Punta Arenas Appeals Court rejected the protection request presented by the Simunovic Abattoir against the local government for having extended regional investment incentives to the recently privatized former Sacor plant.
The defendant argued that the former government managed Sacor and now Frigorifico Patagonia (linked to the regional farmers company Wool & Meat) was entitled to the investment benefits contemplated in the Navarino Bill to promote the establishment of businesses in Magallanes and Tierra del Fuego.
The ruling says that even when the plaintiff considers the Navarino Bill benefits are specifically determined for those businesses establishing themselves in the region and since the new company Frigorifico Patagonia is a continuation of the former Sacor operating in the same sector, actually on passing from the public to the private sector the new owners are entitled to the legal franchises contemplated.
"There are no grievances to the constitutional guarantees invoked by Mr. Boris Simunovic Vodanovic", was the final statement.
Simunovic and former Sacor are the main abattoirs operating in Magallanes Region and Tierra del Fuego and both have been certified by the European Union.
