Argentina trusts in a ‘political solution’ with Ghana to release ARA Libertad

The Argentine Navy Secretary General Luis María González Day, expressed confidence on Sunday that the joint ministerial commission that went to Ghana to seek the release of the training vessel ARA Libertad will reach a successful agreement. Read full article

    and the USA, but leave Ghana out of it?

    Of course, they only have less than 90 days now and Christmas is coming and bureaucracies more slowly etc etc ...

    The ship will be forfeited, but then there will be 1 or 2 million $$$ in Port Fees for Argentina, pay court costs, ship the crew home...

    Of all the stories we've had about Argentina over the years this one has definitly been the most entertaining.

    I'm hoping the hedge fund can get on with auctioning the ship without any further reference to the Argentine shennanigans to reclaim her.

    I agree the irony has been sweet.

    I think a solution will be reached and the ship will sail back to Argentina. However, even if NML are not successful they will not give up. They have nothing to lose, everything to gain, and endless money and time to recover the debt. Every time anything of value leaves Argentina it will be fair game and NML will be successful eventually.

    For the life of me I can't understand why US tax payers should protect deregulated nontransparent hedge funds through US federal courts. We as tax payers pay for the infrastructure of the court systen and yet average Americans cannot buy into these funds. If you believe in deregulation you should believe hedge funds should protect themselves.

I can find the Vienna Convention on Diplomatic Relations, but that doesn't mention “warships”. Only diplomatic missions. It does say that “immovable” items in a mission can't be seized. But this is a ship! It's intended to move. Or be moved. Go ahead, Ghana, stick with the law. US$20 million or seize it!

    Again, where would Argentina take this matter? I'm guessing they think it should go to the Hague. That would be at least a 2 year process.
    What happens if they lose? Do they ignore it like the judgements from the other international courts currently have with Argentina? The 10s of Billions that the USA wants paid immediately!
    The arrogance of these people is astounding. They want to use the courts when it suits them but ignore the outcome when it doesn't.
    They are truly disgusting deadbeat scofflaws.

    A debt is a commodity. It has value and does not just disappear as CFKC thinks it will if she flouts the law long enough. If she had any skills at all as a politician she would never have let this escalate to this level. Her arrogance might be attractive to the domestic audience - though even they are becoming tired of it - but it does not play well internationally.

    NML have deep pockets and will pursue this debt until it is paid. Hedge funds may be unregulated but they are NOT illegal.

    The Argentine government cannot claim any moral high ground when it flouts the law and steals companies.

    Argentina may think that this is about politics, but it isn't. This is about upholding international law.

    International law that the Argentine government has flouted for years. There is no political solution to this problem of theirs, it is a financail solution that is needed.

    So Argentine government, cough up US$20,000,000 from the absolute abundance of dollars that your President boasted that you had (only second to the USA in the amount you hold) and start paying off your debts.

    Maybe if you show good faith in paying your debts, the international community may start investing in Argentina.

    I won't hold my breath though.

    Respect is earned, pretend African (TTT), and the Argentine government has done little to earn the respect of its own people, let alone people from other countries.

    Now after years of believing they have 'got away' with stealing people's money, the Argentine government has been humiliated on the international stage.

    Whether Argentina gets this vessel back or not is irrelevant. How Argentina responds to this situation is relevant. So far, the Argentine government's words and actions have been woefully lacking in substance, truth and strength.

    The world knows for sure that Argentina is in deep financial trouble when they can't cough up a mere US$20,000,000 (a mere drop in the ocean compared to a national budget surely?) to get their ship back.

    I would also advise the Argentine representatives not to attempt to bribe the Ghanaians. Just think of how much kudos the Ghanaian government would get exposing Argentina for attempted bribery!

Govt newspapers like Pagina 12 are trying to blame the Navy for this fiasco , alleging that Navy chiefs are in league with NML and deliberately sailed the ship to Ghana so that it could be siezed. Opposition papers , notably Clarin , are publishing the truth , which is that the Navy questioned the wisdom of going to Ghana , but were ordered there by both Puricelli and Timmerman . This issue is seriously polarising the country ,and has cost KK any political goodwill she had left , which is why the trolls are either keeping a very low profile or desperately tying to change the subject .
    By arguing with the court the government is simply pushing the cost of recovery up . If they abandon the ship , the Kirchnerite legacy will be destroyed , she will have to cave in .

