I feel quite divided on this one. Argentina did win a victory IMO over a hedge fund who bought into the debt in question an are holding out for full value payment when others agreed restructuring. That seems reasonable but at the same time you have to take into account how the debt restructure happened with figures being dictated etc which is not the process you follow when re-nogociating. Regardless of it all this has been very embarrassing for the argentine population. Yet again the powers that be in your country has focused he world community on how things are conducted at a political level in you country. Highly embarrassing...!

Great news, it will be marvellous to have ARA Libertad back home after her rather grueling and tense visit to Ghana, I'm especially glad that the crew are coming back in one piece and am sorry that they are missing Christmas and New Year with their famillies.

The Libertad was seized without the involvement of their Government through their courts. It caused a diplomatic incident which frankly, I do not think they either sought or wanted. I still find it incredulous, that a democratic people such as the Argentines, can not distinguish between the two, Executive and Judiciary.

The Ghanaian Court could have ruled that as this took place in internal and not international waters, the Tribunal had no jurisdiction. Part of me thinks they were hoping for this result.
Either way, they have demonstrated to all and sundry, that the rule of law exists in Ghana and that is not something you can say about all African countries.
Calling them corrupt is nieve and childish in the extreme,

the arrival of IUO LIBERTAD at Mar Del Prat, is expected to be delayed by two weeks.
However a spokes person for the Argentine IOU Navy said, “This is ok, as El Presidentes Victory speech will just be finishing as the Pride of The Nation pulls alongside. A further weeks delay could have causes slight problems, as the arrival would interupt Senor Tinmans speech.” Neither person was available for comment, all further communication on this matter should be addressed to their Litigation Lawyers.

Here's my take: Argentina has in fact scored a major victory. Due to the Tribunal of the Sea ruling/order, contrary to what some posters have said above, going forward ARA Libertad, Espora et al will be able to go anywhere they please whenever they please, without any fear whatsoever. This is because now there is legal precedent that those assets cannot be seized nor even detained by any State. So no judge anywhere will waste time delaying these ships knowing that he/she will ultimately have to release them - and especially so if, by detaining them, significant costs would be incurred which would not be recoverable from the untendered bondholders. So while other points made above regarding Argentina's poor governance, policy mix & poor treatment of it's bondholders might have merit, I think that Argentina's victory in the case of the naval assets is very real & undeniable.

Therefore the UK has a moral position that war reparations can be achieved by restraining and retaining any or all military assets that come her way.
It is not just the bond-holders that are in need of recompense,
and Argentina's 'military' assets on the high seas or in a suitable harbour should be 'fair game' towards payback for the expense incurred in 1982. My guess is that around £6billion (present value) should cover it.
Did the UK ask for and get reparations? If not, why not?

Doubt if the stuff was worth five bob (that will confuse the argies). :o)
