Kirchner family prosecuted charged with money laundering; court seizes US$ 8.5m in assets

An Argentine court on Tuesday prosecuted ex president Cristina Fernandez and her children, Maximo and Florencia, as alleged heads of an illicit organization to launder money in association with public works contractors. The ruling includes the seizure of family assets equivalent to US$ 8.5 million and handing over their passports. Read full article

    Hmm, why did he do that? According to The Bubble, “Bonadio argues that the high-profile cases in which Fernández is being investigated — Los Sauces, Hotesur and the corruption case being investigated by Judge Julián Ercolini — should be all grouped into a single case because they all share an M.O and have the same main actors.” That doesn't seem particularly sinister.

    As for imoyaro's links, I don't understand why anyone famous is willing to talk on the phone these days, with all this wire-tapping going on. And how do the papers get hold of them anyway?

    As if all the other criminal charges against Kirchner were not enough, in recent days articles have appeared in the Argentina media about some 14 additional undeclared Kirchner real-estate properties, which seem to implicate CFK in violation of a number of other tax and reporting statutes. Looks like Baez is involved as well. The discoveries of the unreported Kirchner properties evidently resulted from investigations into the Hotesur and Los Sauces prosecutions. Evidence of Kirchners' criminal activity seems to be piling up quickly.

    In principle...,they have all been declared long ago under the original municipal matricle of the office buildings... but there seems to be some burocratic twist and doubts about their “Tax Status”...
    Don't know much about the other six (6) “Newly Discovered Properties” but some sources mention three (3) small lots of about 400 m2 between them...
    As they use to call cases like these in me auld Country...

    So the charges were pressed by Stolbizer (again), and that was back in May. It also says Judge Bonadio was originally working on the Hotesur case:

    So why was that one passed to Judge Ercolini instead?

    Anyway, it sounds like your short explanation is not so accurate. Why are you so sure CFK is innocent? Suppose she really was trying to help the poor, it doesn't mean she wasn't helping herself to money on the side. People who agree with you politically aren't necessarily any more moral than those who disagree.

    To a point, I understand MP commentators having a one-side view of the reality in Argentina. The above article is clearly aligned with the most anti-Kirchner position. Being limited to reading the Bubble besides MP does not make for good information either. Media abroad is not interested--they will only looking at Argentina when a national election--or a national catastrophe--takes place.

    Now, about judge Bonadio's story above:

    Bonadio's Los Sauces investigation ran for two years and included 40 warrant searches. Bonadio's 392-page file contains no proof, no evidence, no findings. The valiant judge wasn't able to find a single bank account abroad. The properties supposedly object of maneuvers were all rented and the tenants were home when Bonadio raided them. The rent being paid is at current market value.
    Declaring himself incompetent and passing on the (hot?) potato to judge Julian Ercolini is but an implicit acknowlegment of his failure to prove anything. The “merging with other investigations” argument is a but a red herring.
    Let's add that Bonadio, who has committed numerous judicial irregularities during his career was taken off the Hotesur investigation due to alleged irregularities.
    Some judge, this Bonadio.

    I think I have a more balanced view of Argentina as it is now than you. I have spent considerable time there over the last 7 or 8 years and travelled the length and breadth of the country. I also went there with a completely unbiased view and gained my insight by meeting people of all incomes and political views. Also, I don't form an opinion based solely on reading The Bubble or sticking with only media than agrees with the opinion I formed over time. Though you should consider The Bubble fairly impartial since the editorial bent is totally devoted to Argentina but not enamoured with any particular political party.

    If CFK is innocent and you believe in the judicial system in Argentina then what are you so rattled about? If you think the judicial system cannot be trusted then surely it was open to exploitation by CFK when she was in power. The truth is the Kirchners were not wealthy when they took power. CFK didn't even graduate as a lawyer and yet she is fabulously wealthy now. She used to poke fun at poor people - remember that? How do you explain the jump to uber wealthy?

For starters..., because I have read extensively and broadly about those three cases.., including many of the official court papers and nobody..., and I mean..., NOBODY..., has yet presented any proof of any crime... Ergo..., she's innocent until proven otherwise... You..., on the other hand..., have read The Bubble.com..., a near literal translation of Clarin...

