Argentina warns UK and US market regulators about ‘illicit’ oil activities in the Falklands

Argentina has asked British and US market regulators to probe whether oil companies that are involved in hydrocarbons exploration off the disputed Falklands/Malvinas Islands have told investors about the risks of their “illicit” drilling, the Argentine Foreign Ministry reported. Read full article

    ”Besides building into what many consider to be a foreign relations nightmare, Argentina’s threatened action could result in some of the world’s largest banks and accounting firms being at risk of asset seizures. According to analysts, the move could spell trouble for banks such as Barclays (NYSE:BCS), HSBC (NYSE:HBC), and Standard Chartered (LSE:STAN).

    “Argentina certainly could try and bring claims against the companies in the Argentinian courts and they could also try and seize any assets that were actually in Argentina,” said Catherine Robert, a specialist in international arbitration and cross-border litigation at Hogan Lovells.

    All of these groups “need to pay closest attention to what’s being said in Argentina and perhaps start talking to Argentinian lawyers,” Robert added.

    In an interview with Reuters, Mark Jones, a Latin American specialist and chair of the department of political science at Rice University, stated that Argentina wants to attack the explorers, which also include Argos Resources (LSE:ARG) and Desire Petroleum (LSE:DES), where they are most vulnerable.

    “They’re signalling that they’re going to do whatever it takes to put obstacles in the path towards developing the energy resources in the Falkland Islands,” he said.

    From a regional perspective, Argentina has the ability to create further issues in an otherwise tense crude market as it has already garnered support from Brazil in its claims to the islands. If Brazil was to follow Argentina’s lead and ban oil companies that service the Falklands from operating in Brazil, waves could be sent through the market.

    @12 Yes, but we'd all like to see the kangaroo court televised when they actually do have any type of legal action... anywhere.

    In the USA would be best, because they'd just get told they fail to respect US law on debt repayments. In the UK they'd just laugh at them ... and the ICJ jurisdiction isn't respected by the Argies so they'd tell them to get furked too.

    Is simply to play Argentina at her own games,
    1, freeze all Argentina assets in the UK .
    2, advise and warn all British firms to consider withdrawing from Argentina,
    And move all business to neighbouring countries,[there gain, Argies loss]
    3, inform Argentina of a possible trade war,,
    4, as certain companies have been names, [slander] UK companies should
    Sue Argentina in the ICJ, so Argentina would have to prove beyond doubt the territory belongs to
    Her ,
    5, just sit back and see what happens.

    I'd simply do what we are doing which is undermining them and let the markets and company's make their own minds up.

    Lets face it there cannot be many companies very comfortable with the RG's at the minute and following on from the Repsol debacle they must be wondering “whose next”, “should we stay in RG land” etc.

    the RG's are slowly but surely falling out with everyone. People will be more subtle than the RG's and one day The botox Queen will wake up to find that RG Land is closed for business.

    You could label the ruling elite as economic terrorists and get them put on black-lists for travel in the known world.

    I have to confess a degree of curiosity as to what tangiable assets the likes of HSBC, Barclays and Lloyds actually have in Argentina. Aside from the actual branches and the paper money and shrapnel in them.

    Let's face it, as soon as one of the firms on Christina's little list finds itself subject to any serious measure of “administrative, civil or criminal sanctions” everyone else on the list (which I'd imagine would include most of the banking sector, the major auditors and everyone else) would electronically transfer all of their bankable assets out of Argentina, switch the lights out and lock the doors.

    Although I think the auditors wouldn't be entirely adverse to that. Can you imagine the horror of having to give an opinion on whether the Argentine figures represent a “true and fair” image of the state of their economy.

Anyway, is anyone really going to pay any attention to Argentina? I mean come on... Argentina? really? In any court outside Argentina they would essentially be told a variation of F@%k off.     @26 The companies are not states so they cannot go to the ICJ. They can go to USA and get a ruling or they can go to Europe which would be better and get a ruling. Then the European Commision would have to act on any ruling, i.e. freezing Argentinian assets.

    maybe the threat of asset seizing of those companies/banks involved in the legitimate drilling of oil by the not-so-democratic government of Argentina should be enough reason to justify those companies/banks named to effectively pull the plug on Argentina before they get their grubby thieving hands on anything of value, they should follow the example of the IMF, Argentine Govt. threatened them with court action until they hightailed it out of dodge.
    with all that much potential investment lost im sure that would secure regime change :)

I still can't get all this strange version of the story, even if I wanted to believe in it and forget the businesses that make these excuses worthy, it is too difficult to understand. It leaves me no option rather than going on thinking that it is a two-faces and hypocrite excuse coming from the same british elite that supported “preventive” wars and grabbing resources in so many different places in the world.

