The Argentine Navy flagship ARA Libertad set sail for Mar del Plata on Wednesday four days after a UN court ordered its release from the Tema port in Accra, Ghana, following a 77 day embargo (since 2 October) due to a claim by vulture fund NML Capital. Read full article

That ship shall now become an indelible, metaphoric, and everlasting cynosure to all who fervently yearn for a world liberated from the yoke of feral capitalism and furciferous bankers, and a puissant dreadnought to those sauntering the halls of financial Mordor, that their heydays have seen their final gloaming.
Dec 20th, 2012 - 12:07 am - Link - Report abuse 0Take a long hard look.... this is the last time you will see this vessel outside Argentine friendly waters, strict instructions to dock at friendly ports in future for all non military vessels, kind of narrows it down somewhat.

Although argentina finally secured the release of the ARA piece of sh*t and will understandably see this as a mighty victory played to the easily pleased peasants , as argentina past and present has had nothing to celebrate other then failure, one has to ask who actually was the biggest loser ??? :))))
ghana - no
nml - there will be other opportunities.
argentine - worldwide embarrassment shown to be vulnerable, incompetent and diplomatically wreckless, strike one navy chief, oh but they got their little boat back, which they were always going to get, meanwhile other assets stay grounded for the foreseeable future, Priceless!!!:))))

I feel quite divided on this one. Argentina did win a victory IMO over a hedge fund who bought into the debt in question an are holding out for full value payment when others agreed restructuring. That seems reasonable but at the same time you have to take into account how the debt restructure happened with figures being dictated etc which is not the process you follow when re-nogociating. Regardless of it all this has been very embarrassing for the argentine population. Yet again the powers that be in your country has focused he world community on how things are conducted at a political level in you country. Highly embarrassing...!

Great news, it will be marvellous to have ARA Libertad back home after her rather grueling and tense visit to Ghana, I'm especially glad that the crew are coming back in one piece and am sorry that they are missing Christmas and New Year with their famillies.
Dec 20th, 2012 - 02:32 pm - Link - Report abuse 0With regard to Rosarino's comment that Ghana has lost US$ 7.6 million, I believe that NML will be footing the bill for all losses incurred over this business. If for some reason NML does not cover Ghana's losses they will NEVER get another favourable descision from any court anywhere!!!!!!!
There is no reason, Rosarino, to say that Ghana's High Court Judge Frimpong is corrupt, from the Supreme Court descision we can only deduct that he was wrong to understand that when we, the Argentine people, said that we waived our sovereign right to immunity, it didn't include our warships, that does not mean he was corrupt, it means he was WRONG!!!
@43 However, you did waive your immunity regarding all state assets, and warships are state assets. Sort of makes everyone wonder why you're such a bunch of incompetent clowns, that celebrate FAIL, really.
Dec 20th, 2012 - 02:43 pm - Link - Report abuse 0Sorry about that.
For 1000 generations, will the echoes of this sublime stand lambent over the chronicles of legend, justice, and time.
Dec 20th, 2012 - 02:45 pm - Link - Report abuse 0I think the Ghanaians grasped this decision with both hands, as a way to sort out the problem without losing face. The Libertad was seized without the involvement of their Government through their courts. It caused a diplomatic incident which frankly, I do not think they either sought or wanted. I still find it incredulous, that a democratic people such as the Argentines, can not distinguish between the two, Executive and Judiciary.
Dec 20th, 2012 - 02:53 pm - Link - Report abuse 0The ruling of the Tribunal, was obeyed, it did not have to be so. The Ghanaian Court could have ruled that as this took place in internal and not international waters, the Tribunal had no jurisdiction. Part of me thinks they were hoping for this result.
Either way, they have demonstrated to all and sundry, that the rule of law exists in Ghana and that is not something you can say about all African countries.
Calling them corrupt is nieve and childish in the extreme,
@35 wow touchy aren't we. Edinburgh could sail past at full power and the wash would do for Libertad no need for any weapons : )

@24 Oh, no. We can see your little joke. But that's because we have little difficulty in following the limited mental processes of the lower orders. In the meantime, the UK still has a AAA rating. As has the USA. Argieland has CC, yippee! Bolivia has B+. Brazil has BBB. Chile has A+. Colombia has BBB-. Ecuador has B-. Paraguay has B1. Peru has BBB. Uruguay has BB and Venezuela has B+. So, only one worthwhile country in the whole of South America. And argieland is, quite properly, right at the bottom. C, of course, stands for the generally held view of argieland's leader, although it's not polite. B you can figure out for yourself.
@38 you insult usurping what belongs to Argentina. What exactly belongs to argieland? Kiddies never understand. When you borrow shed-loads of money, you don't own anything you've bought with it until you've paid all your debts back. Got it now?

Is this a re-run of 1982 when Argentine ships headed for port and stayed there?
Still there has been a lot of harbour space freed up by the cruise ships that don't want to endure Argentinas bullying any more, so the Libertard won't be blocking any commercial space.
The Argentine Navy at least will never try invading the Falklands if NML set up an office in Stanley.

Dec 23rd, 2012 - 04:54 pm - Link - Report abuse 0Must be a lash-up job for Espora because I have seen the photos of the damage to the whole electrical distribution system and even the German builders acknowledged it was a 5 or 6 month job to do it correctly.
But there we have it, don’t we.
The country that ‘walks on water’ mainly because her boats sink, won’t have taken any notice of that and will be limping back because of the politics of the situation NOT the safety of the crew.
As an American sailor, ha, ha, ha, you should know these things: but you don’t do you?
I think, Isolde, she is not intrinsically ugly;

I have the same problem with my waistline, but I draw the line at having the tummy-tuck to get rid of it. I have seen the pain involved, and I am an old coward - or too sensible, depending on your point of view.

but the asylum is not that silly, lol.
Here's my take: Argentina has in fact scored a major victory. Due to the Tribunal of the Sea ruling/order, contrary to what some posters have said above, going forward ARA Libertad, Espora et al will be able to go anywhere they please whenever they please, without any fear whatsoever. This is because now there is legal precedent that those assets cannot be seized nor even detained by any State. So no judge anywhere will waste time delaying these ships knowing that he/she will ultimately have to release them - and especially so if, by detaining them, significant costs would be incurred which would not be recoverable from the untendered bondholders. So while other points made above regarding Argentina's poor governance, policy mix & poor treatment of it's bondholders might have merit, I think that Argentina's victory in the case of the naval assets is very real & undeniable.

Dec 24th, 2012 - 11:54 am - Link - Report abuse 0Undoubtably, a declaration of war and conforming to the cecession of war is not the way Argentina does things.
Therefore the UK has a moral position that war reparations can be achieved by restraining and retaining any or all military assets that come her way.
It is not just the bond-holders that are in need of recompense,
and Argentina's 'military' assets on the high seas or in a suitable harbour should be 'fair game' towards payback for the expense incurred in 1982. My guess is that around £6billion (present value) should cover it.
Did the UK ask for and get reparations? If not, why not?

Dec 24th, 2012 - 02:26 pm - Link - Report abuse 0I see to remember a few aircraft and APCs’ as well as the crap PW (mainly FN SLR) but the Unimogs were never paid for by the argies and I think Mercedes had them back from the MoD.
Doubt if the stuff was worth five bob (that will confuse the argies). :o)
Good news, roll on the 9th =)
