Prime Minister David Cameron must return the Falkland Islands to Argentina, 180 years after the territories were “forcibly stripped” from Buenos Aires, President Cristina Fernandez has claimed in UK newspaper adverts scheduled to be published on Thursday and which has been anticipated.     Nice play on words here, hoping to misrepresent a UN Resolution.

    I wonder if she mentions the words “self-determination”. Probably not, but then again you have to love her desperate style of newspaper advertising. I hope they paid in advance.

    I think the UK should start negotiations. They can meet with Argentina's president every January 3rd and ask whether Argentina will recognise the UN Charter and give the Islanders self-determination. When they answer no, they can thank them for the chance to negotiate and return the next January 3rd.

    Hard to argue that you ignoring a UN Resolution then isn't it?

    How so Argentine to overlook that these resolutions were non binding “motions” in effect from the Gen Assembly and similar committees - and of course completly OMIT formal legal binding res 502 of the UN Security Council following Arg invasion of the islands whilst Sov talks were still in action!!
    So unArgentine to ovelook that her own history archives list the names of all who STAYED on in the Islands in 1833!
    But Good news - she will have paid in Dollars - so a bit less in her reserves and a bit of usefull cash into the UK private sector - just what the UK economy needs!! - Keep it up old girl!!

    Look, it's obvious the 2 sides in this dispute will never agree. They can't even agree whether the Falklanders are involved or not.

    The advert in the Guardian is just another in the same vein as those from the leaders of North Korea, Libya (pre-overthrow of Gadaffi), Yemen, Sudan, etc. It is there to look good to THEIR OWN PEOPLE.
    No-one in the UK or the Falklands will be swayed by it for a second, only CFK fans.

    Either Argentina's politicos needs to get over this tiny territory, and see that their electorate have more pressing issues, or they will be doomed to decades of disappointment.

    The only power that can force the UK away from the Falklands, is the Falklanders themselves. Not even Ronnie Reagan could do it.

All the advert will do is stir more heightened support for the islanders, like the backfiring Argentine Olympic advert did - It will even cause some Brits to start calling for military lesson teaching to CFK, as to be honest our patience is starting to wear thin.     CFK is like the pot calling the Kettle Black. She has no idea of our identity of these Islands. Funny how she never mentions the fact that Argentina was created by stealing land from the indigenous people of that land. The Falkland islanders have never stolen any land or killed inocent people to claim their rights to live these Islands and Britain who had laid her claim over a hundred years before the Argentines nter claim they received them from Spain is the biggest joke of the new year. It is about time this whole nonsence was put to rest. The Islanders have existed on the Islands for almost the same time Argentines have existed in their Country. If there is any decent Argentines living they would totally agree with me that The Falkland Islands belong to the people who live there and just like all Argentines are a people in their own right. CFK and any previous government has refused to recognise we exist just as they refused to recognise the Indigenouse people of South America those same rights. Argentina will always be the greedy type because that is how they came to be in the first place.
    Britain has supported our right as has the United nations to be a people who should be allowed to choose their own destiny. No one else should be able to dictate otherwise.
    Meanwhile let us enjoy a peaceful 2013 and we will all be prosporouse as a result.

    Nice sentiment Rob. Here's hoping all proves well with the Referendum, too. It should raise world awareness. This stunt by CFK should further raise the profile of the Falklands, in time for the voting in March.

    Hopefully, it will make turn the eyes of the world on Argentina and her SA Mercosur partners, and spotlight their actions.

    Just read The Economist: The World in 2013.

    They mention the Fslklands Referendum, but predict that the oil wealth discovered will make it difficult for the Referendum to have any effect on FI's neighbours.

    Interestingly, they also predict that CFK still has a chance of pulling together a 2/3 majority to change the Constitution before October, to allow a third term.

    That being said, elsewhere in the Economic Profile Section of the magazine, they state the official INDEC inflation rate for Arg. , 9%.
    Nothing about 'false reporting' in the accompanying comments either.
    It makes you wonder how current or detailed their info is.

    BTW, Correa is predicted to become the “biggest irritant south of the border” to the US, after Chavez dies.

