    A stunt is a performance. I read what Cristina wrote, its a desperate attack and those with an education higher than a 3rd grader can see that. Read how often she tries to attack the mind, she tried it with college students here in the states.
    Oh, by the way, when my children were in 3rd grade, they knew that just because an island is 350 miles away does not justify sovereignty. Visiting lovely Bermuda, very close to the US, is just one example of many.

    We, the Brits, should wear down the Argentines, telling them how irresponsible they are telling their school children that the Falklands belong to Argentina and writing it into their constitution based on such a tenuous or, at best, finely balanced claim.

    Argentina needs friends, trade and investment to realise its potential. CFK's and Timerman's policy towards us and, at a remove, our friends in the Commonwealth, EU and Northern Hemisphere, is utterly short-sighted.

    The 1982 Task Force did Argentina and Latam an enormous favour by showing them how pathetic their military dictatorships were. Now Latam needs to raise its game a little further.

My favorite quote from the series could in fact very well apply to my Argentine friends that are about to lose their trousers in the current court battle regarding unpaid debt. “We have met the enemy, and he is us...” Instead of seriously concentrating to negotiate a solution to paying debts, CFK and her cronieies make a big fuss over islands that were never theirs to start with... Never the less, next week should be entertaining...

    Dr. Hayes, Director for the Overseas Territories, wants to “start the process of educating myself about the Falkland Islands”. A good start would be reading UN Resolution 2065 (XX) Question of the Falkland Islands/Malvinas and the 4th Committee's background reports. Here he will quickly discover that the “population” of the Falkland Islands does not have the right of self-determination, reserved for “peoples” in the UN Charter. Then the referendum becomes pie-in-the-sky.

    Look at their leader's faces. Of course the British, Spanish, Italians, and Germans will use Argentina as an escapegoat to distract their despairing citizens of their own problems. It's all Argentina's fault for talking about the Faklands, for buying out YPF, for not paying back the crooked Italian and Geman bondholders, for restricting French imports into Argentina.

    Argentina is the only thing Europeans have left to justify their failures.

It was, said Dr Hayes, a good time to start the process of talking about how the referendum would work to the benefit of the Islanders in the long term.”

    Dr Hayes clearly supports the line that the Referendum was a Short/Sawle initiative by suggesting that someone might have given a thought or two about what to do with it before embarking on the initiative. With the responsible Minister and his own predecessor moved sideways prior to career downgrades, its no surprise to see him distancing himself from early involvement in this sorry and ill conceived tale.

    As for his response to the question about stage management, it must be a case of misreporting. He surely realises that the International Observation effort was as much stage managed as the voting itself. Not fiddled, just an entirely predictable outcome.

    Misreporting must be to blame for this gem too “Asked whether the Falklands referendum might encourage other Overseas Territories along the path towards greater autonomy...”. How can a consultative referendum designed to reinforce the status quo be seen as an encouragement for anywhere seeking greater autonomy to do the same? If that was what was wanted there should have been a No vote.

    Finally, I too find it unacceptable to say that the views of the people don't matter. Of course they matter and should be taken into account as British policy on the Islands develops. No doubt about it.

    No, when Timerman was in London it was not high on the news agenda and the FCO statements were fairly low key. No big speeches or tub-thumping.
    Argentina is a political irrelevance in Europe but is composed of a people we feel vaguely sorry for, so there is no great kudos in getting one over on it.

    Accusing Europeans of using Argentina as a distraction for internal problems is highly Freudian. The whole world knows that Argentinian rhetoric on the Falklands is inversely proportional to its economic success so no-one is ever fooled.

    I have just read this UN resolution - Spanish and English versions - and can find NO reference at all to the Falkland Islanders not having the right of self-determination. Are you sure you have read UN resolution 2605? If so please quote that part of it which says what you claim it says!

