Kicillof: “no change of NY jurisdiction, but a change of payment location”

Argentina's new plan to skirt U.S. courts and resume payment on defaulted bonds aims to protect creditors who participated in two debt restructurings, Economy minister Axel Kicillof said on Wednesday.     Lets idscuss this like grown ups. Troll, Think etc, I'm not abusing you, just discussing this conceptually.

    1. Changing the place of payment is a change of jurisdiction as you are changing the jurisdiction of the payment. As such, the payment mechanism will be governed by Argentinean law.

    2. The actual jurisdiction of the bonds will still be NY. Once you have asked a judge to interpret a private contract such as this what he says goes. Making the payment in BA will be illegal, not just conceptually but illegal under the terms of the bonds as the bondholders and government no longer have control over the process until the court order has been complied with.

    3. This payment will be illegal and, as such, an event of default can be called by the bondholders (lets no forget that the Republic is already in default). This can allow them to accelerate. They haven’t done this as yet as they are waiting for the order to be complied with. Changing the place of payment actually affects them as they may not be able to accept this change.

    4. Any contempt order from the judge could involve those who accept the new payment jurisdiction and they are assisting in evading the court order (very similar to sanctions where if you restructure to evade sanctions you can still get caught).

    5. This could incldue, bonholders who accept payment into a US bank account, those who change payment to EURO and swap into US$, Argentinean entities who accept payments in Argentina and use those payment to find business in the US (obviously corporate veil issues will have an impact here).

    6. Lets say that Argentina actually pays off all of its creditors (except holdouts). It will still be I a state of default until those guys have got the money owed to them under the order. This will mean no external funding from external bodies (BRICS might not fund in a case of default), no US$ investment etc. Given the impact the default is starting to have (it will be slow), this could cripple the economy.

    The Government came out to clarify yesterday that the bill sent to Congress does not imply a change of juridiction for the bondholders who entered the swaps. But articles 6 and 7 of the bill suggest otherwise that it will empower the Ministry of Finance to make an exchange of bonds under local legislation and jurisdiction. The project is currently uploaded in the website of the Office of the President.

    If I were a bondholder I would be doubly hesitant when they use the would “chances” of getting paid. Accelerate the debt and fuck them.

    @11 if I was a bondholder, I would just wait it out until January, the pressure will be so great on the government by then they will be forced to settle with the holdouts, you would think. They are not in a pleasant situation but they lost, time to accept those losses and move on for the good of the nation. Unfortunately they don't take losing too well and therefore the results might be unpredictable

    Look, you seem not to understand.

    This battle with the vultures is in fact the LONGEST TERM, LONGEST TIME HORIZON, LONG-TERM THINKING, Argentina has engaged in for many many years:

    1. For 15 years Argentina has not been able to accumulate more debt with foreigners. Long term that in itself is very good.
    2. It has been able to “get away” with not paying a huge amount of old debt already, regardless of what happens with Singer et al. Very good long term.
    3. It may still get away with not paying Singer et al. Good financially, but excellent as precedent long term.
    4. This battle with the vultures needs to be taken to the bitter end now. It is too late in the game to “Change course” as all the international media are suggesting. If it destroys our economy (I doubt it), so be it. It will destroy our economy. But the stand must be made now, and not one step back given.
    Long term, this will make international investors thing VERY VERY long, before lending to Argentina. It will make it very hard for Argentine politicians to borrow, and it will completely discourage ANYONE from taking on Argentina in the future if this scenario repeats (no one will want to waste 15 years on getting 1 billion dollars...)
    5. It will make Argentina understand that 'quickie” contracts for cash backfire.
    6. It will make the crony capitalist that run EUia and NorthAmoland that their criminality and corruption will have its consequences (since Europe and North America has washed its hand of punishing the banks even as they caused a huge economic crisis in their own countries).

    All in all, long, long term this is completely healthy and phenomenal. I would call it in fact a purification.

    When you had hyperinflation last time you were self sufficient with oil/gas, you were even an exporter. Your farmers also had a somewhat balanced crop to prioritize internal consumption.
    None of that is true now.
    Soy and Corn will be unprofitable next year.
    I think you even imported wheat last year
    You now import U$1b of food products
    BCRA is out of cash
    Peso is rapidly failing
    More pesos to buy, gas, seed, fertilizer...etc etc etc
    At some point it all collapses

    He his irritating but also to be pitied. I used to think he was a wind-up merchant but he has been here too long for that.

    Imagine being that filled with self-loathing and hopelessness that the only pleasure he garners is the idea that somewhere, anywhere, must be worse. He has no friends, can't have a relationship (he hates all women including - or maybe especially - his own mother), can't get a decent job, and is trapped in a deteriorating society. (Or as Chicureo suggests, maybe he is not in Argentina at all).

    We should feel pity for TTT. It doesn't hurt to converse with him as we are all he has but I doubt any of us take anything he says seriously or have any respect for him. That probably hurts him more than he will ever admit.

    No, but in the end, there will only most likely be a stern warning issued today and even if sanctions were to be issued, the U S state department would do nothing. Obama apparently prefers golf above all else.

    Meanwhile, car sales down and consumers are buying less. There's a glut of corn in worlds markets and plenty of wheat. Argentina needs to focus again on soy.
    Even Chile is feeling a slowdown right now. New Russian sales opportunities opportunities will be limited as the sanctions will be over within 3months.

    It's going to get a lot worse before it will start getting better in the Argentina.

    Argentina is easily self sufficient in food production. The problem of course is for farm profits to be sufficient for farmers to risk planting as well as encourage excess production for the all important export market. With the exception of Soy beans, farmers are not completely convinced. Argentina long ago lost its position in the beef export market and there are several crops that growers are actually just breaking even on. The famed wine producing areas in Mendoza are very concerned.

    Here's a tip. In some places the words “street” and “avenue” are interchangeable. For example, the avenues are north/south running , and the streets run east/west on a grid. Makes it simple to tell from an address which way the street runs in that particular town, but there is essentially no difference. If we are talking about Spanish, I would naturally look for “calle” initially in the address. I was right of course. Please keep trying to deflect, it just makes you look even more desperate. ;)

    So what if someone comes from a lower class back groun? so what if someone may or may not be? Lets say if yankee was an estate agent (im not clain=ming he is) he has still predicted alot of things on here that have either happened or something similar has happened. He has been correct in the way the Argentine case unrolled in the US courts and on other things as well. Personally I dont care if he is an estate agent. I dont care on about the level of education he has recieved. Voice says he hashad a good education and I dont doubt this. It doesnt stop him from coming off as a twat.

    Do you believe that YB hates Argentines and their Country just because he used to live there....there is more to it than that, also if he's in DC, he won't want to let you know as he know's you probably visit and would suggest a meet.....

    ....did you pay your property tax early and save 2% or are you paying face...? On or before the 31st of this month was my deadline for discount....
    What a laugh though only 2% discount for early yet 10% penalty if you pay late after Oct 31st....
    Or is it different in Boston....? Is property tax spilt into two parts like I have... County and School district...?

    I never said Boston proper.....and each and every district has it's own method. Most are twice a year.....November and May.....just before fiscal year end. There is more than one location in Massachusetts, one in CT and some in Argentina via marriage.

    I think he hates Argentine's because there are a vast amount of them that are the way he speaks. Perhaps it's the way I choose my friends and acquaintances that any I know are not like that nor peronists.

    Yes I did ask think and I am not convinced that is he in the least.