    #21 T.T.: it's sad but true, islanders will have problems with Argentina forever. Here we are taught “England stole the islands from us” ad nobody knows the real history. The “Malvinas issue” is used every time the country is going through hard times and when someone thinks different about it is bullied as being against Argentina.
    Also, just in case Falkland get independence and cease to have U.K. military protection, be sure Argentina will try to invade the islands again.
    The real inflation rate in Argentina (for 2012) have been over 25% and for 2013 is estimate being over 30%.
    About CFK changing the Constitution, is sad but she still have chance. If that happens she will go forever.

    This story was even on BBC Radio 4 this morning as I drove to work. Our government gives the same response. ”only if the islanders wish it'.
    Her letter referencing the 1960 resolution fails to point out that it is at odds with the UN Charter on self determination. Britain explored the possibilities at the time but without a mandate from the islanders there can be no handover. Thus the falicy that argentines have lived under continues to be renewed by the latest argentine el-presidentee and its ass-backward government.

The arrest of Jim Davidson - a comedian who hardly anyone outside of the UK has ever hear of is making headlines in the international media, whilst CFK pathetic and totally transparent stunt gets hardly any mention at all ... because the fact of it is that everyone can see that she is full of piss and wind and that this stunt is for purely domestic Argentinian consumption.

    I find it difficult to accept the cliche that we get the politicians we deserve. At best, parliamentary democracy can lead to some moderation in the behaviour of politicians. For example, a majority of the British people were opposed to the invasion of Iraq, and that made no difference to what happened. Every country has people who do wise things and people who do stupid things.

    That's it, I've had enough! I'm writing to my MP calling for action.

    I propose that we dress all of our royal marine defenders on the islanders as unarmed south american natives and camouflage all royal navy vessels as some form of even-toed ungulate (llama, guanaco, whatever reaches that far south).

    Maybe that way, when the next Argtard conscript army tries to take the islands they may be brave enough to hold their ground.

    History records argentines are a lot better at mass murder of civilian populations than fighting against a professional army.

    Give the Argentine forces intermittent local air superiority, fortified high ground and 10-1 numerical advantage against British troops and watch them run like hell. Maybe if they thought the approaching body of people were just civilian farmers they'd be brave enough to fight back?

    I think that Sra Kirchner should be shaken by the hand by the British Ambassador in Argentina, for the President has done a great job with her unsigned 'letter' in the advertisments she paid for.

    She has primed world interest in the outcomes of the forthcoming Falkland Islands Referendum.
    .... Become an Argentinian colony
    .... Become an independent state
    .... Remain a British Protectorate
    Self-determination.

    Now it will (might) be published around the world that the Falkland Islands are a self-determining British Protectorate.

    The world will have it re-inforced in its collective consciousness that to be protected by the British really means something, and that the British WILL fight for those under its protection.

    She has allowed interested parties around the world to find out that the Falkland Islands were British well before Argentina even existed.

    As I understand the current debate on Britain's rationale for its ownership of the Falklands/Malvinas: Britain says that it never expelled Argentine citizens from the Island in 1833 because there weren't any living there; that Britain only sent an Argentine military group packing.

    Without doing more than looking at the current British argument for authority over the Islands, the question needs asking: Is it necessary for a nation in claiming land that its citizens occupy that land as opposed to a military garrison? In asking that question, another question can be asked: Does the flooding of another country with your citizens make that country their country? Ah well, I suppose that there are any number of answers. But I have only one answer: that “group” with the most guns and political will to use them against a competing group will win the debate.....

    I notice that you miss the very salient point that not a single Argentine citizen was expelled from the Falklands in 1833, because Argentina didn't even exist in 1833 .. not to mention that the so-called Argentine commander of the Falklands at the time was neither Argentinian nor a citizen of the United Provinces - he was German and his deputy was British - and that the civilian members of the settlement weren't even expelled (in fact, some of the descendants of that very colony established in the name of the United Provinces are still resident in the Falklands to this day and regard themselves as British, rather than Argentine.

    Even if there was substance to the 1833 argument (which there isn't) the Falklands would in fact be Uruguayan, not Argentinian.

    Argentina didn't EXIST in 1833. The United Provinces of the River Plate sent troops to the Falklands to set up an ILLEGAL Penal Colony on BRITISH territory (since 1649), which was IMMEDIATELY protested by the British.