    General Assembly resolution 2065 (XX) Question of the Falkland Islands/Malvinas calls for the ”peaceful solution to the problem bearing in mind provisions and objectives of Charter of UN and of General Assembly resolution 1514 (XV) and the interests of the population of the Falkland Islands”.

    Please note:-
    1) The interests, not the wishes, of islanders are to be taken into account.
    2) The word “population” is used wisely, to distinguish the islanders from a “people”.

    This is why Argentina fails to take advantage of the International Court of Justice. Once the this treaty is shown to the magistrates its case will be dismissed.

    Please note that 2065 wasn't just voided by the 1982 war. As we've all been told many times that rather unfortunate incident was really nothing to do with you, it was your evil twin brother all along. Best to pretend it never happened, really.

    But then there'sthe other unfortunate matter of your constitutional update in the 1990s, which has made it clear that as far as Argentina is concerned, there can only be one outcome to any 'negotiation'.

    Thus invalidating the terms and context of resolution 2065.

    That UN resolution, and your interpretation of it, are 50 years out of date. A lot of things have happened since then, most notably your country invalidating the resolution by invading the Falklands.
    The other thing that has happened is that the world has moved on from thinking that you can subjugate an entire population against its will. You appear not to have noticed this and are stuck in some kind of colonialist time warp.
    Can I ask you two questions, which I have asked many Argentines and never got a straight answer?
    First, who do you think is best placed to decide what is in the Falkland Islanders' best interests, if not us?
    Second, how do you propose to subjugate us, given that none of us want you?

    I am new to this site. So hi all. I been watching the argentina argument and latin american arguments in amusement as they have created a whole mess which they are completely unaware of. The C24 decolonisation committee have stated that the Falklanders are an implanted population by conquest and have therefore no rights; this has been backed up by members of Mercours, Celac etc. So using the C24 and argentinias argument as basis of negotation, Patagonia must be returned to its original inhabitants...the current population has no rights or say in what happens by the way. Chile will have to give up Araucania, Brazil, Paraguay and Chile will have to cede provinces to Bolivia...nobody living there has no rights. So if we use the C24 and argentininas argument to its logical conclusion, the whole of South America will have to be re-drawn with several major countires losing significant provinces.

    You don't have to tell CFK or Tinnerman that at all. You just have to quietly jog the Brazillians and other countires that are currently upporting argentina that by following the argument put forward by the C24 and what the C24 have stated and must therfore be applied fairly, that you Brazil will lose these provinces, Peru and chilie will lose these provinces etc. Oh and the people there...they have no rights at all on what happens to them.

    Well yes and I strongly agree. But its the argument that the FO should now being put forward. Although I think Bolivia is going to shoot argentina in the foot anyway. If no one is aware Bolivia is going to the ICJ to request that provinces ceded to Chile be returned. The ICJ will probably say no. Therefore a legal precident has been created.

Now please explain why you think the Falklanders are Flak-slum-lands. As far as I am aware there are no slums in Falklands, in fact they enjoy a higher standard of life than a lot of other places, encluding I may add parts of the United Kingdom. There is money to buiold a decent community college but for a population of 3000 it is currently economically unviable to build one. It is cheaper to fly them to the United Kingdom to continue their education there. So your getting economical and social factors a little confused.
    As for everyone who reads the Merocpress is a shite whole, again I disagree, as there is a wide ranging and healthy debate on many subjects on this site, the fact you are a member of this site suggests that you are obviously placing yourself in this “shit hole” category?

The ICJ will in my opinion say no, mainly due to the amount of time gone past and the settlement of the poulation etc. This will then create a legal precedent for the Falklanders to use against the Argenmtina (which they will try to deny). But if the case Falklanders V argentina goes before the ICJ which is where the UK goverment is slowly manovering this case towards), it will be used as evidence in the case.

    This should be ruddy obvious but it appears beyond the ken of many people that a resolution passed x decades ago can really have no legitimacy in todays world: these sort of resolutions requiring re-stating and re-issuing under a modern interpretation and, for that matter, law.

