“These flights constitute an additional manifestation of the illegitimate military presence of the United Kingdom in the South Atlantic.”

Is merely a political assertion which carries no legal merit. Whereas, the RAF Boeing C-17 Globemaster III appears to be doing a completely legal activity. Which, moreover is none of Argentina’s business.

    “Law of the Sea

    Chapter 3: Freedom of Navigation

Duties of Ships and Aircraft During Transit Passage

Ships and aircraft exercising the right of transit passage shall (a) proceed without delay through or over the strait; (b) refrain from any threat or use of force against the sovereignty, territorial integrity, or political independence of States bordering the strait; and (c) refrain from any activities other than those incident to their normal modes of continuous and expeditious transit unless rendered necessary by force majeure or by distress.”

Argentina, though, is accustomed to bankruptcy and recovery. And to relative decline. Since 1921, when it was one of the richest countries in the world (GDP per capita at that time was on a par with France and Germany), Argentina has experienced average annual inflation of 105% and has been obliged to change its currency on five occasions: the peso moneda nacional until 1969, the peso ley from 1970 to 1983, the peso argentino until 1985, the austral until 1991 and the current peso, also known as the peso convertible. Since 1980 foreign debt payments have been suspended five times (no country in the world has defaulted the same number of times) and Argentina today is the main debtor of the International Monetary Fund (IMF) with $44 billion outstanding.

And they are concerned about British military flights stopping over in Brazil?

There is absolutely no legal requirement for them to be humanitarian flights.

”The Right of Innocent Passage in the UN Convention

The innocent passage has been codified in the United Nations Convention on the Law of the Sea (UNCLOS III) was adopted in 1982, it is also known as the Law of the Sea Treaty. Its purpose is to establish a comprehensive set of rules governing the oceans and to replace previous U.N. Conventions on the Law of the Sea, 1958 (UNCLOS I) which was adopted in 1958 and another in 1960 (UNCLOS II), since these two convention were believed to be inadequate.

The term Innocent Passage is defined under international law referring to a ship or aircraft’s right to enter and pass through another’s territory so long as it is not prejudicial to the peace, good order or security of the other state. Under Article 19 of the UNCLOS III it is defined “Passage is innocent so long as it is not prejudicial to the peace, good order or security of the coastal State.” Such passage shall take place in conformity with this Convention and with other rules of international law.

CONCEPT OF INNOCENT PASSAGE UNDER INTERNATIONAL LAW

Innocent passage is as old as the law of the sea itself and is a normal consequence of freedom of navigation; the doctrine was elaborated in Article 14 of the convention on the law of the sea 1958, which emphasized that that the coastal state must not hamper innocent passage and must publicise any dangers to navigation in territorial sea of which it is aware. Passage is defined as navigation through the territorial sea for the purpose of crossing that sea without entering internal waters or of proceeding to or from internal waters. It may include temporary stoppages, but only if they are incidental to ordinary navigation. It was practiced by maritime powers throughout the centuries with such consistency, and was affirmed by Jessup in 1927 that

“As a general principle, the right of innocent passage requires no supporting argument or citation

I’ll note that Estimado Tænk’s estimation about future political changes are highly probable...

That’s why “Brazil will always be the country of the future... and always will be…”

By the way — in reference to one of the MP contributors identifying himself as “Terence” — there is four of us here on MercoPress have questioned Skippy’s falsely claiming serving in the Royal Air Force during the Cuba Missile Crisis of 1962.

As I stated earlier — an experienced airman with a qualified technical rating then would have had to be at least in his early twenties and would be an octogenarian today! (Skippy is currently in his mid-40s and simple mathematics cannot be ignored.)

Pleasant greetings to you and value your commentary…

I was simply reminding the MP readership that STOLEN VALOR IS A PUNISHABLE CRIME in several countries — but I’ve made my statement and will not elaborate further on this current subject thread.

(I do reserve to defend my position in future comments.)

I plan to return to the farm on Thursday…

“You present as an unpleasant individual.”

Sorry you’re so biasedly disposed. But the individual is entitled to defend themself from malicious and unjustified attacks.
The fact that I prove my opponent is an unmitigated liar, and his word salads are typical of a malignant narcissist; are to my benefit, from which I can draw complete, and utter satisfaction.
The fact that you proffer further insult to the only victim here, doesn´t place you I good light.
So tough, titty, you aren’t compelled to read any posts. Furthermore, your arrogance is unbelievable if you think people will be dictated to by you.

Just to point out the completely obvious, the ‘Right of Innocent Passage’ is not the issue here, indeed it is completely irrelevant to the matter in hand.

The Argies are not complaining about aircraft flying past Brazil or even over it, exercising the right to ‘Freedom of Navigation’.

They are complaining about aircraft (not on humanitarian missions) being allowed to LAND in Brazil.

For which you do need the permission of the Brazilian authorities, as there is no such automatic right, unless an emergency is declared.

Hope that has cleared that up.

    Eilean Siar
As you see, our friendly neighbourhood F*uckwitt ‘dislikes’ anyone who does not agree with him 100%.

Never mind DARE to ‘question’ him.

He being always the ‘only victim here’, and all.

He will completely ignore the substance of my comments to him above (as they are undeniably correct) and reply with some psychological diagnosis, random quotes and insults from a junior school playground.

And nothing original, all copy/pasted many times before.

“For which you do need the permission of the Brazilian authorities”

Obviously, they need that. The point is it is nothing to do with Argentina, in fact by her behavior she is in breach of the UN Charter.

‘’They are complaining about aircraft (not on humanitarian missions) being allowed to LAND in Brazil.”
It doesn't have to be on a humanitarian mission; to be afforded the normal courtesies expected between friendly nations.

    “Having argument with Skippy”

Aha, your sock-puppet is back. Who in spite of his bizarre life, is apparently having a lot more excitement than you; who is standing, by waiting for your fruit testicles to ripen.

So I am correct then, you didn’t read the article properly in the first place before you started Copy/Pasting irrelevant blither.

The point is it is nothing to do with the, ‘Freedom of Navigation’ or ‘Right of Innocent Passage’, you so abstractly quoted above:

    Or indeed the ‘normal courtesies’.

It is about S. American politics, which are probably too complicated for you to understand.

    Sorry, and all that.

“Argentina's Ambassador to Brazil Daniel Scioli has filed a note expressing his country's concern over British military aircraft stopping en route to the Falkland Islands.”

“It is about S. American politics” No shit batman, nobody says it wasn´t.

It doesn't have to be on a humanitarian mission; to be afforded the normal courtesies expected between friendly nations.

“Right of Innocent Passage’ is not the issue here” Then you will have to show some legal precedent that allows Argentina to interfere in the normal transit of other nations aircraft.

I suspect the readership is well aware of his assertions, and his repetition of them inevitably results in a lengthy thread of little interest, other then Chicureo’s highly descriptive gastronomic delights - that I truly enjoy as much I would as a slice of Charlie Barley’s world famous Marag Dubh..: )
