In a long statement recalling the 181st anniversary of the 'usurpation of our Malvinas, South Georgia, South Sandwich Islands and the adjoining maritime spaces' (almost three million square kilometers) the Argentine Foreign ministry contrasts Buenos Aires peaceful, dialogue attitude with the verbal aggressiveness from British officials when referring to the Malvinas issue. You know you're desperate when you start quoting newspapers and making stuff up about the UK ignoring resolutions whilst the head of the UN states very clearly the UK is not in breach of a single resolution.

    And if that isn't bad enough the only resolution broken in the past 50 years was the one the Argentine's broke with the illegal invasion.

    Spain on the other hand, with their illegal fishing and Garda incursions, firing upon Gib. civilians, and illegal border hold ups, that is provocation UK needs to respond to.

    I can see why they don't, though. With Spain in crisis, it would be a great national unifying issue were a foreign power to retaliate to Spain by military force.

    Perhaps the UK should start supporting the Catalonians at the UN, in their fight for a Referendum and Self Determination.

    The Arana Southern Treaty, ratified in 1850 by Argentina and the UK, clearly settled the matter of the Falklands/Malvinas once and for all. In this treaty Argentina tacitly recognised British sovereignty over the archipelago.

    The biggest laugh of all is that Argentina simply does not know when they are acting like a complete prat.

    CFK prattled on at the G20 meeting in Russia for nearly an hour on Argentina progresses in democracy, not even noticing that no-one else was listening and they were busily using their I-Pads to keep themselves amused. After that complete waste of time, I don't believe there is any doubt amongst the other leaders that Argentina has to be removed from the G20 - not only because they have failed financially to meet the criteria for being a member - but primarily because they elect complete imbeciles to be their leaders.

    As the others have pointed out, there is no doubt that the ICJ would rule in favour of the Islanders...

    So Argentina must be a country of cowards if they refuse to take the dispute to the ICJ.

    The UN principle and concept of Territorial Integrity & National Unity & disruption applies the the borders of member states and overseas territories as extant on 24th October 1945 when the UN Treaty came into force; many of these member states possess overseas territories and the treaty applies equally to these in terms of sovereign territorial integrity

    Applying the principle of Territorial Integrity to the Question of the Falkland Islands would refer to the succession of the Falklands Islands from British sovereignty & its effect on British territorial integrity and British national unity

    The fact is Argentine has never possessed any right of territorial integrity and the pretensions of the Republic of Argentina regarding the British territories of Falkland Islands, South Sandwich Islands, South Georgia, the South Orkneys, South Shetlands, Graham Land and Coats Land

    Argentina's encroachments and pretended acts of sovereignty in or relative to any of those territories are, under international law, illegal and invalid and always have been

    The fact is the only country with territorial integrity and national unity rights regarding the Falkland Islands and its one-time dependencies is Great Britain

    Indeed, the UN and its members explicitly upheld British de facto and de jure territorial integrity on the Question of the Falkland Islands, when the UN Security Council issued Resolution 502 determined that there existed a breach of the peace in the region of the Falkland Islands and demanded an an immediate withdrawal of all Argentine forces from the Falkland Islands

    You possess a somewhat odd attitude towards immigrant populations over indigenous people when your own Argentinian country is a nation of immigrants who exterminated the indigenous people. You yourself must be from European stock.

    You appear also ignorant of the fact that recent arrivals to a country are frequent amongst the most patriotic of people. Many (not all of course) immigrants and their families from Pakistan, Poland and elsewhere, who have settled in Britain, are immensely loyal towards their new country. They are best able to appreciate Britain’s traditions of liberty, freedom and parliamentary democracy in comparison to the sadder experience of their own countries.

    A good example would be Somalian born but now British Olympic gold medal winner Mo Farah, who is famously loyal and patriotic towards the country which has offered him a welcome, and freedom and opportunities unavailable in the country of his birth.

    Hector Timermans father; Jacob Timerman must be turning in his grave at his sons hysterical antics. Is this any way for a country’s Foreign minister to behave? Some of his claims are blatant lies. There was no usurpation in 1833. The islands of South Georgia and the South Shetlands have been British since the 1770’s. Its absurd for Argentina to falsely claim they were stolen from Argentina.

