London court rules English law applies to Euro-denominated Argentine debt

    I wouldn't crow about it just yet.

    The Bank of NY Mellon is still held by the US judgement. It will need to get permission from Griesa before any money can be released.

    I am not saying Griesa won't do it, just that he will have to rule on it. But you never can tell when it comes to a dick sizing competition between legal systems.

    Eventually Arg will pay all that they are owed.

    @1, 3. Oh, do tell. Griesa rules OK!! No money moves unless Griesa says so. Funnily, maggotland is pushing for a legal framework for debt restructuring at the UN. That'll be good won't it? A legal framework that 'might' apply if 193 countries legislate to apply it. Leaving 13 countries that aren't UN members. And then the bond conditions that specifically exclude the 'framework'. Still, all those politicians and experts have to do something to justify the millions (hundreds of millions in the case of argieland) in expenses. Should be good for at least ten years!

    First off Danielle......in the big picture I am not here about maggots not paying what they are contractually obligated to pay or the fact of the matter, most RG's possess no sense of responsibility, so why would I care about this ruling? Plus I highly doubt it matters unless the English court can force over the RG funds in USA banks.

    The Judge reaffirmed the propriety of the U.S. court’s injunction freezing the funds because BNY, as trustee “can properly be the subject of any orders which that court considers appropriate”. The court also expressed it's reluctance to get involved in the pari passu proceedings in the U.S.: “The Court is, of course, very concerned not to intrude improperly into matters which are before U.S. Courts.”

    The only item granted was a declaration — which was not even disputed by BNY — that, under English law and per the bond documents, the funds sit in trust. But no relief was granted.

    This ruling only means the funds in question can be judged under English law, it is still up to Griesa to release said fund from his jurisdiction, the money being in NY, before any ruling could be made in the UK.

    Not much of a victory, even by Argy standards.

    Parasitic though these vulture funds undoubtedly are, if you even think you are winning, never mind have won this dispute, then mate you are simply not in the real world.

    This is a case where Argentina has a strong moral argument, however due to the totally incompetent/populist approach of your government to the issue, you are still going to lose where it counts, in the courts holding your money/assets.

    This is costing Argentina a fortune, yet they are still ahead of you at every step, with a long way still to go.

    At this point the smart money has to be on them to win, in the end.

I would expect NML to open a case looking for resolution of a number of judgments by taking dividends due to 'local' bondholders. The 'local' bondholders would, after all, be parties to argie evasion of the judgments.

    Thanks to global warming which the USA helped cause, the mean northeast pacific ocean temperature has been raised beyond a tipping point.

    This warmer ocean off the NorthAmoan west coast causes the compressed air stream in the atmosphere to move north as warm air from the ocean expands. This causes a high pressure to build in the west of NorthAmoland, which brings sun and warmer temperatures on land (west USA and Canada). This raises the ocean temperature even more, reinforcing the vicious cycle.

    This results in all storms bypassing California, USA's food basket, and it is causing it to become a desert.

    SIMULTANEOUSLY, the warmer ocean feeds much higher moisture and energy levels to the storms in the ocean, which then have far more rain/wind/snow. These supercharged storms are then deflected far north into Siberia, Alaska due to the high pressure in west North Amoland. There they pick up arctic air, and then go plunging down to Eastern North Amoland. This causes massive snow and cold in that area.

    Since the mechanism cannot be stopped, snow will simply start turning to ice, and eventually the pattern will be so strong the summers will bet shorter and the snow won't melt. An Ice Cap will build burying New York, Boston, Chicago, Washington, etc.

    This new icecap will create a new superdry wind blowing off it into the southern USA, causing massive drying and dust, creating a vast unusable scrubland.

    West USA/California: desert
    North USA: ice cap
    South USA: scrubland

    And that will be the end of that hapless country.

    Just as I had warned yankee and captain two years ago. Now it's too late. But... there's always Argentina.
