Meanwhile  Argentina -the country with it all- continues lurching from week to week from one sensational event to another with a highly polarised society with all and sundry protesting and more in the works becoming more and more intense. Request for the prescription of provisional measures.
 
ORDER

THE TRIBUNAL, 

(1) Unanimously, 
Prescribes, pending a decision by the Annex VII arbitral tribunal, the following provisional measures under article 290, paragraph 5, of the Convention: 
Ghana shall forthwith and unconditionally release the frigate ARA Libertad, shall ensure that the frigate ARA Libertad, its Commander and crew are able to leave the port of Tema and the maritime areas under the jurisdiction of Ghana, and shall ensure that the frigate ARA Libertad is resupplied to that end. 

(2) Unanimously, 
Decides that Argentina and Ghana shall each submit the initial report referred to in paragraph 103 not later than 22 December 2012 to the Tribunal, and authorizes the President to request such information as he may consider appropriate after that date. 

(3) Unanimously, 
Decides that each Party shall bear its own costs.

      <description><![CDATA[There is still a chance this could drag on as the important part of the ruling is 'pending a decision by the Annex VII arbitral tribunal'

As in cases before the ICJ, both parties must agree that the UN has jurisdiction over the dispute. From the outset Ghana has contested this, as explained in it's written statement to the court. 

"Ghana considers, however, that the resolution of this unfortunate dispute must comply with the relevant rules of international law, which are not to be found as such in the Convention. Accordingly, as matters currently stand ITLOS does not have jurisdiction to order the provisional measures requested by Argentina."

Judge Yanai can make as many orders as he wants. If Ghana hasn't agreed to be bound by his decisisons they are meaningless.

However I would imagine that Ghana will take the opportunity to have it dealt with and put it the whole sorry affair behind them.]]></description>

In your post you refer to "we".  Is this the Royal "we" ,or are you speaking for the whole of Argentina who no doubt you have canvassed and received 40 million "yes" votes.
Britain developed its own nuclear weapons as a defence against the Soviet Union when there were fears of its expansionist moves into western Europe.. It has been said time and time again that it is not a first strike weapon.  If it had been used then it would have meant that Britain was already a smouldering pile of ash.
As Argentina has no nuclear weapons, it means that you are not a potential target. If they did aquire them and continue with  their belligerent attitude against the UK, then, no doubt contingency plans would be made to put you on the list of POSSIBLE targets BUT you would have to fire first.
  You are rather cavalier in your attitude to nuclear war.
You know very well that the UK would NEVER attack Canada so you would be quite safe, coward that you are, cheering from 6000 miles away.]]></description>

I think the great naval commander, RN retired, is annoyed with you. I met a little prick like him in Canberra, Australia once. The only military person I've ever met with an attitude like this dick. I was on exchange at RMC and he was on exchange as well but working in one of the big DoD offices in the city. The Aussies hated him and I couldn't blame them. They used to call him something really funny but I can't remember what it was. It'll come to me. He used to tell them how useless their military was compared to the UK's (not true at all by the way). He had a right chip on his shoulder. I was worried that he was doing a lot of bad to our reputation but the Aussies assured me they knew it was just a case of a single jerk; everyone has them. It will be milked for all its nationalistic worth  by CFK (but also Clarin etc)  and will sway those who were losing respect for the government, temporarily, but after a couple of weeks it will be business as usual. 

This incident should never have happened in the first place. Argentina shouldnt have got itself into such massive debt and then in desperation signed up to these 'vulture' funds which then pursue Argentina relentlessly.

This in turn takes them away from the responsibility of fixing the social, economic and political problems. Vicious circle. Its easier to get drunk on nationalism than to face upto and fix the problems and the causes that prevent Argentina being as rich and equal societies as those of Scandanavia for example.]]></description>

What part of Argentine law allows a private army of thugs to attack a cruise office, what part of Argentine law allows a group of political activists to hold a cruise ship full of passengers hostage and make political demands of the Captain.  The UNLOS requires all countries to protect ships, crew, passengers and cargo safe within their waters and ports. Argentina is failing to honour its treaty obligations and their is a breakdown in law and order conveniently ignored by the government.

Clauses concerning a nations sovereignty over their flagged vessels apply to vessels at sea.  When those vessels are in port the laws of the host country apply but the treaty obligations to protect the ship do not end.  Neither are the government of Argentina allowed to interfere with vessels carrying out legitimate business at sea.