    Jacobo was a man of honour, dignity and immensely brave. He was a journalist of the highest traditions who possessed enormous respect for Britain and its institutions like the BBC.

    His son however brings nothing but shame and ridicule upon himself, family name and country.

    The facts about the “discovery” of the islands are largely ignored by the Argentine, either due to convenient nationalism or to plain ignorance. However, that the British and the French, and even the Portuguese had 'sighted' the islands in the late 16th century is a well known, historical fact. While seamen and seal hunters of various nationalities used the islands as a safeport during this period and later, it was probably the Brits who made their presence on the islands more than just a vague claim, and named the islands after Lord Falkland. Then the Brits were ousted by the Spaniards who, if not mistaken, ceded the islands to the French as a war settlement...thus the name Malvines....then the Brits took the islands back. Through all this, at no point did the 'then' provinces which are Argentine 'today', actively participate militarily in securing the islands for themselves, other than an attempt in the early 19th century (shortly after gaining independence from Spain), to establish a colony, which did not succeed. In 1832 the Brits decided it was time to take the islands back and that's how it's remained until today, 181 years later. The fact that the “kelpers” recently chose to remain under British rule, and not that of Argentina, simply demonstrates their good sense....and the reason why Argentine presidents , every now and again, rear their ugly heads and claim that the islands belong to Argentina, and try to force the issue through diplomatic channels, is because first, they know they'd get their asses whipped if they tried any other way, and two, to distract the Argentine population from the utter chaos they have created internally.     The piece does its best to garner together all the nationalistic elements seen in the recent past under the malignant banner that is Roca. Everything is there:

    Vaca Muerta
    Anti USA feelings
    Bravado about Chile
    Rabid sentiments against the indigenous Indians who suffered under Roca though this is very much downplayed
    And of course Roca’s defeat was not at the hands of the indigenous Indians but by the dastardly Indians from Chile and it was they that did it for the “Tehuelches” aka Mapuche, so Roca was a good guy after all.

    But for me the sting is in the tail! If things had been left at the Black River whole areas that were “ownerless” were now (and to some of the claim, always had been) Argentine. Miraculous event, I am surprised that it is not Saint Roca. :o)

    The argies could even, as a result of this “new” occupation (that kills the claim it was always Argentine) also claim Antarctic territory AND the islands in the South Atlantic.

    The funniest thing of all is that back when Argentina declared independence from Spain, they actually asked to JOIN Great Britain.

    They wanted the British to station troops and ships in their country, to protect them from Spain. To stop Spain trying to recover their empire. Only Britain already had Spain as an ally in the war against Napoleon, so they could not do anything that upset their new Spanish friends.

    The United Provinces actually wanted to join the British Empire. They honestly believed that their rights would be better served within the British Empire, as protection against their old masters.

    Not surprising really. They had masses of trade with Great Britain. Lots of British merchants lived in the United Provinces and they were very wealthy people. The United Provinces saw it as a way of getting rich quick. They probably reasoned that the British would forget the Baring debt, build even more trade and expand the country.

    In some ways, I suspect that a lot of the Argentine hostility comes from this 'unrequited love'. That the Argentines still admire Britain more than they do Spain, but would be embarrassed to admit this.

    In truth, the Argentines admired the British Empire, admired the fact that Britain was the strongest nation and wanted to be a part of the Empire family.

    There are many nations that would love to join the Commonwealth. I suspect that the United States would like to be a part of it too, but they can never throw off the fact that they split away in 1776. Sure the Americans make out that they hated the Red Coats and the 'tyrannical government' of King George. But in truth, all the Americans wanted was recognition and a say in the way the Empire was run. Like a child asserting their individuality, they had to 'leave home' to become independent.

    So Argentina still regrets that they never joined the Empire, because if they had, then the Falklands might have been protected BY them, but still be independent OF them.