    2) As I have said in here many times..., I disagreed with the former Kirchner administration in many points... That doesn't detract from the fact that their administrations have been the best Argentina has ever had...

    3) You bought your watch at Argos..., you say... Well... if i am correct in asuming that you are around 30..., then it says that you are part of a 20% minority in that target group that wears a wristwatch...,and that you are a price conscious young man... I would need the brand and model of the watch to say any more...

    4) I can see that..., for years now..., Turnipette ElaineB hasn't been able to find one single picture of Mme. Kirchner wearing Louboutins...

    1) Is anything I quoted from The Bubble actually wrong? You and EM don't seem to be saying the same thing about the Los Sauces investigation. Plus the whole thing seems dodgy to me. Politicians pressing charges against their rivals, judges who are biased but nevertheless continue working on the case, and the government attacking the judges for doing their job. And then there are the wire-taps... Do you trust the justice system to give a fair verdict?

    2) It would be more convincing if you didn't keep going on about how brave, beautiful etc, CFK is. But I wasn't here when she was president so I don't know how often you disagreed with her in practice.

    3) 20% sounds way too low. I'm sure most of my friends wear watches and a few have Smart Watches. I don't remember the model, but it's just a normal watch with no fancy features, except for being solar powered; I got tired of replacing the battery. I catch the train to work so I need to know the time.

    4) I was going to have a look and see if there are any pictures of CFK wearing Louboutins, but then I realised I have no damn idea how to tell if a shoe is a Louboutin or some cheapo brand. Oh well.

    Oh, not rattled at all, but thank you for worrying about me. In my previous post I just stated some facts that show how a particular judge has been investigating former president Cristina Fernandez.
    One of those facts tells you that a judge has been working hard and two years and 40 search warrants later, he hasn't found the smoking gun. So, he decides to: Prosecute Cristina. Seize her money. Seize her passport. Next, he hands the whole thing to a colleague...to see if he can have better luck perhaps?
    Now you can come up with other facts, for example, and demonstrate mine are wrong.

    You claim of having gone to Argentina “with a completely unbiased view and gained my insight by meeting people of all incomes and political views” I do recall that the electors were about half and half in the last election. So if you spoke to a representative sample of the population you got feedback about 50-50. However, you seem to have taken into account about half of the input. What happened to the other half?

    Anyway. You seemed to almost make sense in some lines of your posting. But then you come up with things like this:

    Now, Elaine, how serious your sources are? How trustful the people you talk to who are? In the current times, people are beginning to compare. Today I listened to real owners of small and medium-size companies. I wanted to cry. Metalmechanics, textile, plastics, electronics, some with 10 workers, others with 100. They spoke about how dropping domestic purchase power and wide-open imports are hurting their sales--in the last 15 months. Tomorrow, there is the first general strike that the Macri government faces.

    In the meantime, you haven't spoken a single word about the current situation in Argentina. All we get from you is how bad Cristina was. Really, Elaine--how objective you think you are?

    I would like to know the following, Is there any justice in Argentina ? As one judge hands it to another and so it goes on, does anyone get justice? It seems to me that you go to trial if ever and at the last minute the court says “ Oh you have to come back next year as the government has changed and the judge has been suspended” .Nisman case has been going on for how long? and still no-one has found out whether he killed himself or was murdered. Jesus, thank the Lord I don't live in such a f***ked up country.

    This reminds me of a similar claim that the Troll made about the Panama papers before they were available in any accessible format and before anyone (including the Troll) had actually read them all. I called him out on it and he did his usual name change by way of running away from the challenge.

    So, to your claims:
    - “no proof” - this would be true since nothing would be proven in law until the case is heard so I'll give you that one. But, if nothing is proven until the case is heard why are you trying to make a deal about something that cannot, legally, be present in the report?
    - “no evidence, no findings” Really? The results of all of the searches would be evidence, even if they don't indicate any guilt.

    So, can you point to the source of your claims?

    Or did you invent them to fit your world view and then reported them as some sort of credible “facts” in the hope that we'd believe you based on your reputation?

