The Argentine Supreme Court unanimously rejected on Monday the ‘per saltum’ filed by President Cristina Fernandez administration against the extension of the injunction decided by a federal court last week and which benefits the Clarin media group. Read full article

    CFK I'd definitely losing her grip, as well as her mind.

    Argentina might just have a future if the judiciary can keep itself seperate from the government. That is what makes democracy work and prevent dictatorship, having checks and balances to prevent one person from gaining ultimate power and assuming that the law doesn't apply to them. For that you need three seperate entities:

    The executive - AKA the government that rules the country.
    The senate or parliament - filled with elected representatives from the whole political spectrum whose job is to challenge the government on laws and policies it plans to enact.
    The judiciary - those that ensure the law is applied equally to everyone without prejudice or favour.

    Only when all these three arms of a country are working and completely free of interference can democracy truly exist.

    Whats funny is they keep on saying clarin has a monopoly but look at their licenses. They are not Argentine wide. in general they are basically local repeaters of their Buenos Aires channel with a few local programs thrown into the mix.

    I get my tv from the company Telecentro and Clarin only has 2 channels on that. The vast majority of channels being rubbish yank channels. Where are they getting 59% from? is that the number of subscribers they have?

    Maybe they should split their subscriber base in half into 2 different companies. That way they will comply?

    As for 38% open that has to include all the repeater channels country wide i mentioned above as open air in BA only has 2 Clarin channels. TN their news and channel 13.

    Ha ha ha ha ha ha. As a lawyer it always makes me laugh when you come up against some incompetent idiot who can't read or process information to the extent that they end up shooting themselves in the foot and then complaining that they “didn't know that was how it worked”.

    On another note, the last time she started talking about an institution not abiding by the will of the people they got nationalised...can you nationalise the judiciary...?

    KFC is 56 and has been in politics for over 25 years. How successful and wealthy of a lawyer could she have LEGALLY become realistically in a 5 year period? I do not know how law is practiced in argentina, but her methods of stomping and screaming would have her in contempt of court on a regular. She is a bad lawyer, and inept leader and politician, a non-existent diplomat, yet a very effective thief.

    This is the first decision that I predicted from the Supreme Court, and the next will be upholding the injunction until such a time that Judge Alonso sends down a decision on the main question; the constitutionality, or no, of articles 45 and 161 of the Federal Media Law.

    My prediction on this main question is that the Court will find articles 45 and 161 constitutional and Clarín Group will eventually have to divest the unallowed licences.

    I also predict that when Clarín divests itself of those licences, life will go on as usual in Argentina, still 25-30% inflation, still increasing street crime, still increasing corruption, still increasing division between Argentines, still increasing levels of poverty, still increasing unemployment, etc. So the government will have expended vast amounts of effort and treasure for absolutely no gain, because Clarín will still be the biggest selling newspaper in Argentina and Jorge Lanata will still be the op-ed show with the highest rating!!!!!

Obviously knowing exactly who is and who isn't going to be able to pay their mortgage puts you in a commercially privileged position. They made a lot from this. In the UK you wouldn't be allowed to do this as you would be struck-off...

    @52. Well I keep asking ~why~ does this have to be done per saltum. This is a press freedom issue and it's rather transparent that the jackrabbits that the administration is trying to “leap” past are the pending financial deadlines so that “bad copy” is somewhat/somehow minimized by selling the quasi-nationalized resources to allies. I can't see how the bad press can be minimized by reducing Clarin holdings to this utopian 35% where somehow they will be “broken” and she will control the domestic press narrative when these problems are clearly of the administration's making. The move on Clarin was pretty artless given that they were hunkydory with the Kirchners' when they handed out the licenses. This fit with pushing it through while they are insisting on their own right to kick the cans down the road with international rulings against the “vulture” funds just makes the administration look even worse.

    The difference here being this is purely an internal matter, no foreign pirates, vulture funds or alien trade organisations to blame and vilify.

    But that doesn’t seem to matter to some Argentinian politicians, already accusing their own system (and as Lawmakers they are far more responsible for it than most) of an “uprising” and being “colonised”, “disrespecting the will of the Argentinian people”.

    Familiar enough language to us extranjeros when CFK does not get her way.

    The ease with which this vitriol is transferred (lock, stock and terminology) from one issue to another, can only have come from practice.

    Simone, it seems to me that the mid term elections are going to be very crucial for Argentina. In the USA when the people get sick of a politician they start a “grassroots” campaign to remove them from office. Some popular ones here was....”Moveon.org. They might start web sites, have protests do anything to get the message out to vote against the politician in question. Don't they do anything like that in Argentina?

    I guess that we have “cacerolazos”, which give us a chance to let off steam as well as calling attention to the ills that we suffer.

    Meanwhile the oposition is beginning to get its act together, the only possible way of beating the kirchnerists is through a coalition of opposition parties, and this is beginning to appear, and it is much easier to create a coalition for the mid-term elections than for general elections because one thing is to create an effective opposition in Congress and another is to govern!!!!!

    I understand what you are saying. Sometimes you need more than letting off steam. They “tea party” movement was started as a grass roots movement to remove congreeman and senators from office and was quite effective, though I do not associate myself with them, they did well in getting heard after being responsible for removing 25-30 congressmen. The president is accountable to congress here so having a good overseer in congress is important and not just having a yes person. So I always view the mid terms as just as important as the presidential elections.