    Every time i try to debate about this case in this foum, i otfen find some people, including some of our misserable sepoys, who accuse us of believing false arguments since we are children, indoctrinated by our official history. I must recognize that i feel really ashamed when i read that kind of comments, because they are too pathetic.
    It's not new in absolut the fact that both countries tell just what is convenient for them before international scenarios. The malvinas case, is a very complicated cause, which has strong and weak aspects for both countries, in fact, i have discussed in this forum a lot about the historic aspects of this conflict, beside, i agree on a proposal of dialogue between both nations, including with the lawmakers from the islands, but what really annoys me, is their hypocritical complaint, in relation to the lack of dialogue with arg., i say it's hypocritcal because every time they ask for a dialogue, they manifest that they are disposed to talk about different issues, but not about the sovereignty, which is the main problem, so, they dont want a dialogue, what they want is argentina's submission.
    C. f. k. was very clear when she read before the u. n., in june of 2012, the secret proposal of 1974 discussed between both nations, which was based on a shared sovereignty, this fact destroys the distorted interpretation that the lawmakers from the islands always do, about argentina's posture.
    In my opinion, i think that the only one way to finish with this humbled situation for arg., is to take the case to the arbitration, as it was suggested by arg. in 1884 and 1888, but rejected by the u. k., or as it was manifested by britain in 1947, in relation to the case of the dependencies from the islands.
    After that year, neather arg., nor the u. k. proposed again to take the question to the arbitration, perhaps both aren't sure of getting a positive result, if the cause is discussed at the court.

The terrible treatment the innocent and naive (and basically illiterate) conscripts, from the northern provinces of Chaco and Corrientes, got from their superiors. Staking out in the freezing rain for example!!! On their trip back to the mainland the officers were made to scrub the decks whilst the conscripts got first class treatment. On reaching the mainland they were confined to barracks for a brain washing for two weeks so they would never repeat what happened to them. Doubtful the islanders will forget this either!!!

    The policy raised by CFK was never official government policy. This was a discussion document produced by civil servants and diplomats. This would almost certainly have been rejected by the islanders. In 1965 the then Labour Foreign Secretary of State; Micheal Stewart made it absolutely clear in a statement to parliament that in any negotiation with Argentina the wishes of the islanders would be paramunt. This has remained government policy ever since.

    The gvernment has made it clear also that the UK government has no doubts about British sovereignty over the islands. Therefore there can and will be no discussion over sovereignty until the islanders wish it.

    the UK government spent 17 years in discussion with Argentina mainly because it was believed that by talking with Argentina there would be no invasion. Talking was believed to be cheaper than keeping sufficient armed forces in the area to deter any invasion attempt. This policy clearly failed.

    The UK is therefore forced to defend the islands .

    Given that Argentina sees talks as simply a discussion on how Britain will hand the islands over to Argentina, what is the point of any negotiations?

    You try and portray that you have studied the Falklands case deeper than anyone else, and that you can “lecture” your findings as fact...the summary of your “lecture” is that “both sides have weak and strong aspects”.

    Your “in-depth analysis” is fundamentally flawed, and that continuing to repeat it just makes you look ridiculous.

    The world has moved on since 1833, when, as per historical facts on both sides...58 people were evicted from the Falklands. All of those (54) forced to leave (without a shot being fired) had been on the islands for 6 weeks and had already mutineed, murdered and raped.

    That is the extent of the “Argentine claim”. Fundamentally weak.

    The Falkland islanders claim based on 180 years of unbroken habitation, the UN Charter and numerous UN resolution showing that their interests are paramount is fundamentally strong. THERE IS NO BRITISH CLAIM.

    However, as you identify in 1974, the was a (NON SECRET) proposal put to the islanders around shared sovereignty.

    THIS WAS REJECTED BY THE ISLANDERS AS TO NOT BEING IN THEIR INTEREST.

    So Britain proved beyond any reasonable doubt that it met the UN resolutions to have dialogue with Argentina to satisfy Argentinas claim, and that the interests of the islanders were paramount AND that the UN Charter that all people have the right to self determination was respected.

    You view that this somehow considered Argentinas mythical 1833 claim valid is ludicrous. Britain actively pursued a decolonization of 1/3 the surface of the world, and 1/4 the population. Wherever possible self-determination was paramount and near all are thriving democracies.

    Britain negotiated with Argentina despite their ludicrous claims...not because of them...simply Because Britain no more wants a territory in the South Atlantic than anywhere else.