    Poor Gauchito Drink. Trying to cover up the fact that Baez was in fact the main beneficiary of public contracts in Patagonia. He was a close friend of the Kirchners, and even built Nestor's Mausoleum, so yeah he was a major beneficiary, and worked the game in the heart of Kirchner's domain.     I did not state what I did in my previous posting in hopes to be believed by anyone here. I will come back on the topic when something new happens. In the meantime, just think about this: Clarin has been reported every single day about findings allegedly compromising Cristina, Maximo, Florencia, etc. You would think that after 40 search warrants they would have come up with the smoking gun. However, so far they have found nyet, nada, zilt, nothing--or you would have it on Clarin's front page in catastrophe-size characters.

    However, an open trial is an open trial, and while a person should be presumed innocent until proven guilty, it does cast a shadow over a personality. The beauty of it is, a trial can remain undecided for a long time, and even if in the end there are no findings, it will have accomplished its mission anyway. They call it a SLAPP, that is Strategic lawsuit against public participation.

    Anyway--today's news from Argentina got much more interesting with Macri facing its first general strike and remaining more in denial than ever.

    I am truly not worried about you as you live in a safe and prosperous country.

    I am well aware of how to take a sample view across disparate sources. I don't rely on or believe any one point of view or source. I information gather in order to form my OWN opinion.

    As to how trustworthy are the people I talk to, well, that is part of the process in forming a view. One cross references, fact checks and looks at perspective. It is a well-worn path for the open-minded. You seek to dismiss the opinions of Argentines living in Argentina when they don't correspond with your indoctrination. I listen to all points of view, even yours, before reaching a conclusion and even then I am open to adjusting my position.

    CFK used her office and power to amass a fortune. Nestor started the whole scam and she continued. Now she is being investigated and it may take years to unravel her corruption but that money belongs to the people of Argentina.

    Not at all. I would be okay if Cristina were brought to an impartial trial after evidence provided some reasonable presumption of guilt. Such is not the case, as judge Bonadio's investigation lacked proof and a previous investigation had been taken from him because of serious irregularities. Currently the best demonstration of Bonadio's inability to find anything worth a process is that he declared himself incompetent--and handed the 392-page file to another judge, Julian Ercolini.

    Oh, but before this, the corageous judge indicted Cristina and a bunch of other people-including her children. The story above forgot to point that Florencia Kirchner was 12 in 2003 and 16 when Los Sauces society was formed.

    ”According to the charges the (Los Sauces) company created in 2006 by the presidential couple and their son Maximo could have been used to rent out rooms and spaces, which were really massive transfers from contractors Baez and Lopez who were awarded over priced public works.”

    Again. After executing 40 search warrants, Bonadio found out that all the real estate properties managed by Los Sauces were rented, that tenants were paying market-value rent, and such payments were done by cheques that were deposited in banks.

    What else could have Bonadio done to save face than indict CFK and next get the hell out of there by passing the - cold - potato over to somebody else?

    I find it hard to believe that the Judiciary would actually lay charges if in fact they didn't have evidence from their investigations that CFK is guilty.

    The trial will determine that.

    EM seems very concerned that it will go ahead.

    Perhaps he can predict the real result.

    CFK could not be prosecuted whilst a serving President. It is why she tested the waters for changing the constitution to allow her a third term but by then her approval rating was diving and the idea was dead in the water. The reason she is being investigated now is because she no longer has immunity.

    At least in Argentina and whatever the diccionary says, “persecución” is never used in the way “prosecution ” is used in judiciary jargon in English.
    Persecución (perseguir) means physically running after someone and also harass, or have Other obnoxious attempts to harm, physically or psychologically somebody.

    So this is a real blunder for judge Bonadio, who was betrayed his inner thoughts.

    Thanks, and the newspapers agree with you both that it was an odd and revealing thing to say, but then what does persecución mean in these phrases:

    “Cristina Kirchner cambió radicalmente la política de su esposo, luego de que murió, porque éste promovía la persecución de los iraníes reclamados por la justicia argentina.”

    “...que el directorio de Interpol, integrado por todos los países del mundo, aprobó cuando aceptó la persecución internacional de cinco altos dirigentes del régimen de Teherán.”

    “...omitir la persecución de un hecho delictivo”, entre otros motivos.”

    It's odd, because it would be a very natural mistake in English, switching 'persecution' for 'prosecution', but the closest word Think could come up with was 'procesamiento'.
