The Falkland Islands are effectively “under a sea-blockade from Argentina” and after years of quiet diplomacy behind the scenes “we are now in a war of attrition and we need to take the war to the enemy” according to Dr Barry Elsby who on Thursday was elected to fill the vacant seat at the Falkland Islands eight member Legislative Assembly. Dec 16th, 2011 - 09:13 pm - Link - Report abuse 0Dam right its time we hit back at argentina and put them back in their place. I have a feeling the navy will be looking at diverting extra ships there to break the argentine illegal blockade. I doubt we would even need to fire a single shot either as they will probably scurry back to port and hide like they did in 1982.

Dec 17th, 2011 - 02:07 am - Link - Report abuse 0Looking at this article http://www.guardian.co.uk/commentisfree/2011/dec/14/10-years-argentina-economic-collapse - its pretty clear there will be nothing you can do. I mean think about it, 100 Pesos for a few groceries, you can just imagine how much jet fighter fuel would cost let alone the cost of ammunition. You simply can not afford any military action, and you certainly can not afford a war with the UK. Like i said earlier, as soon as we send extra ships down there you navy will sail back to port and hide, just like in 1982.
I feel sorry for the argentines that are wise to what is really happening in argentina and how things are going down hill in your country economically. Especially when its idiot indoctrinated argentines like some of the argentina commenters here that kept CFK in power, despite her economic models ruining your country financially.
Good idea. hire a world class PR firm to promote the Falklands. Argentina will try and copy. In a few months Argentina will give up as it has cost them a whole years defence budget.

2- you will never recover the islands
3 - they were never yours, so you can not recover anything.
4 - The islanders have the right to self determination, therefore argentina has no rights to the islands.
5 - You refuse to goto the ICJ, even though that is evidently your only real option, but even that is likely to fail due to the right to self determination under the UN Charter.
6 - Argentinas recent naval blockade is a breach of the UN Convention on the law of the sea
7 - The blockade is also an act of military agression and therefore deemed an act of war against the UK under internation laws.
8 - As a result of your act of war against the UK and the falkland islands, the UK and the islands would be within their rights to declare war and fire on any argentine vessel in falklands, internation and argentine waters without warning, though will likely only do so if the argentine vessel is military and acting agressively.
9 - We can apply for UN sanctions to be put in place against argentina and cease all trade and put a weapons embargo in place like after the 1982 war.
10 - The effect of such sanctions, or war, or possibly even a blockade of argentine ports would result in economic catastrophe for argentina, expecially when we push of seizure of all argentina assets and argentine company assets, which as the second largest Financial sector in the world, it will not be hard to do, not to mention blocking any trade and or trade agreements between the EU and mercosur. Now that would really piss your neighbours off and they will only have Argentina to blame..
So please stop dreaming, as the islands will never ever be argentine - Only kids dream up such delusional fantasy's, so i geuss thats make you the real kid here.
Oh and by the way, the UK's got a much better hand then argentina could ever dream off having in this dispute.

Let see some comments by the british readers:
As a Brit living in Argentina, I would say that the social model is one we could learn from. Analogies with Greece can only go so far. Argentina is massively rich in natural resources .... reputedly sufficient to support a population of 200 million, compared to its current 40 million. You can run the country badly and still be fine, which is not going to be Greece´s case.
Having said all that, I have absolutely no intention of returning to Blighty, I love it here!
growth is what any country needs and Kirchners were doing right things then. For Latin American country to reduce poverty and inequality is something worth noting
Sounds to me as if Kirchner's doing it right - in as much as one can in a situation like that.
The article doesn't mention employment figures, but I would guess that the growth rate means they're doing ok.
People are right to be angry about the eye-watering price of basic foods, but inflation is usually temporary, and when she has the economy back on an even keel, there are numerous controls to bring it under control.
It seems to me that the loudest critics are the foreign speculators and financiers who fancy they could make a killing off Argentina if it didn't have a pesky woman president who keeps putting the people first.
In 2002 Argentina stuck two fingers up at the IMF, US and EU over her debts. The country said 'Argentina will decide how and when you will be repaid the debt, but now you get nothing'.
Kirchner then worked with the trade unions to develop growth, increasing wages to stimulate demand and taking over the factories whose owners had left the country. They even invented a new currency for a while.
Since then, GDP has increased by more than 50% and the debt has been repaid.
Thats why Arge