    In this instance I very much doubt that any Argentine delegation would be allowed to get away with the outrageous lies it gave to the UN that went on to form the basis for a large number of these resolutions.

    Put together it would seem inconceivable that the same resolutions would be passed without significant changes.... yet this is one further example of the hypocrisy of Argentina (in refusing to accept blame for the 1982 invasion and negation of any prior resolution) and the UN as a body for allowing such out-dated and legally-superceeded resolutions “stay on the books”.

    It makes a mockery of the entire body.

    No problem. To be honest I thought argentina and other countries would have picked it up due to the legal precedent it would create. The way I read it, if Bolivia wins, theyy can legally challenge Peru, Brasil, Paraguay etc for the formers provinces to be returned. This then leaves Argentina to challenge the UK, but also be challenged in return for the provinces taken during the conquest of the desert. The huge ramifications of the case will be one of the reasons the ICJ will say no. This then creates a legal precedent against Argentina when the case goes before the ICJ, the UK (representing ther Falklanders), continuious habitation by the Falklanders, First settlement by the Uk dating back 1765. The fact that the Vernet requested British Permission to land and reported to the British on a regular basis is a tact acknowledgement of the British claim to the Islands, (rather like a tenant requesting permission from the land lord for works and adjustment to the house), the facts that only the military side of the argentinia colony was removed and not the civilian. The only thing argentina has going for it is for the two months (december 1832 to Jan 1833). However two months of continuous population against 150 years will be a case of case dismissed.

    Their plan seems to be a mixture of unchecked overfishing and seige (very peaceful, or so they claim), with an unhealthy amount of lying to stir up regional support ,if you can call 1000+ miles away as being in the same region (again very peaceful - not).

    Hello @82. I am not exactly sure where Malvinas Argentina is and doesnt appear on any national or international map. I assume your talking about the Falkland Islands? If so please refer to the name that they are internationally known as. Even the UN in its documentation refers to them as The Falklands Islands, (Malvinas). Not Malvinas Argentina. To make overfishing legal in the Falklands Islands...you would have to control the falkland islands...which argentina doe not. Getting guns into Falkalnds Islands will be very difficult as international airlines frown upon this. And how shooting penguins will keep the english away, I am not sure. Perhaps your very confused on this point.
    You will find that shooting anyone even if they are illegal or not is still Murder. That will get you twenty five years plus in the UK. As your obviously spouting premeditated murder that is 40 years plus.
    You can actually become american by applying for citzenship, Sir anthony Hopkins has done it for example. The same as people taking citzenship in this country. So hence not an alien race.

    WHY CAN'T WE DO THE SAME?.
    I heard on the news last week that president from bolivia evo morales decided to demand chile before the i. c. j., in relation to it's claim for acceding to the sea.
    Many people in this forum know what i think about the idea of discussing the malvinas-falkland cause before the court. In fact, i debated in different oportunities with some people about arg.'s proposal of arbitration in 1884 and in 1888, which were rejected by the u. k., and about the u. k.'s idea of discussing the cases of the dependencies from the islands only, s. georgia and sandwich in 1947.
    During my investigations about the historic and the legal aspects of this conflic, i had an interview with an ex professor of public international right from u. b. a. (university from buenos aires), and i asked her wether she thought that taking the case to the i. c. j. was a good idea, and she told me agreeded on that step.
    However after 1947, there wasn't any other proposal of arbitration by none of the two nations. I have always thought that if none of the two parts proposes to give that step, is bacause perhaps neather arg. nor the u. k are sure of getting a positve result if the case is discussed before the court.
    Anyway, beyond my thought, and beyond the omissions of both governments, i think that we all should wonder why can't we do the same than bolivia.
    I think it's the only one way to finish with the u. k.'s hypocresy, every time it asks for the application of the right to self determination for this cause, when that right actually has never been applied for this case by the u. n., as it was for other colonial situations, due to the d. c. has always considered this case like a special colonial situation.
    It's obvious and expectable that both governments tell just what is convenient for them, in reference to the historic and the legal aspects of this conflict, however, we must be intelligent, instead of buying so easily their propoganda like many people in this forum do.

