Falklands military exercises: Governor Bertone condemns “UK's bad faith”

Argentine Tierra del Fuego governor Rosana Bertone joined the group of protestors condemning the military exercises, including launching of Rapier missiles, announced by British forces stationed in the Falkland Islands, and accused London of acting in “bad faith” just a few days after releasing a joint statement with Argentina to improve relations.     Supposedly inherited all of this territory from Spain under uti possidetis juris. That's Argentinean UPJ not the customary law of UPJ.

    The concept that Argentina had inherited the Falkland Islands from Spain is false. The law of the time did not accept inheritance without settlement and stated that 'an unopposed settlement of some years was necessary” before sovereignty was accepted. (The Law of Nations, Vattel, Cpt XI, p337) Vernet had sought acquiescence from the British consul in BUENOS AIRES on two occasions before establishing “his” colonies and the British protested when he was appointed military and political governor by the BA. Authorities. Jewett had no settlement. The concept of uti possidetis juris (inheritance of Spain) is only customary international law, applicable to those who choose to use it. Great Britain, France and Brazil have never opted to use uti possidetis juris and UPJ has “never” be used in “any” court or tribunal without the consent of both parties.

    So what does Bertone think of the intimidating actions of the Argentine Armada going around firing Exocets seven months ago? Is this legal according to Bertone?
    Shouldn't we not throw stones if we have glass in our own house?
    Are the Bertones the owners of the law and the only ones to be able to define what is and what isn't legal?
    Is it “legal” for a “Bertone” to be in South America in the first place? And speaking Spanish .. it is like Europe in somebody else's land.

    I'm sure she won't be able to sleep at night what with those nasty Brits firing missiles (max range about 10Km) whilst she is practically living next door and her being governor and all.

    Must be terrible for her not to mention all those other 40,000,000 terrified Argentines screaming “why doesn't the world do something the British Empire is up and running again just when we thought it was dead”.

    As for “dialog”, about what? The only thing both parties agree upon is that “Sovereignty is non-negotiable”.

    In 1833 the territory now known as Tierra del Fuego had not been incorporated into what is now know as the Republic of Argentina. It was sparsely populated by indigenous peoples who later in the nineteenth century become victims of genocide committed by the expanding European colonising immigrants arriving mainly from Italy and Spain.



    Therefore, with what logic can Rosana Bertone claim to be ”the governor of Tierra del Fuego, Antarctica and South Atlantic Islands (INCLUDING THE FALKLAND ISLANDS)?

    The website of the Gobernación de Tierra del Fuego shows a map of the South Atlantic with the name of the Falkland Islands and other British Territories in ENGLISH and, in brackets, in Spanish. How odd!