Mrs. Isolde, I propose a little exercise ....
The British people in the UK taxpayers pay their taxes, which serve to greatly subsidize the economy of the Islands.
http://www.youtube.com/watch?v=zsQ3QI7TprA
Moreover, the FIG besides the enormous revenues from the illegal exploitation of fishing licenses get paid from islanders taxes that are ultimately used it to pay people like Graham Pascoe and Peter Pepper (fromally know people employee of FIG who wrote the famous gettingright paper )..... as well as our friend that keeps your blog Redhoyt LordTon 1955 of dubious veracity from Thainlandia.
Conclusion: You like the other ones kelpers friends, (islander1, kelperbout, M_of_I, etc.etc) consume processed information based on a salary and a payment ?
I mean......while you are with the cold wind burns your face every morning on the islands and paying their taxes for others to enjoy the beaches of Thailandia writing what you need every day ?
If the FIG wants to pay I'm sure there will be a lot of people interested in writing a document to suit your needs ..... the gettingright version 2 maybe..... but I think it is unethical.
The other option is to understand the reality, accept and find the truth in other sources and act justly if you want to be accepted as honorable community.

No-one who actually lives here needs Pascoe and Pepper, or Lordton, or anyone else to discover any 'truth' about our home. Nobody cares about any of that crap.
What do you think is going to happen? We'll all have some mystical revelation about something that happened in 1833 and give up and go away? Really?
Are we going to suddenly decide that we are part of Argentina's 'integral territory' when all other comparisons around the world tell us we are not?
Are we going to decide we have no culture and identity of our own just because you say so?
No.
Your arguments are all fallacies. They are based on the way you need things to be and not how they actually are. And since I know a lot about my home and you know practically nothing, I don't actually have to listen to anything you say.
However, if you have some 'truth' that you think will change my mind, then let's hear it. It might be your lucky day.
Meanwhile don't lecture us about acting justly. There is nothing just, or even legal about your treatment of us. And your politicians are all downright liars. There isn't anything honourable in spreading the kind of falsehoods your politicians indulge in so you can stop blithering on about the truth like you even know what that is.

Dec 18th, 2011 - 04:46 am - Link - Report abuse 0Actually i strong believe that islanders are not guilty of a great ignorance about the American continent and Latin America in general and Argentina in particular.
In fact I think the most responsible of the present ignorance of the people there is a person I respect a lot but in my opinion did not fulfill their primary task of education, Im talking of former Superintendent of Education and Headmaster of Darwin School, in the 90's, Mr John Fowler. ...in fact actually editor ofPenguin News de Stanley still in a great responsabilitie job of information and education and seem to everybody that still is not reaching the main objective......should be educate and inform with the truth to inhabitants of the islands.
Such kind of neglect in education and information is the main reason why appears vile things as graham and pascor paper, gettingright ..or FalklandNews.wordpress or blogs full of lies as Lordon, or individuals like JustinKuntz trying to writing BS in wikipedia all the time or the silence and sinester David Barrow from so far away injecting lies.

And no, they don't learn about 1982 (or 1833) in school. However, this year the younger children are going to be gathering first hand accounts of the conflict from family members in the run up to the 30th Anniversary of liberation.

@76 It`s the own benefit of Argentina what`s in question, given the fact that part of its territory was usurped by a (declining) great power. Precisely because Argentina finds it unacceptable to let great powers push small countries, usurp their territories and exploit its resourses it´s that Argentina will fight forever for territorial integrity.

It isn't the content that's crap. I have no way of knowing if it is or not. The 'crap' element is the credence it gives to the idea of finding a solution in the events of 1833. The Argentines pin their hopes on it and the more we talk about it the more it encourages them. You can tell that from the inane wittereing of the above poster; he thinks that if he can prove you wrong they will get the Falklands as a prize. Pitiful.