    Then HMS Clio turned up and threw the murdering, raping, mutineering troops from British territory, in accordance WITH international law as it stood in the 19th century.

    No Argentine troops were expelled in 1833 because Argentina didn't EXIST then. The UP then un-united to become Uruguay & Argentina.

    See, your arguments FAIL immediately on this point.

    The Argentine Republic was finally ratified in 1853 - a full 20 years AFTER the 1833 incident.

    But even if Britain HAD kicked civilian Argentines off in 1833 (impossible as Argentina didn't exist at that point), after nearly 200 years the Islands belong to the inhabitants. Just like Argentina belongs to the inhabitants, even though 90% of those inhabitants STOLE that land from the indigenous population.

    So the minute Argentina hands back ALL the land it stole from the native population (in other words ALL of Argentina) will be the day the Falkland Islanders will consider handing back the Islands to their native population - namely the Penguins.

    By the way, how much of the Argentine taxpayers money has your government wasted on this advertisment?

    They are facts. The United Provinces fought among themselves and split into what would become Argentina and Uruguay. FACT.

    First of all, CFK should get her own country in order and tackle inflation and crime and other issues before she goes on some diplomatic tirade. It is simply a means of distraction away from issues she can't get control of in her own country. The last time the Argentines made such a fuss was for the same reason, a discredited Junta trying to distract its population from hardship. Look where that ended.

    Argentina has no direct claim to the islands. If anything the Spanish would have more of a claim. The Argentina that declared independence 200 years ago was a nation in flux and was so for another 50 years, its borders disputed, its sovereignty not fully recognized until at least 20 years after 1812. Argentina relinquished its claim in 1850 under the Convention of Settlement.

    Argentina can go on and on about UN resolutions. All they ask is for the british and Argentines to talk about sovereignty. Argentina denies the fundamental UN principle of self-determination, which overrides the substance of the UN resolutions themselves.

    Furthermore completely ignoring the Falklanders is stupid and ignorant. why would they want to be part of a country that ignores them in this instance? But if Argentina was doing good economically and politically, maybe the Falklanders would like to join Argentina? We are all rational egotists. Even many N.I. Unionists 5-6 years ago looked in awe at the Republic and thought “maybe, even just the corporation tax” until things went belly up. But why would they want to join a country that has endured military coups, economic mismanagement, hyper-inflation, a country that raids people's pension reserves, over-rules contracts and ruled by a President that if she doesn't like you she will do her best to destroy you.

    Cristina should shut up and spare her country international embarrassment and sort her own country out before she goes on an international diplomatic tirade

    In 1849 General Rosas(or Rozas) was Supreme Chief of the Argentine Confederation as Argentina was known at the time. In this year the Arana Southern Treaty(later ratified by both parties in 1850) was signed by representatives of the Argentine Confederation and of the United Kingdom. This treaty became known as the “Treaty of Settlement” and also the “Treaty of Perfect Friendship” as these sentiments were expressed within the body of the treaty document.
    This treaty came about after the withdrawal of a trade blockade by France and Britain of the area of the River Plate - both Argentina and Uruguay were affected by the blockade. Whilst this treaty solved the problem of the blockade it also gave Argentina the opportunity to state an exception to the “Settlement” and/or “Perfect Friendship” - the matter of the Falklands/Malvinas. This exception was not mentioned in the Arana Southern Treaty and it was not until over 40 years had passed that the matter was ever mentioned again.
    In the meantime Argentina had prospered through foreign investment, mainly British, and had become one of the biggest and most prosperous economies of the world. In fact, in the early twentieth century a president of Argentina stated that Argentina would have to be eternally grateful to Britain for its collaboration in the prosperity of his country.
    Back to the Arana Southern Treaty - in many circles, even in Argentina, it has been accepted that this treaty ended any claim that Argentina might have over the Falkland Islands. Britain's lackadaisical treatment of the islands over the years has encouraged Argentina's nationalists to believe their own mythical and folkloric history of the archipelago.

Perón himself even admitted that the claim was a completely baseless one that was nothing more than a pro-German / anti-British propaganda stunt and was astonished when the British government came close to doing a deal with him in the 1970s .. a deal which ultimately came to nowt because Perón fortunately did the whole world a favour and kicked the bucket just months before pen was to be put to paper.

