UK says Falklands should be out of UN non self-governing territories list

The United Kingdom spokesman Chris Bryant said that the British position is that Gibraltar, the Falklands or any other Overseas Territories should not be included on the United Nations list of non self-governing territories. Read full article

    Spain's claim over Gibraltar is no light matter as the UK as a EU co-member and NATO ally of Spain cannot unilaterally cede rights to the only existing colony in Europe. Besides, the extent of the treaty by which the Bristish acceded to Gibraltar specifically prohibits its cesion and only allows its return to the previous owner, the Spanish Crown.

    If the Treaty of Utrecht were really put to the test it would not be worth the paper it is written on. It was abrogated almost as soon as it was written.

    Anyway, ToU has been superseded by the UN charter and under that the Gibraltarians have the unlimited right to self determination. The options available to them under the UN charter are British sovereignty, full independence and Spanish sovereignty. There is nothing at all in the UN charter - or any subsequent resolutions which say if Gibraltar is not British then is must be Spanish.
