Meanwhile Argentina -the country with it all- continues lurching from week to week from one sensational event to another with a highly polarised society with all and sundry protesting and more in the works becoming more and more intense. We'll see if Argentina or the government is still -winning- next year. I dont wish ill of Argentina quite the opposite but just saying its not looking good for next year.

So in theory neither party is legally bound to the courts decision.

Request for the prescription of provisional measures.
ORDER
THE TRIBUNAL,
(1) Unanimously,
Prescribes, pending a decision by the Annex VII arbitral tribunal, the following provisional measures under article 290, paragraph 5, of the Convention:
Ghana shall forthwith and unconditionally release the frigate ARA Libertad, shall ensure that the frigate ARA Libertad, its Commander and crew are able to leave the port of Tema and the maritime areas under the jurisdiction of Ghana, and shall ensure that the frigate ARA Libertad is resupplied to that end.
(2) Unanimously,
Decides that Argentina and Ghana shall each submit the initial report referred to in paragraph 103 not later than 22 December 2012 to the Tribunal, and authorizes the President to request such information as he may consider appropriate after that date.
(3) Unanimously,
Decides that each Party shall bear its own costs.

Ghana considers, however, that the resolution of this unfortunate dispute must comply with the relevant rules of international law, which are not to be found as such in the Convention. Accordingly, as matters currently stand ITLOS does not have jurisdiction to order the provisional measures requested by Argentina.
Judge Yanai can make as many orders as he wants. If Ghana hasn't agreed to be bound by his decisisons they are meaningless.
However I would imagine that Ghana will take the opportunity to have it dealt with and put it the whole sorry affair behind them.

I would have thought that NML could now invoke its various judgements and take possession of the boat. NML is not bound by the ITLOS judgement. There's bound to be more. NML will have been prepared. I wonder if an appropriate court could order a warship to arrest the Libertad at sea and tow it into a more suitable port.
Well that was a real disappointment and I have to agree with others on here who having watched the absolute shambles that was the AG ‘legal team’ this decision is just incredible in the real sense of the word.

As Argentina has no nuclear weapons, it means that you are not a potential target. If they did aquire them and continue with their belligerent attitude against the UK, then, no doubt contingency plans would be made to put you on the list of POSSIBLE targets BUT you would have to fire first.

The only military person I've ever met with an attitude like this dick. I was on exchange at RMC and he was on exchange as well but working in one of the big DoD offices in the city. The UN Law of the Sea court can only pass judgements on states, it can not however overrule a states internal judiciary's court orders where one party is not a state! Nor can it rule on issues within a states internal waters (ports), where the states judiciary has legal jurisdiction.

Great, because if Argentina imposes such taxes, less people will import your produce, meaning you will have no money to update your armed forces. This means that any attempt to attack the Falklands will result in the UK teaching you a lesson you will never forget and with the eradication of your remaining armed forces you will suffer more debt.
Why not put the tax up (try 500%) so nobody will buy your produce?

After all the ILOS, the treaty which sets up the tribunal, is a treaty that specifically excludes ports and inland waterways from its terms. Ghanaian courts have jurisdiction over the port not the tribunal.

Of course Argentinas laws apply to what happens in their ports, the problem is the Argentinian government is quite happy to turn a blind eye to people breaking Argentine law in their ports where it suits their political ends. It is the Argentine governments attitude and the break down in a law and order in the country which has led to a number of cruise companies abandoning Argentina as a destination. No law, no security.

That is why vessels under all flags that are involved in the FI oil and gas industry do not dock in Argentina. No Argie law effects cruise vessels that is why it is the thugs attacking the cruise ships as government proxies, if it was against Argentine law it would be official government organistions acting.

As for it being illegal for all British ships to dock in Argentina, when Britain summoned the Argentine ambassador to complain that it wasn't safe for British ships and that Argentina had breached its treaty obligations, Argentina did not say it wasn't under a treaty obligation to protect the ships or that it was illegal for the ships to dock, the ambassador denied there was any risk to the safety of the ships.

The PR stunt by the financial group have been extremely successful in their aims to bring Argentina a lot of pain for non-payment. I'm sure for good measure and to impact Argentina some more they will appeal the ruling just to drag this out for a bit longer.
I said it before and I will say it again, I don't think its right for a private fund to be able to seize a Argentine naval asset even if it isn't a warship.
I am, however, surprised by Tobias behavior which seems to of hit a new low in this thread. It's been a downward spiral for Tobias since joining the forum to where we are today.

Well Ghana can appeal if they wish to, to the highest court on earth, the ICJ, who have the power to overrule the ILOST.
However, Ghana could do several things:
1. Get rid of the Libertad, as it is a poisonous albatross around their necks.
2. Ignore the ILOST ruling, as this is an INTERNAL matter to Ghana, and the ILOST doesn't have the power to overrule a sovereign nations court.
3. Let the Libertad go, but only after the Argentines pay their docking fees in full.
Frankly, if I were one of the Libertad crew, I'd be a bit p!ssed off being told that I wouldn't be home until after Xmas!
This could be termed an Argentine victory in that ARA Libertad MAY be coming home.

The Mayan calendar is just that, a calendar. It doesn't mention the world going under, it merely states Happy New Bak'tun.
That some people make an apocalypse out of it, isn't the Maya's fault.

Maya writings could be as old as 400 BC; highest state of development was during the Classic period (AD 250 to 900), and continued throughout the Post-Classic period until the arrival of the Spanish. The Spanish conquest and colonization of Mayan lands was between 1540-1560.
However, the catastrophic decline of the Mayans - as a civilization - was between 1020 and 1100.

Did you learn nothing of Latin in your Spanish colonial church? I would have thought the majority of the service would be based on Latin.
