feel the of honor to their homeland, but tempered with common sense, would carefully consider with great anguish the destruction of one of the few classic naval cadet training vessels in existence, especially due to political and financial corruption. It would cost OVER 20 it today's modern world to replace the Liberdad with a proper cadet training vessel which is a part of the Argentinian national image.

    There are many ways of destroying a vessels hull, but even if some foolish diplomat was able to smuggle explosive, via diplomatic pouch, into Ghana the key would be to get the vessel into deeper water. And imagine that it's discovered in transit? Another scandal as well. And for what? The honor of a corrupt politician? My stomach turns at the thought, but I also know that as an officer I would be bound to follow Admiraly orders. (It's a bit more complicated of course as there is modern international law that defines criminal actions that an officer could be rightfully prosecuted.)
    There are MANY issues and comments I would add to this conversation, but yes, I prefer to remain reticent.
    If I recover, I'm sincerely thinking about revising the text and publishing in in an ebook format. Unfortunately it's all typewritten and would have to be scanned, converted with software to electronic text and then re-edited.
    I have three other “papers” in addition, of which one would be of interest about the post Falklands War. There is now fascinating declassified material (30 year rule) that would fill in the blanks of much I wrote about in the late 1980's.
    BTW, today's breakfast is Eggs Benedict with smoked salmon.

    How embarrassing for Argentinians. I feel sympathy for the average AR citizen. Even when a symbol of national pride is in jeopardy, but offered back with reasonable terms, CFK's government still has a public tantrum.
    They have made this situation far worse than it could be. And more public.

    Have they no dignity? Pay up the nominal amount quietly, and take your ship home.

While I heartily concur with your assessemet of Hans Langsdorff, who got his ideals from his mentor Admiral Graf von Spee and possibly from the captain of SMS Emden, so lets leave the Esmeralda out of this discussion. Both Arturo Prat and Grau of the Huascar were fine men who died in some of the most bloody naval battles in service of thier countries, most of which are unknown outside South America. Lets not squabble about who owns the Huascar. She is a fine ship and a fitting monument to the courage of both men and thier crews and lets leave it at that

    Well, the Ghanaians are in for it now. TMBOA is personally looking at it so that is going to lead to a complete balls up.

    The court has already decided over what can be admissible as evidence and AG had not got any.

    BTW either the ‘Flagship’ has its transponder turned off or it does not have one (more likely in order to save money).

    So, AG sticks two fingers up to the International Courts when the judgement doesn’t go their way, BUT in matters like this they rush to them rather than pay the ‘Get out of Ghana card fee (USD 20 M plus USD 497,000 and counting dock fees). I wonder where they will go if it ever gets that far?

    Under American Law, which in this case is based on the original English Common Law in terms ot treatment, there is an outstanding writ of execution for enforcement of the judgment issued by a NY Court and substantiated by the UK judgements in favour of Singers companies.     It seems the next step is for Singer to request from the Ghanaians enforcement in their court by means of a ‘found as a fact’ decision allowing the transfer of ownership to take place. There is a time limit of 90 days for the owner of the property to be seized to present payment.

    So AG have 90 days left from Thursday 11th October 2012 to pay the amount in full (or as agreed with Singer) or lose the ship.

    There is no right under this law to ‘hold’ proceedings up while the debtor (AG) goes to an International Court. Can’t see on what basis they can proceed with any claim, but no doubt the weasels will come up with a try-on.

    The whole situation with the Argentinean ship is just a “precursor” for the Europeans about how those “Vulture Funds” operate.

    Of course; Europeans couldn't care less, as long as “Vulture Funds” did operate against “Fringe Countries”.

    But now, those “Vulture Funds”, all of them “incidentally”, based in the British Overseas Territory of the Cayman Islands (the legendary “Tortuga” pirate Island:-) are beginning to operate against European Countries as Greece, Spain, Portugal and very probably Ireland in the near future.

    That will mean that a significant percentage of the European Community monies will end in the pockets of some Billionaires based in UK territory...

    Let’s see what the European politicians and citizens “Think” about that.....

    Costa Rica has about the best defense budget strategy in Latin America, but you can't rattle your saber and threaten other countries with nothing to back you up. 

    After careful thought, under similar circumstances, as captain of the Esmerelda and with direct orders from the Chilean Admiralty to scuttle her, I would disobey.

    Despite the tall the ship's tarnished image due to the incredible  poor leadership of the Chilean Admiralty in 1973, she remains an important symbol of our country.  