    The only binding UN resolution regarding the Falkland Islands was the one in 1982 which insisted Argentine illegal invaders leave the islands. Argentina ignored that resolution compelling the British to expel the armed squatters forcefully at the cost of British lives.

    The other thing your tragic little case of revisionism overlooks is the fact that none of those 10 territories is seeking further independence - and that territories, such as Danish Greenland and the Netherlands Antilles, which have far less independence than any of the British protectorates have , have been removed from the Special Committee on Decolonization list. The only reason the 10 British protectorates haven't been removed is purely political and because Argentina makes political objections to it. It has no more significance than that.

I guarantee you, that once they collect on their mission; they will be on the first plane out of there.
    It was obvious that Carmen Aristegui noticed that they were lying, she seemed uncomfortable, but made little effort to question them. Unfortunately her hands are tied by the CNN's pro North agenda in Latin America. It’s either put on who we want or you are off the air, as she experienced with her radio show after she questioned local authorities. CNN exploits programs and their hosts outside of the USA knowing that if a program is cancelled, that there will be other puppets ready to take their place for the money.
    I recorded the interview and wrote a letter to Ms. Aristegui explaining to her point by point where they had lied, attempted to evade question or deviate from matters that would have exposed their deceptions. I suggested for CNN to provide equal time by inviting a spokesperson the Argentine Embassy or Foreign Ministry on her program to explain Argentina’s position on the Malvinas matter. I have not received a response nor have I seen another of her programs discussing the matter.
    This is one more example of the need to have CNN booted out of Latin America.

    This is where some Argentines like me have a different opinion then CFK, and because I know there is no peaceful way to deal with the Brits I support a nuclear defence program 100% made in Argentina, but I must admit CFK deals with the Brits a lot better then all other presidents before her, she manage to turn a forgotten cause into a energy power hub, and if she if she is smart enough she can even get Iran, Russia, N Korea or China to help build a nuclear defence program in exchange for some oil drilling concessions in islas Malvinas Argentina.     As usuall both parts always tell just what is convenient for them, respecting historic facts, i have never believed in our official history, that's why i have investigated exhaustively about the veracity of the arguments of both parts of the conflict, in my comment 9 of an article published today here, about a brief history of the island, i explain what i think about the arguments of both parts.
    Respecting this letter, c. f. k. just asks the u. k. for a negotiation, the word negotiation implicates that both parts will have to ceade in some aspects of their claims, it means that if the u. k. decides to resume the negotiations with arg. tomorrow for the sovereignty of the islands, and the islanders manifest that they want to remain under british govt., arg. won't be able to force them to accept our sovereignty only, because thats' not what is signalized by the u. n. On the other hand, the defence that the u. k. does of the right to self determination, is just hipocresy, because the malvinas-falkland cause has always considered like a special colonial situation by the u. n, beside, it has never expressed that self determination must be applied for this acuse, like it did for others colonial situations, and it has never considered the govt. from the islands as a third part. All the resolutions just ask arg. and the u. k. to find a negotiated solution. Anyway, i have always expressed also that beyond what the u. n manifests, our govt. should include the islanders, when it asks the u. k. to dialogue in order to find a negotiated solution for this conflict. C. f. k commits a big mistake, when she doens't include the islanders in the proposal for a dialogue. Actually the three parts aren't acting correctly, the problem is that the hipocresy, and the lack of intellectual honesty of many of the people who publish their comments here, won't let them see that all the parts aren't acting correctly, that's why, they will continue blaming argentina only.

    When, oh when are Argentines going to learn that in a negotiation you have to actually bring something to the table. You also have to have all the stakeholders at the table. Choosing to omit the people who morally, legally and ethically own the land from an Argentinian-sponsored negotiation over which they bring absolutely 'nowt' just shows how nonsensical they are.

    Better to just wait, let them shoot each other, then carve up their lands between Chile, Falklands and Uruguay.

