Ghanaian government confirms the release of ARA Libertad

The Ghanaian government confirmed on Tuesday it would comply with the UN Law of the Sea court decision to release the Argentine navy flagship ARA Libertad, impounded in Tema since October 2, over a debt dispute between a US hedge fund and the Argentine government. Read full article

    There can be no other way. The way of International law. After this little screw up by Ghanas justice sustem I do hope that the Ghanan Government passes into law the requirement that their judges be profficient in the subject.

    I wonder will Argentinas newly released vessel be visiting Queen Elizabeth Land, in homage to her Royal Heirness Queen Elizabeth?? :)) more to the point would it even get their?

    Well the comedy show was fun while it lasted. I can hardly wait for the next show. Though we know argentina was not embarrassed as we all know that takes something argentina does not have to be embarrassed. When you take 100 billion dollars from people and steal 70 billion by only giving back 30 billion.....yes....argentina is incapable of embarrassment. She reneges on treaties, default on contractual debts, steals from her own citizens, calls people of argentina liars about crime, she gets what she deserves. If argentina is happy in the world of Oz.......good. But why complain about lemons and beef with the USA?

    Both courts are right, the system works, you are simply showing your ignorance.
    Ghanian judge was dealing with an issue that was pertinent to his remit.
    Does the law of Ghana allow the claimant the excise of a judgement under contract law from a foreign jurisdiction? Which it did. Argentina's claim was under the law of the Sea was that its waiver was null and void. It appears that the International Tribunal for the Law of the Sea gave more weight to the potential of conflict between the two countries than any other issue. Beside this was new law to be decided as this same issue had not been adjudicated before.

    @14 This story was very good value though. It made the Argentines look like completely incompetent fools inside and outside of court. Their legal discussion was woeful, and to be fair if it wasn't for the likelihood of conflict (people on board shooting the dock-workers), then I very much doubt that it would have ever been released.

    This is a good story just keeps on giving.

    the ghana government makes a PLEA to the court. who says that the court has to follow that plea? it is like the amicus curie in the US, where the us goverment also intends to assist arg crooks government gang instead of their own people.

    Ghana is not alone as countries which can be manipulated by interests from outside its borders.There are many and Eygpt is struggling to establish the relationship it's people will accept with these interests.Hopefully these interests will suffer a setback there.

    The Ghanaian government will query the decision of the court, and will want something in writing, so they can't be seen to be liable. When they get it then Libertad will presumably be free to go. Whether it'll be in good enough shape to make it back across the Atlantic is another story. I think it's generated all of the goodwill that the trip was ever going to.

    So when is Argentina going to be taking MTU to court to get them to repair their broken-down corvette that is stuck in South Africa, on credit, when they haven't paid their previous bills?

    Up to this moment I can find no reference to the Ghanaian court releasing ARA Libertad, quite the reverse in fact NML has presented a amplation to the Appeal Court which has been granted because there is NO Argentine legal representation!!!!

    I seriously do hope that CFK hasn't counted her chickens before they have hatched by telling us that Libertad would be arriving in Mar del Plata on 09/01/13!!!!!

    As usual yulena you make no sense. But perhaps to a communist it makes sense. When you borrow moeny and pledge assets as collateral, the creditor has the legal right to attach and take those assets. You your world, government just take assets from anyone regardless of pledges.
    As for piracy.....stealing 70 billion dollars that was given to argentina is definititively “financial piracy”.
    I still get a chuckle of you reference to me as an old soldier. You still must wonder why I am a Captain yet that is unknown to you as is my age.

    HMS Queen Elizabeth will be the first of a new class (they've already started building the second (HMS Prince of Wales) as well).

    It'll be the first full size fleet carrier (as opposed to the through-deck-cruisers/light carriers/ASW carriers/whatever the Navy has to call them to get the money out of the politicians) that the UK has launched in more than 50 years.
    It's also the biggest (at least in terms of displacement) carrier that we've ever built by a considerable margin.

    The Argentinian flagship, Libertad - though it is a ship-rigged sail training vessel - does have four cannons - 47mm salute guns.

    The Argentinian normally fire blanks,
    but this flagship will be allowed into waters of TFI by invitation only
    .. because you can never be sure if the Argentinian blanks have been supplemented with mini-cannonballs.

    The Royal Navys' new ship is more a larger version of what we had before in a way. No cats/traps so we await the F35B Stovl to be delivered after some bureaucrat decided ditching Harriers early was a good idea. I just hope it isn't another F111. Overpriced, delivered late and not as good as it was meant to be. The Harrier is still a good aircraft, even after all these years, as the US Marine Corps well know.

    Ghana comes out of this as would any nation tied up in the complexity of this international baliff action.
    They facilitated the Law of the Sea ruling, and abided by its provisional decision - happily getting shot of the troublesome boat and its gun-toting crew.
    Quite frankly, I think the crew were lucky that the Ghanian military did not respond to the Argentinian gun-toting at the baliffs on Ghana's sovereign territory.

    It does sound like we do not agree.As I understand,if you are asked to act for a third party,you are responsible for accessing whether to act or not.Either in your own self interest as a gain or loss,and as a legal act.If it is not legal you should not act,unless there is a gain which counters its illegality.

    La Nacion and C5N have confirmed that ARA Espora has sailed from South Africa and is headed towards the Brazilian coast where it will join ARA Libertad to escort it into Mar Del Plata Naval base on January 9, 2013.