    General AssemblyResolution 2065 (XX) Question of the Falkland Islands/Malvinas has not been voided either by the war of 1982 or by a ruling from the United Nations. No UN member has applied to have it set aside. Therefore it is still in force.

    Resolution 2065 sets the terms by which the dispute over sovereignty has to be decided between Argentina and the UK. These terms are no different now than they were in 1965. Any change can only be made with the approval of the General Assembly.

    Temporary Provision #1 of the revised Constitution of the Argentina Nation (22 August 1994) states: -
    Argentina ratifies its legitimate and imprescriptible sovereignty over (the South Atlantic islands....) as part of national territory. The recovery of the said territories and the full exercise of sovereignty, respecting the way of life of their inhabitants, constitute a pemanent and irrenunciable objective of the Argentine people.

    The Constitution of the Falkland Islands was in turn revised in 1997 and 2008, when the term “colony” was dropped from the preamble.

    Neither the revised constitution of Argentina nor the amended constitution of the Falkland Islands have any bearing on the terms of the dispute as defined in Resolution 2065.

    #57 The British and Argentine Governments must decide what are the best interests of the islanders.

    It is not a question of the “subjugation” of the population. It is a question of deciding the ownership of the territory.

    1. the provisions & objectives of the Charter of the United Nations
    2. General Assembly Resolution 1514(XV)

    Any interpretation 3. which are inconsistent with 1.& 2. or sets them aside are void. In addition the UK is the administrating County which reports to the C24 on the implementation of 1514 in the Falkland Islands, not Argentina, a third party interest only. In 1982 Argentina terminated negotiation

    Nota Bene: Article 73 of the UN Treaty states:

    Members of the United Nations which have or assume responsibilities for the administration of territories whose peoples have not yet attained a full measure of self-government recognize the principle that the interests of the inhabitants of these territories are paramount, & accept as a sacred trust the obligation to promote to the utmost, within the system of international peace & security established by the present Charter, the well-being of the inhabitants of these territories, &, to this end:

    @105 Thank you for reminding me that it is a sacred trust for the United Kingdom to reinforce the political, economic, social and educational capacities of the population of the Falkland Islands. The old ways of doing this are the best so let's encourage the migration of more skilled and educated British nationals, particularly British Citizens, from wherever to the Islands. They'll need somewhere to live and work but fortunately there's money in the Consolidated Fund for the necessary infrastructure development. Step forward the Falkland Island Company and its private construction partner and get building. No time to waste.

    Argentina has no business at all in the matter. You don't have any way of knowing what is in our best interests, and therefore no way of protecting them.

    But the only way you'd get us to change what we do is at the point of a gun. Which is 'subjugation and domination by a foreign power', according to the UN.

    You haven't thought this through properly. You have no way to get what you want.

They don't have to be “set aside”. Compliance is voluntary. The “terms” by which the “dispute” can be settled are therefore irrelevant. The ONLY body with the authority to set any “terms of settlement” is the Security Council. Whose resolutions ARE binding. But argieland just ignored one of those, didn't it? What's sauce for the goose is sauce for the gander. See how easy it is to destroy your contentions? And, on the subject of international law, there is a handy international legal principle. It says that territory or property held at the end of a conflict is the property of the possessor. That is GAME, SET and MATCH. And whether you accept it or not is also irrelevant. So get used to it!

Although the record shows that Falkland Islanders are an extremely charitable bunch, that doesn't mean that we're going to give away all of our money (or whichever amount of it you would like to see) to every worse-off group.     You came on here, I THINK, within the last twelve months and your view at the beginning was that the Falkland Islanders are completely owned AND governed by the UK. Otherwise the UK would already be draining us of our wealth. If we ARE completely owned AND governed by the UK, as you would like, why AREN'T the UK Gov't draining us of our wealth?