    This is not good for international peaceful cooperation. The world doesn't need more warriors.

    Argentina will go on claiming, PERFECT, it is a demonstration of human peaceful determination against colonialism and grabbing of natural resources.

    First they took 100 miles away from the islands, then 200, then 300, they will come up with self-determination of two or three inhabitants imported from berkshire, leeds, mumbai, bangkok or moscow placed at any island far from Malvinas if needed to justify the grabbing of natural resources...

Perhaps the Editor took exception to the over reliance on quotation as opposed to original comment? If so the Editor should perhaps have started on the Penguin comment page where this fault is equally applicable. At least 13 was relevant to this post, which it wasn't the first time he posted it.     @45 I think the mass exodus of companies began a long time ago. Not just British but every sort of company, from Beef to Airlines. The obvious step of freezing Argentinian assets is obvious, this happened in the USA when they defaulted on the debt and Argentina still tried to sell them even when under court order not to.

    They know not the law.

    If the RG government does go after these companies (esp the banks) in argentina (or even try to) it will lead to enormous capital flight of a huge number of corporates. This will lead to further inflation and the economy will spiral further out of control...cutting you nose off to spite your face.

    Think- You and I both know that all this is just Hot Air and will go nowhere - other than causing commercial and financial instability in Argentina if Timmerman pushes to far.
    No notice will be taken of the letters. Why? - Because nothing illegal is/has been done.

    THe UN(and US etc) recognise that UK is is the current legal administrating power with responsibility for the Islands.

    Yes there is a dispute noted - but current situation is as above.

    UN/US etc etc are all aware that there were International Agreements between Arg-UK-Islands on Offshore Hydrocarbons and Fisheries etc

    UN/US etc also know full welkl that current Arg Govt - UNILATERALLY Scrapped and Withdrew from such Agreements.

    No exploitation is being done by UK - all operations are 100% under the control of the Islands Govt.

    I know it- Beef and the others on here know it - and you know it. Even Timmerman and CFK know it!

    Not forgetting some of those Banks are owned by british tax payers, after we bailed them out. If argentina did carry out its threat, it would be effectively stealing direct from the british taxpayer, and no one steals from the british tax payer and gets away with it. Its simple really, if they carry out their threat, the tax payers will demand action from the british government to recover what argentina has stolen. What that action will be or will lead to is anyones guess, but military action would be one response that would be firmly on the table.

    If the UK, US, EU and Commonwealth work together the Argentine government could be brought down overnight in a series of sanctions.

    It looks to me that Argentina could easily fall apart in the same way that Tunisia and Libya did. The economic conditions are ripe for a popular uprising. The Argentine military could be taken out in a series of NATO raids.

    Every minute, every hour and every day, Argentina slips further into chaos. Its government’s knee jerk protectionism and financial legislations putting more coffin nails in both the formal and black economies, both black and white economies are of critical importance to Argentina’s financial well-being. When one considers the ‘black’, remember, for many years 'black' has been more than tolerated, it's been celebrated and supported by the many.
    Argenzuela has legislated with great vigour since the black queen was re-elected.     Law 25,659 is a domestic law published in April 2011. DOMESTIC. Whilst Argenzuela claims sovereignty over the Falklands, it’s only a claim, a tenuous one, and domestic laws do not apply to the Islands or their waters – they are British.
    Now, here’s the cruncher – the sustained attacked on YPF by the government’s proxies - provincial cronies – soon to be followed by attacks on international banking and financial interests in Argentina will only deepen Argentina’s isolation and will no doubt lead to a very strong lobby to remove Argentina from the Gs.
    Moreover, we are talking about Argentina fighting against the financial centre of the world – sorry Timmy - you lot are not up to the job – in addition, do you really want to go to war via policy from a president who sees dead people.
    If you start this war, as you did the other – I can see John Cleese goose stepping with an outstretched arm holding an Argentine flag – you will lose, you will be completely isolated, at least then there’s an upside - you lot can steal the money earmarked for the Paris Club especially now the Central bank run by pasty del la ponte is completely under the black queens spell.

    There are all sorts of possible scenarios, none of them in Argentinas' favour that will arise from this.

