In another chapter of the ongoing dispute between Argentine president Cristina Fernández and a non-submissive Judiciary, the country's Supreme Court issued a statement on Tuesday ratifying Ricardo Lorenzetti as Chief Justice for three more years starting in 2016, following versions that he was pushing to leave the SC on yet unclear “moral fatigue” grounds.     I don’t trust Lorenzetti, but I do hope he stands where he is despite all the threats he is getting.

    DEGRADATING HUMAN RIGHTS.
    I can't believe still that somebody who seemed a serious judge like d.r Ricardo Lorenzetti continues to expose judge Carlos Fayt, whose cognitive conditions are in process of deterioration, and it's not just a personal opinion, in fact, a few days ago, secretary Carlos Abrita, who has worked with Fayt since many years ago, went to see him to his house, and Fayt didn't recognize him. It was informed by Horacio Verbitzsky from página12, and nobody denied it.
    Beside, all those cretins from the hegemonical press, and from the different political parties from the opposition, who try to make people believe that the government is attacking Fayt, omit that since the constitutional reform of 1994, our constitution contemplates the right of ordering to examine the conditions of the judges from the supreme court, who are more than 75 years. What some members from the f. p. v. in the congress want to do, is to comply with that constitutional right.
    Anyway, it would be too unfair to blame Lorenzetti only for the intitutional crisis of the supreme court.
    Since the deaths of a great judge like d. r. Carmen Argibay, and d. r. Petracchi last year, and since the renounce of d. r. Zaffaroni in january of this year, the number of the members from the court was reduced to 4, which is not good, in fact, judge Elena Highton said that it's necesary to have 7 members in the institution.
    C. F. K.'s government sent d. r. Carles's academical conditions to the congress, in order to be treated by deputies and senators. However, the leaders from the different political parties expressed that they are not disposed to treat the conditions of any candidat sent by the government, which shows that the usuall defence of democratic dialogue that many of them often do, is just a decadent farce. All those rabbles are as responsable as Lorenzetti for the actual crisis of the court.
    Only a political negotiation between the government and the opposition can solve this problem.

    Good, informative post. At this point, SC judge Carlos Fayt does not have an alternative. He must show up and demonstrate he is still able to exercise his important position or take a well deserved retirement--at 97!
