@1. Four UN ICJ Advisory Opinions, one UN ICJ judgment, 2 UN Covenants all state or confirm that 'the right to self-determination is applicable to ALL non-self-governing territories. The 1995 East Timor judgment stated that the right to self-determination has an erga omnes character, this means that it is to be respected by ALL states. The vote taken in the UN General Assembly on 17 October 2008 that rejected a motion sponsored by Argentina and Spain to have restrictions placed on the right to self-determination where there was a sovereignty dispute confirmed that the fight was an inalienable human right. The 2010 Kosovo ICJ judgment confirmed (para 80) that 'the scope for territorial integrity was limited to the relationship between individual states and did not impinge on the right to self-determination.' To 'implicate' that Gibraltarians or Falkland Islanders do not have the right to self-determination is pure fantasy.

Gibraltar has been slowly increasing its international profile especially over the past several years. They don't need anything to happen now but slowly over the next decade or two the momentum and profile will become unassailable by Spain.
Then Spain can look back and asked where they went wrong just like Argentina does now.
Gibraltar has a plan while Spain just reacts.

Gibraltar and the rights of the people there, are now in the public consciousness of the U.S.
US News agencies can now report on homegrown opinions of the legal status of Gibraltar, from their own politicians.
There is likely to be more cooperation from the U.S. as an ally, as they need their most trusted friends, UK, Canada, Australia, etc., to rally alongside them.
Perhaps Gibraltar will be used as a reliable military staging centre?
Spain's concerns by comparison, look a bit inconsequential at the moment.

Given the George Washington quote it is difficult for me to see how the interests of the US are served by having any opinion on the status of Gibraltar.