Why would Chile have Russian bases on or beneath its territory? Then there's the small matter of it being an international waterway with neutral status.     @64 You shouldn't wait. I'm sure that any intelligent person (thus ruling out Tin Man) can see the first obstacle. Tin Man sends his lawyers to, let's say, the U.S. First day, the argie lawyer stands up and outlines the case. First question asked by the court is “Who says it's illegal?” Let's see the argie lawyer work his way around that one. Chances are that the court would rule that any activity within British territory is a matter for Britain to determine. Now, would Tin Man have the incredible stupidity to try and take the matter to a British court? I see any court in the UK ruling that the case should be commenced in the relevant jurisdiction, i.e. the Falkland Islands. How would CFK go about starting proceedings in a jurisdiction she doesn't recognise?

    Incidentally, has anybody got any news about CFK's application to the Falkland Islands Government to replace the LAN Airlines flight with 3 by Aerolineus Argentinas from Buenos Aires?

    Argentina may be able to diplomatically muscle its way toward negotiations as it has had consistent regional support from Mercosur,Rio Group....But understanding what Britain stands to lose if it truely enagaged in a discussion over these Frigid Islands makes it clear why the cries of a far inferior military power like Argentina go ignored.For now and as before ,with too much at economic and strategic stake,might will be making right.

    Most Argentine people do not care about the Malvinas. We are still abel to speak our minds but as you find on here, we are labeled unpatriotic, traitors, etc. all the usual insults. People are brainwashed, to most Argentinians the Malvinas are like a football team, they want Argentina to win the game we lost in 1982. Very few have ever visited the islands. They are in the news constantly now, the government have propagandized them and whipped the veterans up. A lot of people are fed up with this. The problem is the government can not handle the economic, it is a good distraction from these problems. Add to this the possibility of oil and they want a share of it. The ordinary people would not be the ones to gain but Cristina Fernández and Timerman are both very rich, they did not get that way by accident. The media is completely on their side. A lot of people are brainwashed but the Malvinas has reached the level of fanaticism. It reminds me a lot of 1970's. I would not be surprised if very soon, posting like this becomes a crime. People have been disappeared even under Cristina Fernández, the police can not be trusted.

    As a result of Argentina continuing to raise the profile of this issue, the Islanders side of the story is now reported in many parts of the world, along with Argentina’s actions. Argentina’s position is increasingly being see for what it is, morally bankrupt.

    You have got to hand it to CFK and the Mighty Tinman, they have given the Islanders a platform from which to put their case they could not otherwise have hoped for.

    Over the centuries with foreign invasions, new words were added & the grammar changed.

    FYI, Our “form” wasn't in Papua it was in the NG part of PNG.
    lt was in a hanging valley. l'm sure you know what that is, Think.
    Verily a piece of Paradise, at 2,000 metres elevation, a perfect climate.
    Just to wet your appetite, l'll tell you ONE story.
    One of my very good friends was a Finn.
    His idea of a saturday night in was a glowing potbelly stove with a coffee pot bubbling away, full of very strong black coffee & a bottle of Johnny Walker Red lable.
    lnto his pint tin mug went 50/50 whiskey/coffee.
    He always stayed til stumps, then would fall into bed.
    As he also smoked cigars, Dad would have to check up on him to make sure that his bed wasn't alight.
    A thorough gentleman though & l've never seen a man work as hard as he did.

    Never said that it was. The land belonged to a tribe that had set up a corporation(with Australian Government help), to develop the land.
    Dad was the manager. He received a percentage of the profits.
    The harder we all worked, the more money we got.
    You could own land if you became a citizen. A lot of expats did.
    Where we were was virgin land until Dad cleared & developed it.
    There is a lot of unpopulated land in PNG. Too cold for the locals l think.
    Yes, Think it was originally German New Guinea although the Germans never penetrated very far inland.
    lt was captured by Australian troops in 1914.
    On the coast the local people still call the unit of currency(the Kina) ein mark.
    l speak fluent pidgin & there are many German words in it.
    petrol=benzin
    rubber or tyres=gumi
    leave or withdraw=raus
    & lots of others.
    Our neighbour Mr H..................did not carry a knife that l ever saw.
    l have heard that Finns had/have a reputation for knives.
    But l never saw one.
    He taught me how to operate a Komatsu bulldozer.
    As l said, a good friend & a thorough Gentleman when sober.
    Never saw him drunk.
    l heard that the whiskey & smokes eventually killed him.
