Ghana court to rule Thursday on the release of Argentina’s Navy vessel

The case of the seized Argentine naval ship ARA Libertad was heard on Tuesday by a Ghana Commercial Court which will rule on Thursday whether to release the vessel impounded on arrival last week at the Port of Tema, according to the official Ghana News Agency. Read full article

    No wonder the Argentine government thinks it is still 1833 if they think ARA Libertad is a warship!

    However, we wait to see what the judgement of the court is, but Argentina's international reputation slips further everyday.

    Yes, the court needs to legally confiscate the boat, to give it international validity.

    Arifu Gobakuwi and his African brothers should be commended for their integrity and the courts too, for following steadfastly, the proper rules of law, to retrieve assets from the defaulting borrower.

    I can't see Ghana keeping hold of this ship. There isn't a great deal of benefit for them coming down on the side of a vulture fund.

    The various court proceedings are being done to show potential investors in the country that they take the relevant action required and follow protocol - even if the eventual outcome has been decided at a political level.

    Damian, You might be surprised to learn that in civilized countries they respect the rule of law and most politicians are very hesitant to involved in court proceedings.

    Even if you think this is settled, let's see siding with a NYC Billionaire Investor or a deadbeat country that restricts imports.

    Damian - nice to see that they took the correct steps though, instead of turning a blind eye or allowing themselves to be bullied.

    At least it will get a court hearing and a response from Argentina.
    As you say, their display of integrity should reassure investors that foreign owned assets will be treated ethically in some countries.

    Yes I do think that it will be returned. Taking this ship will not get the Volture funds the money they claim. This is an unlawful seizure. Just like any attempt to take Tango 1 or Airliners would be. This later scenarios have has already been declared unlawful in US Courts.
    There is too much not being said by Governments involved here. It seems as if not even the Ghanan press nor it's government agencies know much oranything about what is happening.
    The solution to settle this dispute is for both parties to meet half way on the amount to be paid and cancel these debts. Else, this will continue to no avail and blood could be spilled unncecessarily at some point.
    Both sides need to mdeclare half a victory and move on.

    Been having confidence building lessons from La Camping-it-up then I see from this post:

    AG has had plenty of time to settle the debts that it owes since 2001 but has not done so and is now going to reap the rewards that all crooks need to experience.

    Why would anybody in their right mind talk to AG unless the money owed had been paid into an escrow account beforehand? There would be no point as the whole world knows talk is cheap and Argentina is definitely cheap and untrustworthy.

    And what’s with the crap ”blood could be spilled unnecessarily”? The last time AG was anywhere near blood it was in 1982 and it was mostly their own blood that got spilled.

    Your so called government are a bunch of craven cowards with no honour whatsoever and even less morals. But then, you being cast in the same mould, you already know all about that.

    What the argentine trolls are failing to forget....they took someones money with the promise to give it back, which they never did. I call that stealing......people, ordinary people invested their money in those bonds also and LOST them because the scumbags did not give back what they took. argentina stole money.....plain and simple.     11 - You clearly havent a clue how it works do you. If they are awarded the ship then the value of the that they get for it at auction will be deducted from what argentina owe them. Argentina will still owe the rest of the debt. So i see more assets like tango 1 being seized in the future.

    Oh and its not an unlawful siezure either. Read the article pecifically the 2nd to last paragraph which makes it clear the immunity does not apply to this ship.

    As for “and blood could be spilled unncecessarily at some point” - well since you have no other ocean going vessel, how is any blood going to be spilt? Are you going to build an armada of rowing boats and send your army rowing across the atlantic to invade Ghana!

    11 ProRG_American - while a 50/50 split may sound equitable it's not going to happen. Firstly Argentina doesn't want to change it's position from refusing to pay to haggling over the amount as that would in itself be a victory for the hedge fund. Secondly you would then find the other hold-outs and those that accepted a haircut would start making similar demands. Finally I believe that the reserves are already earmarked to make the regular payments to the creditors that did agree to the restructuring. I don't know the Argentine government budget in detail but the desperate dollar clamp doesn't indicate they have any spare to throw around.

    While it's a beautiful ship it's value is a drop in the ocean compared to the debts so win or lose the hedge fund has made a far more important move in terms of pressure than it has done in recovering it's debts.

    Eventually Argentina will get a president that wants to put the country back in the normal fold of international relations and it's not going to happen until this is resolved.

    The crew are free to leave whenever they like. If they were hostages don't you think CFK would be screaming her head off about it? I'm pretty sure the Ghanians, the hedge fund and even the crew themselves would all like them to leave. It is only in the interests of Argentina that they stay because they need a crew to sail her home should she be released.

    However you keep dreaming of your commando attack if it makes you feel better. I'd love to see Argentina try that and make a fast getaway in a sailing ship. Even the local skiffs with an outboard would be faster.

    @29 Seems to me that this is going the right way. I like Frank's idea of the vessel getting arrested in every port it enters.     As a US citizen I sure don't feel like defending a bunch of vulture investors who extracted ungodly interest rates with no intention of risking their capital, especially knowing tax payers, courts or the military would protect them.     Even though the request may be legally accepted, the Ghanaian government is violating the Vienna Agreements because the ship was on an official invitation (guest) in the country and granted permission to dock. Furthermore it is an Argentine Navy ship (and an Embassy as well) so it is considered a warship and hence Argentine sovereign soil. There are 8 Uruguayans, 15 Chileans, Brazilians and other nationals on board. The captain should dismiss the unlawful court order and leave port immediately without any other argument with the locals (under fire if necessary). If unable, Argentina can now call on UNASUR support of the ARA and send a military mission to escort the ship safely out of harbor. A call to Itamaray is due to free up the Sao Paolo; now back in Rio, in case that Ghana refuses to abide by International Law. If UNASUR allows this flagrant violation we must as well burn the Geneva Accords. Its credibility is now at stake.
    The case must be brought forth into an emergency session of the UN and OAS to make clear that there is a rescue mission under way under International Law and not an act of war. UNASUR must explain its position clearly to the AU that there is no attempt to harm neither Ghanan property nor lives and that it is only a mission to secure safe passage under International Law.
    Let the diplomats solve the issue later.

    It it was a warship....defend itself....teehee...sure! The government can invite and not be aware of the law until someone, in the case a creditor, takes an action. Rgland waived dipliomatic immunity over this debt. Deal with it. Charter a damn jet and get and get the crew home!

    NO OFFICIAL INVITATION COULD BE PRODUCED IN COURT.

    Also, the sovereignty of the 'warship', what a hoot, was overruled by the numb-nuts waiving sovereignty on the bonds. This they had to do before anybody with a half-a-brain would buy them. People with a full brain knew better than trust any argie government.

    You just will not accept that this bunch of second-rate crooks 'running' (ha, ha) the country cannot tell the truth if their lives depended on it.