    However, because the islanders wish to remain British, so it will stay. Until they chose otherwise. in 180 years Argentina has convinced one islander (Betts), 1500 to go.

    No, I didn't. I can remember reading “Storming the Falklands” by an ex member of 2 Para who took part in the Falklands war. In this book ( which is well worth a read, if you can get hold of it ) he describes his homecoming and lack of understanding and help that he received regarding the PTSD he suffered.

    He also goes on a journey to Buenos Aires to return a Trumpet he took from an Argentine POW. There, talking to the man, he is told about the harshness of their own officers toward the young conscripts.

    He also quotes from a book by Edgardo Esteban perhaps you have heard of it? read it? Edgardo describes how, as conscripts, they were bullied by their own officers, humiliated in front of their own men and then shunned by their families / country when they returned. I would like to read that one as well but I do not think it is available in English.

    Hindsight is a wonderful thing and the Junta, should have known better. They all should have know better.

The best book on that war is probably the one written by Max Hastings whose son, Harry is living here and running tourism of the country for foreigners. He doesn't mention the harsh treatment meted out to the conscripts. I have spoken to some so I have heard it first hand and we have one conscript from our own community who has spoken openly about it.

    Quite a number of veterans, especially the ones flying the Harriers, have come back and met their counterparts and become friends.

    Suicides amongst the conscripts has been very high and it is calculated that more have died from suicide than in the fighting on the islands.

    The ex-member of 2 Para should have gone to The Royal British Legion and they would have made sure he was treated for his PTSD. This is probably the largest charity organization in the UK and they handle all these issues not only for the vets but for their families as well.

    If after all these objetive facts, you prefer insisting on defending self determination for the islanders, you have right to do it, but reality is much more different than the usuall mischievous lectures of many of you.
    Respecting the offers of arbitration, the u. k. just offered to submit the cases of the dependencies of the islands to an arbitration, but never the malvinas.
    If the sovereignty of the islands would be shared by both countries, neather arg. would be submitted to the will of the u. k., nor viceversa, actualy it would be a fair solution because it would respect the wish of the islanders of remaining under british government, and argentina's sovereign rights.
    You all know perfectly that if the u. k. didn't have right to veto at the u. n., it would never be able to do what it has always done with this cause.
    On the other hand, the historic aspects of this conflict, are much more complicated than tipicall too partial analysis of many of you, i have explained them in planty of opportunities.

    Tony Banks actually received help from a charity called “Combat Stress” in the end. He tells us that :-

    “Estimates of the total number of veteran suicides vary. But it is likely that around 500 Argentinians and 300 British ex servicemen have taken their own lives since 1982. Those figures do not include those who have died of drink, drugs or poverty related problems. It is dreadful to think that after all these years - three decades - men from both sides are still suffering and dying as a direct result of the conflict”

    Edgardo Esteban again :- “The main problem stems from the fact that the Argentine Army never acknowledged its errors and blamed the conscripts for the defeat. Argentinian society, whcih originally supported the invasion, abandoned us and linked us to the military dicatorship. When the conflict ended , there was no help.”

    So there you are Tim, there is still much suffering, even in victory. My only hope is that for the Argetinians who fought, get the juctice that they so far have never had. And here in the UK, we better understand and encourage the troops to stand up and say “I have a problem” otherwise, there will be lots and lots more suffering from the veterans of Iraq and Afghanistan.

    They are not yours.
    You have never possessed them.
    No Argies have any history of living there as a culture.
    Nobody wants you there

    and there is no reason for them to speak to you about giving you either full or partial control over the Islands that are their homes and livelihood, owned 100% by them, which they are free to do with 100% as they please, simply because you feel they should be yours.

    However, I don't know why you are asking us or the UK.
    You really should ask a Falkland Islander.