    No matter how much fire damage you could create,  permanently scuttling the steel-hulled vessel would require several timed explosive charges preferably while in deeper waters.  As the ship would begin her death list, anyone within the range of her four masts could be easily killed.  Anyone harmed, no matter what their nationality, would be the legal criminal responsibility of the captain.  (That would include Ghanian port authorities or fishermen, as an example.)

    It's a classic “Catch 22” situation:  To willfully destroy her due to corrupt political policy during peacetime and even despite official Admiralty orders, I would refuse.  My concern would be for my crew and making sure no one was harmed in the seizure of the vessel. (No pistol scene over the Chilean navy banner either.)  This would no doubt result in a devastating court-martial with disgrace and cause the destruction of the naval careers of a few of my serving officers as well.

    No matter what kind of warships, airplanes or weapons that Argentine armed forces has, even if they had the latest techology and weapons available to mankind, think have you ever been in close quarters together with a bunch of Argentine men? They would totally ignore the fighting part (they only like to yell and scream, maybe go as far as a slap on the face if they get really insulted), they would all be grabbing each other's crotches and trying to mount each other. They are a bunch of horny dudes and would RUN from the front lines into each other's arms. Argie men are really cute to look at, but luv to play “plug the poop chute” before anything else!

    Somewhat the opposite, when the collapse eventually occurs, I promise upon my questionable honor as a commissioned officer and gentleman, to make an undisclosed contribution to a charity in Argentina that provides assistance to an orphanage for children. I think they will suffer greatly and will need the help most. (The Cruz Roja unfortunately has become involved politically with the government and I think their administration costs world wide are too high..)

    If the sailing ship were attacked in an act of belligerence I would not dare to strike my colors. However, wjust as the brave commanding German general who refused to obey Hitler and destroy the city upon abandoning Paris, I would do the same. It would be cowardly to scuttle your ship.

    No, I'm actully offering an olive branch. Your charitable contributions should go to whomever you decide. When the “currency correction” takes place, I plan to modestly assist an old age home, or orphanage IN Argentina during the crisis. They will probably need it the most.

    I also plan to take advantage of a buying spree as in the past. As I mentioned, CFK has more tricks in her bag, so there is probably no imminent collapse.

    BTW: Destroying a national symbol over a legal issue caused by a corrupt government is not honorable. (And yes, so is willfully disobeying orders. “Catch-22”)

    It does not matter whether anyone took the bet, in fact I was going to but did not know how I would collect OR, in the event of you being correct, how I would pay.

    9% is not 14%, so you lost the bet. It was not that Chavez would win as I think most people would have put money on that, even if Capriles had got 100% he would still have 'lost'.

    Do you consider 5.0% a landslide? Do not overlook the fact that if just 5.0% were to have voted for Capriles he would have won and who is to say they did not?

    But no-one can believe the 54% anyway, I think TMBOA wanted it that way as she obviously fancies him and wanted a 'pair' of results to keep it ‘in the family’, so to speak.

    Argentina has NEVER abided by a decision made by the international courts when it went against them. In fact, the Argentine government is constantly saying that the international courts have no jurisdiction over Argentina (despite signing treaties to the contrary), so why go to the international courts now?

    Is it because their attempt at bribery has failed miserably?

    And your continuing fantasies regarding nuclear weapons is so funny! I mean, Argentina can't even cough up the meagre amount of Us$20,000,000 to get its ship back, let alone develop a prohibitively expensive nuclear weapons programme. I mean if Argentina had nuclear weapons what would you do? Nuke Ghana? Not a good idea since Ghana is part of the Commonwealth and is therefore protected by the UK who would immediately launch a counterstrike against Argentina.

    PH, you live in a make believe world where you believe that nuclear weapons will make Argentina powerful, feared and respected. Well, it won't. With or without nuclear weapons Argentina would be an impotent country, without respect.

    How can Argentina gain respect? First you need to elect a government that cares more for Argentina and her people than they do about lining their own pockets. Then honour your debts. Start following intentional law instead of flouting it every time it becomes inconvenient.

    Then encourage investment to develop and exploit your natural resources, and use the profits from those resources to improve the infrastructure, education, health, housing and the lives of ordinary Argentine citizens. You can use the money to give tax breaks to assist domestic companies in being competitive and to encourage foreign companies to open factories in Argentina, thus creating jobs. Jobs means people having disposable income, which in turn will make them want to spend money, thus helping the economy. It's not rocket science, it's simple economics.

    Poor PH, who loves Argentina soooooooo much, he lives in another country.