The involuntary/forced colonists were offered the opportunty to stay. And most did. Thereby showing a distinct preference for British sovereignty rather than Argentine tyranny. And we haven't taught the events of 1982 until now because there is no way of doing it without making you look like b**&^% and scaring the children.
I told you already, we don't do indoctrination. It's not 'hiding' anything. Dead UN resolutions are irrelevant. We all know you want sovereignty and you won't discuss it with us. Your government says we don't get to decide. The children know that too. If it was taught in school it would take about 5 minutes.
The Falklands history they learn in school is about their own culture, and the way of life here in the past, and significant figures from history. This is what matters.
Anyway, this time around they are going to gather some eyewitness accounts and make up their own minds. I'm warning you that those eyewitness accounts aren't going to help your case any.
Geo,
Dec 18th, 2011 - 07:37 pm - Link - Report abuse 0I never said that in Republics the state is represented by a Prime Minister.
I'm well aware of the difference between a president in a presidential system and a president in a parliamentary system.
In a presidential system the president functions as both head of state and head of government, and in democracies is elected directly in most cases or indirectly as in the US.
In parliamentary republics the president is the head of state and the head of government is a prime minister, premier, or chancellor. The head of state and the head of government are two different people. The president can be elected directly or by the legislature, which may be the national legislature, or a combination of the national legislature and state legislatures.
Apart from how the head of state of a parliamentary republic gets his/her job, the government system of a parliamentary republic is more similar to the government system of a constitutional monarchy than to the government system of a presidential republic, and if the republic follows the Westminster system, it will be very similar to the UK government system.

Dec 18th, 2011 - 11:58 pm - Link - Report abuse 01966 - December 16th, the International Covenant on Civil and Political Rights is adopted by UN General Assembly in Resolution 2200A (XXI) -
“ Article 1 - All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.
Article 2 – All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence.
Article 3 - The States Parties to the present Covenant, including those having responsibility for the administration of Non-Self-Governing and Trust Territories, shall promote the realization of the right of self-determination, and shall respect that right, in conformity with the provisions of the Charter of the United Nations.”
So what the Islanders are doing with their fish and oil is not ony lawful, but protected by the UN Charter.
Argentina signed and is bound by Article 3 !
We are not there by force, we are there because the 'peoples' of the Falklands wish us to be.

As for the living in peace - if that was the case why -
February 8th, Mestivier's murderer, Sáenz Valiente, is shot after having his right hand cut off, six other mutineers are shot by firing squad in a public execution and two others are flogged. José Antonio Gomila is only condemned to 2 years on half pay.
As for who stayed, and who left -

“Capt. D. Juan Antonio Gomila, Miguel Hernandez and his wife Maria Romero, Sgt. Settlers: Joaquín Acuña, his wife Juana, Matthew González, his wife Marica.
Aliens: José Viel, John Quedy, Francisco Ferreyra, plus 1 prisoner.”
Military prisoners removed on the Rapid are recorded as: Sgt. Dec 19th, 2011 - 10:01 am - Link - Report abuse 0At least one Argentino was thinking, not raving, about 1982:
[3] . After the war, a lot has been said about the possibility that the result might have been different if Argentina would have been luckier in her military operations, sinking more British ships with bombs that hit their targets but never exploded. Such conjectures are very unconvincing for the simple reason that war is not a sport played on the gentlemanly defined limits of the playing grounds. If Argentina had, for example, sunk one of the British aircraft carriers, escalation would have been inevitable, with the remaining one attacking the Argentine mainland and most probably wrecking the Patagonian oil and hydroelectric industry. This would have had a devastating long term effect upon Argentina's economy, and an immediate and equally disastrous effect on political support for the war, as Buenos Aires would have been left without energy. As it was, war never got to Argentina, and the country can be considered extremely fortunate for that.
Perhaps all you Argie numbskulls who think you have a cat in hells' chance of beating Britain, had better read the final sentance two or three times for it to sink in.