When British vessels are in Argentine ports Argentine law apples.  Argentine law prevents vessels involved in the exploitation of the Falkland Islands mineral wealth from docking.  That is why vessels under all flags that are involved in the FI oil and gas industry do not dock in Argentina.  No Argie law effects cruise vessels that is why it is the thugs attacking the cruise ships as government proxies, if it was against Argentine law it would be official government organistions acting.

CFK uses the thugs much in the same way as Hitler used the brown shirts.]]></description>

      <description><![CDATA[If no British flagged ships are allowed in Argentine ports why is it that the Argentine Navy,  Argentine Coastguard, the Port Authority, the police, the minister for transport, the minister for foreign affairs, the minister for security and the minister for trade, the Argentine courts all do nothing.  Surely if it was a law it would be someone's responsibility.  Instead Quebracho,  Maximos private army and unofficial bands of political activists are used.

These are people allied with the ruling party but with no official authority.  The government of Argentina has already denied that they are acting on their behalf but if what they were doing was legal under Argentine law wouldn't an arm of government be doing it.

As for it being illegal for all British ships to dock in Argentina, when Britain summoned the Argentine ambassador to complain that it wasn't safe for British ships and that Argentina had breached its treaty obligations, Argentina did not say it wasn't under a treaty obligation to protect the ships or that it was illegal for the ships to dock, the ambassador denied there was any risk to the safety of the ships.]]></description>

What a blatant untruth. My country was the first country to form by a vote and not a revolution. It has never had a coup. It has never been run by a junta/an army/a dictator.  It has never had civil rights suspended. It has had the same constitution since birth. Only the people can change the constitution. Inflation is low. The currency has always been stable and is freely convetible. The judiciary is independent. Elections are free, fair and run independent of the government. The public service is apolitical. Our neighbours do not revile our leader. Crime is low. Living standards are high. 

30 years of democracy don't make you the most politically stable on Earth.

I don't think many of us are surprised the ARA Libertad has cause to be released however if you think that is a victory, then you are sadly mistaken. The PR stunt by the financial group have been extremely successful in their aims to bring Argentina a lot of pain for non-payment. I'm sure for good measure and to impact Argentina some more they will appeal the ruling just to drag this out for a bit longer. 

I said it before and I will say it again, I don't think its right for a private fund to be able to seize a Argentine naval asset even if it isn't a warship.

I am, however, surprised by Tobias behavior which seems to of hit a new low in this thread. It's been a downward spiral for Tobias since joining the forum to where we are today.]]></description>

I have to admit that I am surprised by the ILOST making such a bold precedent. It says in the article that they can't appeal.

Well Ghana can appeal if they wish to, to the highest court on earth, the ICJ, who have the power to overrule the ILOST.

However, Ghana could do several things:

1. Get rid of the Libertad, as it is a poisonous albatross around their necks.
2. Ignore the ILOST ruling, as this is an INTERNAL matter to Ghana, and the ILOST doesn't have the power to overrule a sovereign nations court.
3. Let the Libertad go, but only after the Argentines pay their docking fees in full.

Frankly, if I were one of the Libertad crew, I'd be a bit p!ssed off being told that I wouldn't be home until after Xmas!]]></description>

1.	Ghana shall release Libertad, 
2.	ensuring that Libertad, its Commander and crew are able to leave the port of Tema and Ghana
3.	and that Libertad is resupplied. 
4.	Argentina and Ghana shall each submit the initial report by 22 Dec 
5.	The LOSC requests subsequent information for the Arbitration hearings

What we really need is the WHY:

This is a PROVISIONAL decision because the setting up of an arbitral tribunal and its outcome will take some time.

2. “any act which prevents by force a warship from discharging its mission and duties is a source of conflict that may endanger friendly relations among States” .

1) The case was urgent because a Ghanian attempt to bord the ship without the permission of its commander had to be repelled by the showing of arms.
A difficult and potentially dangerous situation that demanded an urgent solution.
(First time since I was ~16 that I aprove on an Argentinean military action.................................. I must be getting soft :-(

2) The fregate ARA Libertad classifies as a warship because, as Mr. McDod already pointed at post (103), the Article 29 of the UNCLOS convention  states:
"Definition of warships
For the purposes of this Convention, "warship" means a ship belonging
to the armed forces of a State bearing the external marks distinguishing the character and nationality of such ships, under the command of an officer duly commissioned by the government of the State and whose name appears in the appropriate service list or its equivalent, and manned by a crew which is under regular armed forces discipline.

Maya writings could be as old as 400 BC; highest state of development was during the Classic period (AD 250 to 900), and continued throughout the Post-Classic period until the arrival of the Spanish. The Spanish conquest and colonization of Mayan lands was between 1540-1560.