The principle of self-determination does apply to the Question of the Falkland Islands/Malvinas because the Islanders were subject to rule by British colonial government & thus listed as a UN Non-Self-Governing Territory under UN Charter Chapter XI Article 73 entitled Declaration regarding Non-Self-Governing Territories

    Strictly, the UN Charter issue is not a question of sovereignty, rather a question of removing colonial rule from the Islanders through the process of self-determination

    Specifically both Argentina & Britain must support this change under UN treaty obligation; furthermore Argentina is obligated to support the British implementation of Article 73 via Resolution 1514 as Argentina voted for 1514 & is a UN Treaty signatory. In accordance with this Declaration the British government as the Administrating Country must develop self-government by transfer of all powers to the people of the Islands & the British government must report annually to the UN Special Committee on Decolonization who's terms of reference are defined in resolution 1654 as to examine the application of the Declaration, to make suggestions & recommendations on the progress & extent of the implementation of the Declaration, & to report to the General Assembly

    With respect to the question of territorial integrity, the effect of the UN Charter is not retrospective & does not apply to disputes before 24 October 1945. In terms of the UN Treaty, Resolution 1514 protects British interests as Great Britain exercised sovereignty on the Falkland Islands/Malvinas at its inception & 1514 protects Britain from the self-determination of the Islanders if it would disrupt British territorial integrity & national unity

    Only the existence of a sovereignty dispute was noted in resolution 2065 & both Argentine & British governments were invited to find a peaceful solution by the UN General Assembly; Argentina chose war in 1982 & resolutions 1514/2065 have remained unresolved because of this

    One might think it would be sensible in reply to the Argentine open letter to point out that Britain and Argentina did actually start peaceful negotiations on solving the problem of Argentina's sovereignty dispute in compliance with UN GA resolutions, but these negotiations were terminated by Argentina (not Britain) in 1982, principally because Argentina refused to abide by the requirements of resolution 2065 to bear in mind:

    1. the provisions and objectives of the Charter of the United Nations
    2. General Assembly resolution 1514 (XV)
    3. the interests of the population of the Falkland Islands (Malvinas);

    Argentina then chose to initiate hostilities through its illegal invasion and occupation of the Falkland Islands/Malvinas instead of peaceful negotiation to resolve its sovereignty dispute with Britain in direct breach of the UN Charter and its Treaty obligations to maintain international peace and security. Furthermore then Argentina reinforced its invasion force in direct breach of the binding UN Security Council Resolution 502 which demanded an immediate cessation of hostilities and an immediate withdraw of Argentine armed forces from the Falkland Islands/Malvinas.

    As a result of these Argentine hostile actions, Britain invoked its UN Charter right to self-defense from Argentine military aggression under Article 51 of the UN Treaty and subsequently defeated the Argentine invasion force to regain British sovereignty over the Falkland Islands/Malvinas under the international law following the prevailing principle of Uti Possidetis, that the Falkland Islands territories & properties remained with Britain at the end of the conflict because they were the victor and there was no other agreed peace treaty provisions

    Argentina instigated hostilities & is guilty of the failure of peaceful negotiations in accordance with the UN resolutions

    The reason the Falkland Islanders refuse further negotiation with Argentina is because of the injury done to them by Argentina

    1-Argentina spends billions of dollars in useless organisations like IMF and WB that cost to the country more than 4 billion dollars. Also is member of hundred of useless institutions good for nothing like OAS puppets of US agenda.

    She has primed world interest in the outcomes of the forthcoming Falkland Islands Referendum.

    Thinking about it, some people have brought up a very viable point concerning the C24.

    The point being, who put them on the decolonisation list and how do they get themselfs off it if they want to?

    I believe I have read on hear, that some territories have approached the UN with a view to be removed and have been blocked or refused.

    Perhaps some further Referenda need organising. I am of course assuming that if a territory votes in favour of the question, “Should they be removed from the list” then the UN will listen and grant their request.

    After all, the UN is supposed to be a democratic body.

    Then again, am I being nieve?

