If a judge is biased or prejudiced for or against a party or attorney, he cannot be fair and impartial in deciding the case. A party or attorney who believes such bias or prejudice exists must prove it with admissible evidence, ... bias or prejudice typically means the judge has acted or spoken in a way that prevents him or her from treating the party or attorney in a fair and impartial manner. https://www.lawyers.com/legal-info/research/well-recuse-me-when-a-judge-shouldnt-try-a-case.html

New Lava-Jato Leak: While Mocking Lula's Testimony, Moro was Instructing the Prosecution
President Lula gained new queries with further leaks reported by The Intercept Brasil, on Friday night, June 14th.
My Legal-Knowledge is less than zero but normally in any court trial, the defending advocate argues against a public prosecutor and a judge just decides who is right or wrong after hearing the arguments, witnesses and after studying the proofs presented by both the advocates. Whereas in this case, the judge directly interviews the accused. I wonder if this was NORMAL!
@:o))
” Whereas in this case, the judge directly interviews the accused. I wonder if this was “NORMAL”!
IF it weren't normal procedure (in Brazil), do you think it would have been (so flagrantly) used in ALL cases, or that the lawyers of all the defendants would have allowed it / not complained ? No one complained because the procedure is correct.
But let's go into more detail : It is not the judge's role to look for evidence /proof ; along with the prosecutors, he simply questions those who opt for plea-bargains, which in turn might offer / furnish clues for the prosecutors to follow up on ; if the clues turn up evidence, it'll be examined, and when/if they feel they have a solid case, the prosecution present its findings to the judge, who can accept, or reject the accusations. If he accepts them, he will then question the defendant, based on the evidence presented by the prosecutors, and after listening to both sides - defense as well - he will decide, based on the evidence and on the 'law' (not personal likes /dislikes), whether any crimes were committed, and if the evidence is sufficient to convict or not...if convicted, each crime carries its own sentence, the sum of which will reflect the total jail time.
Appeals go to the 2nd lower court, that re-examines the evidence 'n can either confirm the conviction, or overturn it, 'n even modify the sentence. In the next two (high) courts, STJ, STF, the proof is no longer examined, they should only rule on HC's based on whether legal procedure was followed correctly.
Have any of Greenwald's /Intercept's leaks been authenticated ? NO. Have any of the accusations been proved ? NO.
So, just more left-wing whining 'n fake news to throw shit in the fan, which they cannot prove - nor intend to, because they can't - but if it contributes to undermining the vote on the pension reform, and creates unfounded doubts regarding Lula's conviction, that is what matters. The left's tactics are painfully clear.
Jack Bauer aka Proof-less and Truth-less
Have any of Greenwald's /Intercept's leaks been authenticated. Apparently sufficiently to satisfy his publishing partners. Which of course will verify the defence's contention that it is part of a larger conspiracy initiated by the US.
REF: No one complained because the procedure is correct
While I don't support/promote ANY Corrupt, Brazil specializes in facilitating the cooks + buying politicians is common! Since that happens as a normal practice, anything can go! Do you really believe that the judges are totally immune to being bought/sold? Once that happens, any law can be interpreted as ordered by a payee!
REF: based on the evidence ...............................................................the total jail time:
At least THAT hasn't happened so far wrt The Leaks + Hacking! The Involved Politicians are defensive instead of arresting the criminals! Is that a normal practice too?