The final paragraph is one possible (though very unlikely) scenario if Argentina keeps agressively attacking the peaceful people of the Falklands (there are no Malvinas).
Given the rank stupidity shown by most Argies on this site to what they are facing if they 'took on' Britain militarily, then an armed response (note the response) by Britain to another invasion or act of war toward Britain (includes BOTs) would result in devastation for the Argentinean mainland.

This reminds me of another country...Israel! I don't want to get into the rights or wrongs but the facts are this.
This country is surrounded by unfriendly neighbours who refuse to acknowledge that Israel even exists.
Some have declared that they even want to wipe them off the map/ push them into the sea etc etc etc. Sound familiar?
But despite this Israel does exists and by mere fact that these neighbours threaten bluster and bully means that Israel would have full backing from almost all civilised countries in the world if such an event ever took place.
Another country has a similar problem. Taiwan. Independent nation which has a BIG neighbour always saying This Island is part of China etc etc etc. Self determination keeps them independent. As well as having support from strong friends.
If either of these two countries fell to the threats of the aggressor states then I would be concerned for the Falklands. But until that time I believe The Islanders can sleep well at night knowing that they have friends who stand up to bullies. Compared to China or Iran Argentina is a toothless old stray cat. Hissing at imagined threats but will run given the chance if ever there was one.

Dec 19th, 2011 - 08:04 pm - Link - Report abuse 0Crimes of General Julio Argentino Roca does not override the sovereign rights of Argentina over the Falkland Islands. And historical contexts are different social processes. UK has 500 years of existence thanks to colonialism and imperialism. In this context, the conflict must be judged. The decolonization committee of the United Nations is very clear about which is the appropriate body to understand the conflicts generated by colonialism. In its resolutions states very clearly that the Falklands conflict is an issue of sovereignty and self-determination.
In the Malvinas Question General Assembly of the United Nations included this doctrine - the principle of territorial integrity by referring to the interests and NOT the wishes of the population of the islands - in its resolution 2065 (XX) of 1965, later confirmed by other resolutions 1973 (3160, XXVIII) 1976 (31/49), 1982 (37 / 9), 1983 (38/12), 1984 (39 / 6), 1985 (40/21), 1986 (41 / 40), 1987 (42/19) and 1988 (43/25). They all declare the existence of a sovereignty dispute and reaffirm the implementation of resolution 2065 (XX) Parties (Argentina and the United Kingdom).

Following Paraguay's defeat in 1870, Argentina sought to enforce one of the secret clauses of the Triple Alliance Treaty which permitted Argentina to annex a large portion of the Gran Chaco region, an area that was rich in quebracho wood (a product used in the tanning of leather). The Argentine negotiators proposed to Brazil that Paraguay should be divided in two, with each of the victors incorporating a half into its territory.

@118. Raul, in the case of the Falkland Islands status as a non-self-governing territory, the principle of Territorial Integrity applies to Great Britain. This is because Great Britain is the Administering Country under the terms of UN Charter Article 73

Argentina's invasion of the Falkland Islands in 1982 was a breach of all UN Charter Articles and all UN Resolutions regarding this issue

Furthermore, Argentina lost the 1982 conflict and the principle of uti possidetis, ita possideatis applies to British Sovereignty of the Falkland Islands. UN Charter Article 73 applies and UN GA resolution 2065(XX) confirms resolution 1514(XV) covers the case of the Falkland Islands, which Argentina voted for
Thus the principle of Self-Determination applies. The Falkland Islanders, chose to be British and as such the Falkland Islands are British