A look at the historical record of the Islands reveals that the history of the Islands goes back hundreds of years before that date. Falkland Sound was named by Captain John Strong in the Welfare in 1690. East Falkland was first colonized by the French in 1764. In fact the Argentine name Las Malvinas is the hispanisation of the French name Les Malouines. (So it’s not even a Spanish name!)The French colony on East Falkland upset the Spaniards because they believed that they owned all of South America (except for the parts occupied by the Portuguese) and the French were persuaded to withdraw their administration in return for a large sum of money and a Spanish governor took over.
    A British colony was established at Port Egmont in West Falkland in 1766. On June 10, 1770 a Spanish force expelled the British settlers and occupied Port Egmont. This incident brought Britain, France and Spain close to war and, after a diplomatic battle, Spain agreed to restore Port Egmont to the British and it was formally handed back to Britain on September 16, 1771.
    The British naval garrison was withdrawn from the Islands in 1774; however the British claim to the Islands endured. Both countries proclaimed their rights over the rest of the territory.
    The Spanish garrison was withdrawn from the Falklands in 1811 and the islands were left uninhabited for many years, although they were visited at will by vessels of many nationalities. Spain took no further interest in the Islands.
    In 1828 the Government of the United Provinces of La Plata granted Louis Vernet a grant of full sovereignty over East Falkland. Britain immediately protested this move and made it clear to the Argentines that they had always contested the Spanish claim to sovereignty and that they were not prepared to permit Argentina to exercise a right from Spain which Britain had denied to

They are the original inhabitants of the Islands and they are entitled to benefit from the principle of self determination which is enshrined within international laws. The referendum to be held this year is likely to, once again, affirm that they want no truck with Argentina.
    In their desperation to mount a cogent case for sovereignty, the Argentine government has side stepped the self determination issue by simply stating that the wishes of the Islanders do not count, that there are no Falkland Islanders. This attitude defies reality and is unlikely to find much sympathy amoung proper democracies. Even the most ardent Argentine apologists will have trouble ignoring the self determination issue.
    If Argentina was to get its way over the Falklands, what will become of the Islanders? They are descendants of the original inhabitants and since Argentina believes that they don’t exist, their chances will be less than average. This type of thinking strongly resembles that of the Nazi regime towards smaller weaker neighbours and minority groups during WW 2. They may think that they have international support on this issue but, when put to the test that will turn out to be another delusion.
    By its words and actions, the current government of Argentina Is making the country look like a pariah state. It is up to the good people in Argentina to bring their government to book on this matter and get some common sense and humanity back into its policies on the Falklands.

    The biggest ommission in all of the Argentine Government claims to our land is that they made a deliberate choice to try and get the islands prior to that they weer so wrapped up with killing the native people the Falklands did not even come into their thinking untill the French made the mistake of selling something that actually did not belong to them either. Had this not happened we would not be in the situation we are in today because CFK and all of her under educated people think that spain gave them the Islands in their agreement of independance. Maybe it is time that someoone in that mixed up land called Argentina produced the hard Historic facts stating Spain gave the Falkland Islands. I doubt very much if a true document exists but would not surprise me to see them fake one. Also prior to the French settling at Port Louis. the British several years earlier had made it know that it was claimed for the King of England. History shows that all great nations were claimed in the exact same way. Differance here is that Argentina a young know it all thinks they can actually take any thing they want including chillean territory. So is it any wonder the world does not trust them. How many more bloody noses will they have before they finally admit they are wrong.

    When the treaty of recognition was drawn up between Spain and the new nation, Britain was mediator, so it would have been very unlikely that it would have allowed any transfer of rights or anything that could be interpretd as a challenge to British sovereignity in the islands.

    The one good thing that spun off the Huemul Project is that the Balseiro Institute was located in San Carlos de Bariloche in what is now Río Negro Province. Río Negro had an exceptionally sensible Minister of Technology a few years ago, who put up money and land for the creation of INVAP, an offshoot of the Balseiro Institute, which is a high-tech company making nuckear reactors, satelites, etc.

    So in a way one could say that the Proyecto Huemul was a success in a sort of second (or third) hand way!!!!!!!!

    Was it really nescessary to kill the indigenous people to get the land. It is clear to the Islanders why they did. Just to control the whole of the Eastern South Atlantic region and the Falklands is the only land left to complete their control and they know it.
    Even Chile has a terrible time trying to work with the Islanders because Argentina stole Terra Del Feuga from them to ensure they had such control over them as well.
    The Falklands our not up for grabs and it hurts them like hell because they thought these little Islands would be a push over but we have a very loyal British people that will defend our rights to determine our own future.