But to you Gollum, that is unimportant, isn't it, slimy head ?
Jack Bauer aka Proof-less and Truth-less
Have any of Greenwald's /Intercept's leaks been authenticated”
He's addressing the Congress right now on the issue, as we have their stream on. While the Supreme Court is rehearing a petition of habeas corpus right now.
What is much more important: is the fact, the truth + the supporting concrete proofs.
Of course, the Culprits+Corrupt can lean heavily on the legality, laws + justifications/interpretation of the laws + verdict; to find a convenient escape route - OBVIOUSLY!
Jack Bauer aka Proof-less and Truth-less
I fully predicted it, just confirms how far the taint of corruption permeates the legal system.
Those messages raise serious doubts about Moro's impartiality as he presided over Lula's trial. The messages showed him coaching prosecutors on the timing of raids and arrests, asking them to publish press releases to criticize Lula's defense and sending investigative tips while he was legally obliged to remain impartial.
Moro at first said the leaked messages showed no wrongdoing. As The Intercept published more stories, he changed tactics to say he could not verify if the notes were authentic and that he could not recall whether he had sent them. Pleading the fifth.
Not to worry Moro will deliver the answer after another of his many secret trips to the US.
Gollum, the slimy basement dweller
You fully predicted it ? LOl, LOL.....But I thgought you were an ardent defender of correct legal procedure....... yet you believe Moro should be locked away for a very long time, based on the PT's allegation that in 2017, when Lula was convicted (for the first time), by Moro), that Moro knew that one and a half years later he would become Justice Minister (at the time he didn't even know Bolsonaro) and, that all the unauthenticated crap produced by the Intercept, proves anything but its criminal intention to accuse without proof....what proof is there of wrongdoing ? ZERO...even you Gollum, should know that.
What a contraDICKtory little slime ball you are.....
Jack Bauer aka Proof-less and Truth-less
”I thgought(sic) you were an ardent defender of correct legal procedure.
I am, when they are.
What a contra...
If I wanted shit out of you I'd squeeze your head.
@:o))
Do you really believe that the judges are totally immune to being bought/sold?
Of course not....look at Lewandowski and Gilmar Mendes in the STF....not to mention Toffoli...and then, Rogerio Favreto (a rabid 'petista' and a very close friend of Lula's), who in July 2018 actually signed Lula's release, when he was only the reserve judge in the TRF-4.....there's big money exchanging hands.
Once that happens, any law can be interpreted as ordered by a payee!
Not exactly....IF the law has a loophole that gives the judge leeway to decide one way or the other, yes....but not when the Law is clear and defined, not subject to interpretation.

Text approved by the commission also typifies the crime of electoral box 2 and classifies corruption as a heinous crime. Voting in the Senate floor may still be on Wednesday.
By Sara Resende, TV Globo - Brasilia
The bill aims to combat situations where the judge or prosecutor benefits himself or another person, harms someone, and by whim or personal satisfaction, directs a process.
By the text, the magistrate will incur abuse of authority if:
render judgment when prevented by law;
act with evident political motivation;
expose his opinion, by any means of communication, in the middle of the process, commanded by him or another magistrate. https://g1.globo.com/df/distrito-federal/noticia/2019/06/26/justica-do-df-autoriza-senador-em-prisao-domiciliar-a-passar-ferias-no-caribe.ghtml
REF: IF the law has a loophole that gives the judge leeway to decide one way or the other, yes
When the laws are made BY the crooks & FOR the crooks; obviously, the loopholes are left on purpose! Hence a law without ANY loophole would be rare - if not an extremely rare case. That gives plenty of room for different interpretations by different judges [awailable for a generous price?].
Don't you believe? REF: look at Lewandowski + Gilmar in the STF - not to mention Toffoli & then, Rogerio Favreto

But to you Gollum, that is unimportant, isn't it, slimy head ?

He's addressing the Congress right now on the issue, as we have their stream on. While the Supreme Court is rehearing a petition of habeas corpus right now.
What is much more important: is the fact, the truth + the supporting concrete proofs.
Jun 26th, 2019 - 02:17 pm - Link - Report abuse 0Of course, the Culprits+Corrupt can lean heavily on the legality, laws + justifications/interpretation of the laws + verdict; to find a convenient escape route - OBVIOUSLY!

Jun 26th, 2019 - 05:53 pm - Link - Report abuse 0You fully predicted it ?

Jun 27th, 2019 - 05:37 pm - Link - Report abuse 0Do you really believe that the judges are totally immune to being bought/sold?

The bill aims to combat situations where the judge or prosecutor benefits himself or another person, harms someone, and by whim or personal satisfaction, directs a process.
By the text, the magistrate will incur abuse of authority if:
render judgment when prevented by law;
act with evident political motivation;
expose his opinion, by any means of communication, in the middle of the process, commanded by him or another magistrate.