The principle of self-determination does not apply to the Question of the Malvinas Islands.
The specificity of the Malvinas question is that the United Kingdom occupied the islands by force in 1833, expelled the original population and did not allow their return, thus violating the territorial integrity of Argentina. Is ruled out then the possibility of applying the principle of self determination, as its exercise by the Islanders would cause the breach of national unity and territorial integrity of Argentina. In this regard it should be noted that resolution 1514 (XV) Declaration on the Granting of Independence to Colonial Countries and Peoples in the sixth paragraph states that Any attempt aimed at partial or total disruption of national unity and territorial integrity a country is incompatible with the purposes and principles of the United Nations Charter. In the Malvinas Question General Assembly of the United Nations included this doctrine - the principle of territorial integrity taking into account the interests and NOT the wishes of the people of the islands - in its resolution 2065 (XX) of 1965, ratified by later resolutions 1973 (3160, XXVIII) 1976 (31/49), 1982 (37 / 9), 1983 (38/12) , 1984 (39 / 6), 1985 (40/21), 1986 (41/40), 1987 (42/19) and 1988 (43/25). They all declare the existence of a sovereignty dispute. and reaffirm the invitation made in resolution 2065 (XX) Parties (Argentina and the United Kingdom) ”to proceed without delay with the negotiations recommended by the Ad Hoc Committee on the Situation with regard to the implementation of the Declaration on the Granting of Independence to Colonial Countries and Peoples, to find a peaceful solution to the problem. There is absolutely no precedent in the UN's history for the forcible subjugation of an unwilling population on the grounds of territorial integrity (or anything else). You are deluded.
And you can pipe down about UN resolutions, since Argentina has shown itself very willing to completely disregard them when it suits.

Dec 20th, 2011 - 06:40 pm - Link - Report abuse 0But if you like take it to the International Court of Justice if that helps. ?
Dear British:
England will never accept the International Court of Justice because doing so will automatically recognize that there is a sovereignty dispute with Argentina.
The International Court of Justice proceedings immediately send the dispute to the decolonization committee of the UN, which is the most appropriate body for interpreting and understanding the concepts of colonization and imperialism, its historical contexts and social processes, and has already extensively reviewed the arguments of both Argentina and the UK finally failed and it is a sovereignty dispute and self-determination. Just note that in the Malvinas Question General Assembly of the United Nations included this doctrine - the principle of territorial integrity by referring to the interests and NOT the wishes of the population of the islands - in its resolution 2065 (XX) 1965, later confirmed by other resolutions 1973 (3160, XXVIII) 1976 (31/49), 1982 (37 / 9), 1983 (38/12), 1984 (39 / 6), 1985 (40/21) 1986 (41/40), 1987 (42/19) and 1988 (43/25). They all declare the existence of a sovereignty dispute and reaffirm the invitation made in resolution 2065 (XX) Parties (Argentina and the United Kingdom).
The International Court of Justice in its judgments rests on the committee of the United Nations decolonization. Remember that the international court of justice and decolonization committee United Nations is supranational. Both have a lot of international prestige and complement each other.
Thank you very much.

Dec 20th, 2011 - 08:18 pm - Link - Report abuse 0You are wrong. I'm an IR student, so I do follow what goes on at the United Nations and its agencies. There's a great difference between theory and practice. The fact is that Brazil and Argentina have diplomatic clout at the United Nations. I hardly believe that Russia, China or France would be willing to damage their relations with Brazil (the world's 6th largest economy) because Brazil chose to close its ports to Falkland vessels. The decision to close their ports was decided at the Unasur, a regional supranational body.
Do you think that Russia, China or the United States would be willing to damage their relations with the 6th largest economy on the planet (yes, Brazil just overtook the UK this week) in support of the an island? You guys are delusional.
As for the United States following U.N. resolutions and international law, that is arguable. Guantanamo? Israel's constant defiance and violations of UNSC resolutions? Invasion of Iraq? ...