    There was an interesting article in a sunday magazine about this new phenomenon. In the USA the conservatives said a few weeks ago that the economic reports and election polls where a fraud, a massive global conspiracy involving media, government, the UN, and individuals.

    Last few days, election polls have turne in favor of the conservative, and some economic reports have been more negative. Those same exact people now bruit about those polls and statistics as the 2nd coming of the Tablets of Moses.

    What a bunch of quacked people, to use the data sources that some weeks ago they purported to be the work of the Antichrist, because now they work in their favor.

    Who said I believed the Arg crime stat? I don't I think most crime in Argentina is under reported for a few reasons, citizens are afraid of the police, the police are uber-corrupt, the gov't wants to have lower crime stats.
    I would bet the increase in violent crime, kidnappings, assaults and robberies is much much higher than the stats show.

    First thing someone told me when I moved to BA is never to call the Police it will cause much more problems that whatever you were calling about.

    You would need the minimum force necessary,

    Special Forces,
    Amphibious forces,
    An aircraft carrier, or an helicopter carrier at the very least,

    An alternative would be a sub,
    A rescue team in case it goes wrong, and plus an abstraction team,

    Air fore cover were required,
    Diplomats to cover open ground and to stop the sparks flying,

    Oh and or course special agents in place,

    Included, is a downloadable pdf of the actual 25 page Court Order to seize the vessel.

    The Judge specifically points out, in the document, that the ship does NOT have immunity as a ship of war in a Ghanian Court.
    Further, he outlines that Argentina agreed, in a UK Court of Law, to waive all immunity from seizure, as part of their financing terms.
    He goes on to note that Argentina had agreed in Court, to repay their creditors, but had not done so.

    Nothing to argue, really.

    The excellent judgement by the Justice of the High Court of Ghana makes every attempt possible to let AG have its say and to provide EVIDENCE that would allow him to set aside their immunity that THEY originated and signed for the bonds.

    Given the unusual fact that AG have in the bonds themselves provided in the legal opinion of the UK Supreme Court (to which AG had appealed the first contra-judgement) Lord Collins stated “This was the clearest possible waiver of immunity”.

    So they only have themselves to blame.

    BUT, (there’s always one) AG seem to be relying on their type of justice to give them the ‘get out of jail card’ where the state can interfere with the justice system by removing judges from the case.

    Of course, Ghana, being an ex-British colony had the good sense to follow the British example and keep the state well away from the judicial system. This is clearly stated in the COURTS ACT
    1993 (ACT 459) of Ghana. The Supreme Court follows the usual (in civilised countries, not AG) where the lower courts must refer points of law to them, BEFORE making a decision. I have no doubt that this has been the case.

    I particularly liked the way that the Honourable Richard Adjei-Frimpong, Justice of the High Court published his CONCLUSION, the final sentence: “If that option (of AG providing security and taking away the ship) is unattractive for whatever reason, so be the order of the Court. The motion is accordingly dismissed.

    It is difficult to see a way forward for AG to recover the ship other than to pay the money. The Supreme Court has no remit to intercede and the government of Ghana would not be so stupid to do so in the high profile case.

    But it wouldn’t be the first time that AG have weaselled out of something.

    briton it will be interesting to see if they actually bring it to the international courts. If they do an lose, they will esentially be slapped down at the point by the world. If they don't......they can still bark, cry and blame everyone else. I am not sure if thr rg's will chance that.
    Can you see or imagine any navy in the world allowing a ship to be taken without resistance? Albeit it is a traning cadet vessel, but typical not far out of reach of there iron sister ships with fire control systems. If I were the skipper I would make way, what will they do.....sink her?

    The international courts sounds like an excellent place to discuss the lawful detention of 'libertad.

    It is OK for Argentina to seize foreign assets like YPF while grossly disregarding the Argentine constitution (First Part, Chapter I, Section 17: “Expropriation for reasons of public interest must be authorized by law and PREVIOUSLY compensated.”), but when an Argentine asset is seized according to international law, all we hear is whining.

    It is always somebodyy elses fault.

I think at some point Singer will send an seafaring tug to tow her back to the states.
