Ghana court to hold hearing on retained Argentina’s ARA Libertad on Tuesday

Next Tuesday the Ghana Supreme Court will be holding a hearing to consider a motion from the government of President Cristina Fernandez requesting the annulment of the injunction retaining Argentina’s navy training vessel ARA Libertad following a legal proceeding from a hedge fund holding Argentine defaulted sovereign bonds.     In other news:

    Chaco province in northern Argentina surprised the local capital markets this week when it made more than $263,000 dollar-denominated bond service payments in local pesos rather than in US currency. The government of Argentina has cracked down on access to dollars this year in a bid to halt capital flight as the local currency depreciates against the dollar.

    The Chaco dollar-denominated bonds were issued in 2006 and come due in 2015 and 2023. But the debt payments could not be made in the designated currency because the province could not get its hands on dollars said market sources. This act leaves the door open to the possible forced pesification of other securities denominated in foreign currency.

    @11 Oh please, don't take it out on Skyteam! They have it bad enough with them ~adding~ Garuda to cover Oceania/South Pacific. But yes, it IS nationalized and if I were an International Repoman of Mystery and had no care of my already bad reputation and didn't mind being seen on the TV stranding some sad family on vacation or a dad wanting to get home to his family, it's what I would do since the planes are more fungible than a tall ship*. And indeed, DAL/KLM/AF/AeroMex could cover for AA and it would be a harsh lesson to the three alliances to chose wisely when they try to broaden coverage.

    (*That said, the though the idea of it being auctioned and snagged by FI interests is brings new meaning to Schadenfreude (salty language warning).)

    I'm curious as to how the argie government reckons that the detention of the vessel “violates............ .the vienna convention on diplomatic immunity” Just to start with, there is no such convention. Although there is one on diplomatic relations. I've read it. There's no provision that prohibits a government's assets being detained, or seized. It's not a diplomatic mission. It's a boat! Perhaps CFK could use some of that US$100 million sitting in Switzerland.

    Good news. I hear Ghana is about to lose all trading with Mercosur + Chile, and Venezuela over this.

    They have an important client in Brazil, import Argentine food, and use Venezuelan oil.

    If they don't release the ship, they will eventually be starved, and in the dark.

    Off topic but about sureties, the people posting bail for Assange have lost their appeal and have to pay their money by early November, though it was reduced to 2/3 rds as the judge recognised they acted honourably (hinting that Assange had not). Also, the Ecuadorians have requested that Assange be allowed safe passage to Ecuador but the UK government stated that they have an absolute legal obligation to send him to Sweden as the extradition process and all appeals had been completed.

    Really tit amazing. Brail is south americans main import partner totalling 2.2% of Ghana's imports. argentina ranks 31 @ .06% of total imports and they rank relatively the same for exports. Yes titty, they will certainly starve for acting in good conscientous of international law.

    @19, well if we only knew the creditors as from the neck down wearing yellow neru jacket petting a persian cat maybe taking the planes as small compensation for the debt as they land would be a profitable option. But we've seen their faces and the negative publicity of them showing a small child crying that daddy is stuck in Miami (or their other FLA destination, Orlando!) and all she doesn't even have a lousy t-shirt would make such a venture prohibitive. ;-)

    @23 You don't get the picture, do you? To get your boat back you need to put up a bond for in excess of US$10 million. No problem with that, is there? CFK has ten times that in Switzerland. Then the boat can flee back across the South Atlantic and the case can go ahead. No doubt British and American lawyers will fly out to enforce the judgements already given in UK and US courts. The Ghanaian judicial system is largely based on British common law. Let's watch CFK try to wriggle her way out of this one. Incidentally, there may be a British warship close enough to assist the Ghanaian court and intercept anything trying to flee.

    Tell me. Why are you defending a South American country against a fellow African country? Even more so when you look at Argentina's history of 'whitening' the population, and the fact that they (unlike European countries, fellow South and North American countries) didn't free their African slaves, they murdered them.

    Ghana is following it's law, and has impounded this vessel in accordance with their law. Argentina will have their day in court to argue their case, but whether they win or lose, their government has embarrassed their country once more on the international stage.

    The longer Argentina takes in paying off their debts, the longer it will take them to turn their country around. No investors in the world will lend Argentina money because they can't be trusted to pay it back.

    Argentina has the potential to be one of the richest countries in the world, but they remain poor. This is all self-inflicted by sequential corrupt governments, who spend their time in office stealing what they can, instead of investing in the future of Argentina.

    One day Argentina will have to wake up and face its international obligations. One day Argentina will have to accept responsibility for the financial mess it is in, instead of blaming everyone else for their problems.

    I, however, will not bet on that happening soon.

    We have only been here about 14 months, but given the rhetoric levels here that is the equivalent of years in other websites and forums, which we have been keeping under close observation. From engineering forums, to football, to UN forums, to aviation, to skyscrapers, to women's health, to rugby, to Q&A websites... we are EVERYWHERE, 24/7. For years, building our case.

    Our purpose is not to bring down MercoPress, just like our purpose is not to bring down the Mezzanine (right Tobers?), or Airliners.net (right Idlehands?). Once we have gathered enough evidence, we can “blow up” ourselves in whatever forum we had been covertly acting upon since the evidence has been saved in no less than three databases, pressed in print, and sent in several countries off-site to data-security vaults.

    Once all that is done and the legal framing for what was gathered is complete, we can say whatever we want as long as we don't reveal the crux of our case, which I have not revealed nor Tobias, or anyone else will reveal or has revealed in the dozens of other forums we have been participationg over the lat 4 1/2 years.

    It's been fun indulging you with this, but this will be my last briefing. Everything else will come out in time, just keep an eye on the legal websites. I admit this may not make major news channel's information blocks, but keep an eye for those that cover internet legal news. Not now, but around February or March 2013.

I have never seen a poster named Tobias, but I have seen the Truth Telling Troll, but only last week.     As a self proclaimed “socialist” do you believe in the independence of the judiciary from the state ?
    From the little I have read about this case, the judge has only upheld the law.
    Do you think that the President of Ghana should direct the judge to go against the law. Is this not the first step to a dictatorship ?

    The place for Argentina to contest this case is in open court.

    Why should the President of Ghana get involved in a dispute that has nothing to do with his country ? It would look like political interference instigated by “whitey”
    The writ has been served under Ghana's system of law.
    For the President to interfere with this is the first step to dictatorship and these usually end up in a bloody, civil war.
    Argentina has several choices.
    Continue to contest the seizure by judicial means in the courts of Ghana.
    Pay the money and free the ship or
    Abandon it to the authorities.
    It is obvious that some persons in Argentina made a cock-up but prolonging the case makes it worse.