    It is clear you understand very little !there was absolutely no good reason for the invasion ( just Argentine stupidity and brinkmanship) and I support open talks with no preconceived ideas to what the out come will be, as for decolonisation only the people who are colonised have the right to determine what political status they wish to be, neither the UK or Argentina are the colonised. “to resume the negotiations and find a peaceful solution.” Yes it does but you missed the important part “taken into account the wishes of the islanders which is ”paramount” do you understand what the word means? it means the islanders interest are more important than Argentina`s or the UK interests in this case. the UN recognises the UK as the legitimate authority over the islands, all it requires is for Argentina to go to court and prove it is the legitimate authority, you don`t need the UK there you have all the evidence the UN will declare the British presence on the islands illegal and talks on sovereignty can start the following week, there is a world map in the Vatican its dated around the early 1700s it show`s the islands and named as the Falkland's Islands were internationally known then and this was 120 years before the state of Argentina existed 70 years before Spain was given the French settlement on the Falkland Islands. Self determination is a core principle of the UN and people who believe in it will certainly stand by it and Argentina signed it when the joined in 1945, it is now for them to persuade the UN why its not legal in relation to the islands and have it redefined to accommodate Argentina`s ambition. No UN official has stated the Falkland islanders have no right to self determination, they have said the wishes of the islanders are paramount, The UN will not support a change in the status of the islands without the islanders agreement to it.

    Edgardo is correct, the veterans from here have been totally ignored by society in spite of their camping out in Plaza de Mayo in front of the “Pink House”. For the army to blame the conscripts for loosing the battle is a case of a poor workman blaming his tools.

    I have never justified the invasion of 1982, in fact, many people in this forum know perfectly what i think about it.
    In relation to self det., i just recommend you to have a look to all the u. n.'s resolutions, and you'll see that it was applied for different colonial situations, but never for this cause. In fact, i recommend you also to read the statements of all the lawmakers from the islands before the u. n., especially norma edward's of june 24th of 2010, where she complains about the fact that this cause has always been considered like a special case at the decolonization committee, you can find her statement in the news archive of this website. On the other hand, haven't you wondered yet why even after the result of the referendum, nothing has changed at the u. n., in refference to this cause?, i have, and maybe you all should do the same.
    In relation to the idea of submitting the case to an arbitration, you all already know what i think about it, in fact, read my comment 197 again. In my opinion i think that you all should take into account the objetive facts that i mention in that comment, about the idea of an arbitration, if you want to make a serious analysis of this conflict.
    Respecting the historic arguments of arg., they are too long to explain them here, but i'll just tell you that after having investigated for 4 years, i have the conclusion that both countries have rights over the islands in 1833 (discovery and papal bulls are very weak arguments).
    In the case of the u. k., it's rights were based on a secret article included in the nootka sound convention of 1790, and in the case of arg., it's rights were derived of the sucession of states, that's why, the u. k. should have negotiated a peaceful solution with arg., or maybe share the sovereignty of the islands, instead of depriving our country as it did in 1833, there is much more to say about this conflict.

    Tell me, do you research and gather evidence systematically, and try to compare conflicting evidence from different sources to come to an objective conclusion?
    Do you then compile a Bibliography and a list of links so that readers and investigators following you can understand your reasoning and confirm your findings?

    Wouldn't an Investigator and an Academic like yourself, do that??

    Or do you prefer to portray yourself as an ”Intellectual Thinker”, whatever that would be?

    the Nookta agreement was in 1790 between the UK and Spain, 30 years before the state of Argentina existed, what equal legitimate claim could the UP, Rio del Plata have 30 years later? the referendum has nothing to do with the UN other than the inhabitants have expressed their wish to remain British and that the articles of the UN Charter were honoured by the British, the decolonizing committee have not (and legally can`t) proclaim it was illegal, the day to day life continues in the islands that has the fastest expanding GDP anywhere in Latin America, Argentina`s historical claim is extremely weak. it is politically naïve of Argentines to demand talks where the outcome has to be in Argentina favour before talks begin, no one will negotiates from this position, Argentina had a golden opportunity to distance themselves from the Junta`s invasion and start afresh but your successive democratic governments proved to be no less aggressive than the Junta the results are the reality the islanders will never now accept any notion of sharing the islands with Argentina, the other option is Argentina can hope and pray the UK will turn their backs on the islands and walk away. Argentines need to learn and make friends with the islanders and in time you might be able to come to some agreement with them, alternatively you can invaded again! you know what the results will be , the only other option is the ICJ Argentina refuses to use it, it is going to be a very long time before Argentina is accepted as friend.

If there was a special case why then did your people goose-step into they ICJ to stop it?