    If Argentina wishes to dispute the status quo Argentina is free to make a claim at the UN International Court of Justice, but would risk losing due to extinct prescription, uti possidetis & the fact that the UN Charter governs this issue and is not retroactive before October 1945, so the territorial integrity of the member states as of 1945 is what prevails, i.e. the UK's sovereignty of the Falkland Islands, South Georgia, Sandwich Islands & surrounding maritime spaces

    Right now the Falkland Islanders are determining for themselves their chosen future, which is free association with the UK as a British Overseas Territory. The British shall support them in their choices and defend them from Argentine aggression

    The results of your nonsensical bet will not be possible to judge. Like I said: we are going to pay the UK money when we decide the time is right. What I WILL bet you is that the money in the fund right now is about to be spent and not given to the UK.

    At least we agree on one thing. I have no doubt about UK sovereignty of the Falklands and neither do the rest of us because it is our choice to have it that way. If and when we choose to change the status quo we have no doubt about our liberty to make that choice.

    I find your campaign to support veterans a laudable one but take my advice. Don't hold out for money from the Falklands if you really want to assist them.

Subsequently, there is a proposal for a “Sovereign Wealth Fund” to be managed in the City of London. The debt you say you will pay isn't on the books and it's a fantasy idea until it is. As for your views on the transfer of sovereignty, the 2008 Constitution says you'll have to clear it with the Governor first and we know who appoints him.

    It matters not what Argentina thinks or for that matter what THINK is saying the cold hard facts are that the Islanders have told the world that they do exist, Get used to it THINK because your frustrated whinging is having no effect at all. If it ever came about that Islanders were told they had to give up their birth place then by the same token Argentina would have to do exactly the same because THINK your people were indeed squatters on someone else's land.

    Sounds hard I know but your shouting about something you appear to know very little about. That is of course Human rights and Democracy. Something your parents forgot to include when they made you I guess.

    I doubt you will come back with a sensible answer because I have noticed that in almost every case I have commented about you there has been silence and the reason being that I am a Falkland Islander to whom you cannot tolerate outsmarting you.

    When you have the guts to return and live in Argentina then maybe you will begin to really understand just how those oppressed people are living. It is not a pretty site and you know it.
    Poverty is something we Islanders do not have and you also know that but the problem is you cant and wont accept it because you think we do not actually exist.

    All Think ever does on these posts is moan and groan. mind you without a proper early education or is maybe he was educated think it is called brain washing in that Country across the water from us. Got to feel kind of sorry for them less informed characters .

    If Think spent as much time looking at the future and less on raking up the past maybe think would have a better life. The past is a time line of events that one is supposed to learn from to avoid making the same mistakes again. Lucky for me and most Falkland Islanders the mistakes concerning our homeland happened long before we were born. We are only interested in looking forward and that is what we are doing and if Think believes that trying to use past history to make a claim the think has even more learning to do. Fact is Think has not actually included all Falkland History in the argument only those two moments when Argentina tried to possess the Islands. But we have got used to Argentina and that issue because the poor devils were never educated prior to or beyond that period.

    I'm note sure how this works in the rest of the UK, but in my own neck of the woods, just about the last place I would expect to find a former senior officer of the RN enjoying a lunchtime G&T with his old comrades, would be in the British Legion.

    I take it you know something about nuclear powered submarines then?

    I suspect not though, whereas advanced ones are among the quietest possible vessels, the one Brasil is getting will not be latest generation and may well kettle louder than a good diesel sub, ala the Ausralian subs and so much cheaper to build and operate.

    I understood from a government minister that the reason they are getting the subs is to take charge of the nuclear technology for peaceful purposes such as generation. Sounds like bullshit to me because many countries will build you advanced nuclear generation reactors far cheaper than the subs!