Tomas all the laughter. Underestimate it. Argentina managed to install the conflict in the world public opinion and, today, as, discussed in depth the issue, Argentina gets more and more international support. This is no small thing. Just watch the weight international organizations like the United Nations, MERCOSUR, UNASUR, CELAC. support the Argentine claim. Even its supporters claim, a former British Caribbean colonies.
A great merit of Nestor and Cristina Kirchner and all Argentine and Latin American arms race is not to gamble. They have atomic bomas or want. Argentina's strength is the claim alone. Returning to revive a rusty and outdated submarine is not exactly re-arm, on the contrary, is to return to recreate a popular national industry and provide jobs for our technicians and workers and strengthen our domestic market. Argentina and Latin America is aware that this fight is long term. England is increasingly isolated from the world, Europe no longer supports it and your employer is the United States, little by little by little, and released her hand. Obama and Hilary Clinton to speak of the Malvinas . NO .. Falklands Still resting on our laurels as we continue to work together with Latin America and the world.
@Raul 134, 138, 140. You are wrong
Dec 20th, 2011 - 10:16 pm - Link - Report abuse 0The UN Treaty is not retroactive and Territorial Integrity and National Integrity as referred to in resolution 1514(XV) & the UN Charter apply only to the rights of Great Britain as the Administrating Country of the Falkland Islands & by virtue of its territorial integrity at the time of founding of the UN; Argentina has no Territorial Integrity nor National Unity rights under UN Treaty or resolutions in respect of its Sovereignty disputes with Great Britain
Great Britain freely acknowledges that Argentina disputes sovereignty over British Territory; Great Britain merely disagrees and has no doubts over its Sovereignty
You excuse Argentine avoidance of bringing its claim to the ICJ by virtue of an imagined response by Great Britain where they apparently would refuse to recognize the authority of the ICJ, even though Great Britain currently does submit to the authority of the ICJ. It seems to me Argentina is avoiding a court which requires strict evidentiary standards requiring the burden of proof, rather than mere Argentine political rhetoric
The ICJ will deal with any claim brought to it; it shall not and cannot cede its authority to any UN committee
The remit of the UN Decolonization Committee is determined by UN GA Resolution 1654(XVI) is to examine the application of the Declaration on the granting of independence to colonial countries and peoples contained in its resolution 1514 (XV), to make suggestions and recommendations on the progress and extent of the implementation of the Declaration, and to report to the General Assembly; that is all. No more, no less.
Thus the purpose of the Decolonization Committee is to report Great Britain's compliance with resolution 1514(XV) and Article 73 with respect to the Falkland Islanders right to self-determination
The fact is Argentina's position is weak, which is why it seeks to circumvent international law & its own Treaty obligations
The ICJ is the proper UN Organ, so use it
They know this, Domingo, that is why they willnot.

Argentineans keep whining about a fictional territory misnamed malvinas, which is a bad translation from the French malouines. On top of that, in 1833 the Argentine Republic did not even exist.
Since there is nothing, really nothing, to decolonise in the Falkland Islands, why on earth your FCO friends keep sending Islander Missions to the ridiculous sessions of the UN Decolonisation Committe? In that Committee there is no room for a Porto Rico, a Hawaii, a St-Pierre & Miquelon, etcetera. Then, there should be no space either for the Falkland Islands.

Some interesting examples: In 1940 after the fall of France, some military experts predicted, in three weeks, Britain's neck would be wrung like a chicken! Churchill replied then: some neck, some chicken! In more recent times, after Argentina's brutal invasion of the Falklands, Admiral Anaya (I call him Canaya) said that ”a decadent Britain would not respond to the invasion, especially since she was ruled by a woman! Yes, some woman!
It seems that in the South Atlantic, sooner than later the British Lion will be forced to show his teeth and roar in order to just scare the enemy to death!

Dr. Elsby:
Dec 25th, 2011 - 09:05 pm - Link - Report abuse 0Concerning this dirty war of attrition waged by Argentina:
According to Article 4 of the UN Charter, one of the preconditions a State must fulfill before joining the UN is to be peace loving. Argentina after its naked aggression against the Falklands in 1982, ceased to be peace loving. The UN then had excellent reasons for expelling the invaders from the Falklands (UNSCR 502.)
As for Article 4 of the UN Charter, it could probably be easily proven that the war of attrition is waged in violation of Article 4-- for the anti-Falklands campaign is a clear peace violation!
Please consider that FCO has some of the world's best diplomats. So the UK, as a UNSC permanent member, has the diplomatic capability to give Argentina a KO blow at anytime!
